Commissioners' Court of Gass County,
Texas,
We, the undersigned,.being more than
50, resident property tax paying voters
| of the hereinafter described and defined
territory, designated and known as
| "Consolidated Road District No. 1" of
Cass County, Texas, respectfully pray
your Honorable Court to order an elec-
tion in said District to determine the
following proposition:
Whether or not the bonds of said con-
solidated Road District No. 1 of Cass
County, Texas, shall be issued in the
sum of $250,000, for the purpose of the
purchase and construction of district
roads and the farther construction,
maintenance, and operation of macada-
mized, graveled or paved roads and

such consolidated district as follows:
First, Bonds to be issued in the ag-
gregate of $91,000 for the purpose of the
purchase and construction of district
roads in said consolidated district, and
which bonds shall hav-e the same dates
of maturities, bear the same rates of in-
terest and have similar options of pay-
ment as the bonds heretofore issued and
now outstanding against Road District
Nos. One (1), Four (4). Six (6) Nine [9],
Eleven [11], arid Thirteen [13] of tsaid
Cass County, TeXas.
Second. Bonds to be issued in the
aggregate sum of $160,000for the further
construction, maintenance and operation
of macadamized, graveled or paved
roads and turnpikes, or in aid thereof
throughout such consolidated road dis-
trict, and which bonds shall bear inter-
est at the rate of 5 1-2 per cent per an-
num, and be made td mature at such
times as may be fixed by the Commis-
sioneis' Court of Cass County, Texas,
serially or otherwise, not to exceed 80
years from date thereof.
We further pray your Honorable Court
that at sueli election there shall also be
submitted to the resident property tax-
paying Voters of said Consolidated Road
District No. 1 of Cass County, Texas,
the question as to whether or not a tax
shall be levied upon the property of said
Consolidated Road District subject to
taxation for the purpose of paying the
interest on said bonds and to provide a
sinking fund for the redemption thereof
at maturity.
The territory which we pray your
Honorable Court to create and establish
as "Consolidated Road District No- I"
of Cass County, Texas, is the same terri-
tory comprising Justice Precinct No 1
of said County and is described by metes
and bounds as follows, to-wit:
Beginning on the north line of Marion
county at the point where Black Cypress
Bayou enters said county and runs north
with the meanderings of same to the
mouth of Kelly's Creek, on north with
Kelly's Creek to the point where said
•reek crosses the N. line of the H. Buck-
ner survey of laud;
Thence E, with N. line of same S. line
of J. Nail and W. F. Young surveys
crossing Flat Creek and on east on a
straight line to the S. line of the John
Lick League Survey and W. Donah o to
the channel of Johns Bayou.
Thence S. with the W. Bank of said
Bayou to where it enters Frazior's Bay-
ou and on S. with said Frazior's Bayou
to the N. line of Marion county; •
Thence W. with N. line of same to
Black Cypress Bayou the place of begin-
ning.
And it appearing affirmatively to tire
Court that said petition is signed by
more than 50 of the resident property
tax paying voters of said consolidated
district, and it further appearing affirm-
atively that the amount of bonds to be
issued will not exceed one-fourth of the
assessed valuation of the real property
of said consolidated district, and it fur-
ther appearing affirmatively that the
following road districts in said territory
have heretofore issued road bonds under
the provisions of Chapter 2, Title 18,
Revised Statutes of the State of Texas,
as follows:
Road District No. l: Date of bonds
June 15, 1917, numbered consecutively
from one (1) to forty (40), inclusive, in
the denomination of $1000 each aggro-
gatiug $40,000, payable at State Treas-
ury or County Treasurer's office,Linden,
Texas, 40 yeats from date, redeemable at
the option of the district after 20 years
from date, with interest at the rate of 5
per cent per annum, payable semi-annu-
ally, $30,000 of which bonds arc still
outstanding; bonds No's, 12, 13, t t and
19 having been paid off.
Road District No. 4: Date of bonds
July 10, ,1017. numbered consecutively
from one (1) to eight (8], inclusive, in
the denomination of $1000 each agregat-
ng $8000, payable at State Treasury or
County TreRsurer's office, Linden, Texas,
40 years from date, redeemable at the
option of the district at any time after
20 years form date, with interest at rate
of 5 per cent per annum, payable semi-
annually, $8000 of which bonds are still
outstanding.
Road District No* 6: Date of bonds
August 15,1917, numbered consecutively
from one [l]<to forty [40J, inclusive, in
the denomination of $1000 each, aggre-
gating $40,000, payable at State Treas-
ury or County Treasurer's office, Linden,
Texas, 30 years from date, redeemable at
the option of the district at any time
after 20 years from date, Mth interest at
the rate of .5 per cent per annum., paya-
ble semi-annually, $28,009 of which
bonds are still outstanding; Bonds No's
8, 9, 10, 11, 12, 13, 27, 28, 31, 32, 3.3 and
37 having been paid off.
Road District No. 9: Date of bonds
Jan. 1, 1918, numbered consecutively
from one [1] to ten [101, inclusive, in
the denomination of $1000 each, aggre-

