Their Local Schools
Local financial support of Tex-
as' public schools has kapt pace
in-ith the greatly increased state
aid during the last decade.
A comprehensive state-wide
study has just been released by
the Texas State Teachers Associa-
tion in cooperation with the State
Department of Education. It dis-
closes that through increased^pro-
perty valuation or hikes in taxes
most local school districts are do-
ing their share in paying the cost
of their schools.
During the 1946-4-7 school year,
the latest for which complete
figures are available, the study
disclosed that the state paid 53
per cent of the cost of education
and the local districts 47 per cent.
These approximate figures
hold true for each of the last ten
years despite the fact the con-
stitution of Texas provides that
the state shall pay f<jv two-thirds
N>f the coBts of the schools.
Most Bchoola have nine_month
terms. The constitution sets out'
that "the state shall maintain
and support schools for. not less
than six months."
Expenditures for public schools
have increased from a total of
$76,706,149 in 1935-36 to $137,-
609,088 during 1946-47. The local 1
support in 1935-36 was 51 per cent
to 49 for the state. The average
salary of teachers in the mid
thirties was approximately $1100.
Shortly after the depression
years Texans became conscious of
the deficiencies in their school
system and set about to give il
more financial aid, the report
noted.
As the legislature hiked appro-
priations for the schools, the lo-
cal districts also