from one [1] to five [J], inclusive, in

gating $5000, payable at State Treasury
or County Treasurer's office. Linden,
Texas, 30 years from date, redeemable at

July 8, 1918, numbered consecutively

the denomination of $1000 each, aggre-
gating $1000, payable at State Treasury
or County Treasurer's office, Linden,
Texas, 30 years from date, redeemable
at the option of the district ct any time

It is therefore considered and ordered
by the Court that an election ,be held
in and throughout said consolidated road
district No; 1, of Cass county, Texas, on
the 12th day of June, 1924, whi<Sli is not*
less than 30 days from the date of this
order, at which election the following
proposition shall he submitted:
Whether or not the bonds of Consoli-

Texas, shall be issued by the Commis-
sioners' Court of said county in the sum
of $250,000 for the purpose of the pur-
chase and construction of district roads
and the further construction and main-
tenance and operation of macadamized,
graveled or paved roads and turnpikes,
or in aid thereof, throughout said con-
solidated road district No. 1, of Cass
county, Texas, as follows
First: Bonds to be issued in the ag-
gregate of $91,000 for the purpose of the
purchase and construction of district
roads in said consolidated district, and

throughout such consolidated road dis-
trict , and which bonds s&ffll bear inter-

num, and be made to mature at such
times as may be fixed &y the Commis-
sioners' Court of Cass Councy, Texas, se-
rially or otherwise, not to exceed 30
years from date thereof.
And whether or not a rtix shall be lev-
ied upon the property of said consolidat-
ed road district No. 1, of Cass county,
Texas, subject to taxation for the pur-
pose of jraying the interest on said bonds
and to provide a siAltlng fund for tile
redemption thereof at maturity.
Said election Shall be held under the
provisions of Const Motion and laws of
the State ipf Texas', and particularly
Chapter 2, Title 18, Revised Statuted of
1911, and Chapter 3&, Acts of the Second
Called Session of the ilCth Legislature of
the State of Texas',-end Chapter 41, Acts
of the Regular Session of tbe 37th Leg-
lature of the State of Texas.
All persons who are legally qualified
voters of this State and of this County
and who arc resident property tax pay-
ers in said consolidated road district
No. 1, of Cass county, Texas, shall be
entitled to vots at said election, and a'l
v iters desiring to support the proposi-
tion to issue said bonds and1 levy said
tax shall have written or printed on
their ballots the wortfe.
"For the issuance of bonds and the
levying of the tax in payment thereof."
And those opposed thereto shall have
written or printed on their ballots the
words:
"Against the issuance of bonds and
the levying of the tax in payment
thereof."
The polling placcs and presiding offi-
cers shall be respectively as follows;
Linden with S. L. Harper as Presiding
Officer.
Lanier, with John Dodd as Presiding
Officer.
Kildare, with Bob Moore as Presiding
Officer. ,
Lewis, with G. VV. Whatley as Presid-
ing Officer.
Bear Creek, with J. G. Erwin as Pre-
siding Officer.
Concord, with Harvey Ray as Presid-
ing Officer. \
Galloway, wit&C. C Hiats as Pre-
siding Officers.
Roach, with J. O. Cowgill as Presid-
ing Officers.
The manner of holdiug said election
shall be governed by the general laws of
the State of Texas regulating gcuetal
elections when not in conflict ftith tils
provisions of the statutes hereinabove
referred to.
Notice of said election sltiill be given
by publication of a copy of this order in
The Cass County Sun, a newspaper pub-
lished in said eotiMilidated district for
four successive weeks before the date of
said election, the first publication of
which shall be at least 28 days before
the date of said election, and in addi-
tion thereto, there suall be posted other
copies of this order at three public places
in said consolidated district, one of
which shall be at the Court House door,
for three weeks prior to Said election.
The County Judge is hereby directed
to cause said notices to be published and
posted as hereinabove directed, and fur-
ther orders are reserved until the returns
of Said election shall have been made by
the duly authorized election officers and
received by this Court.
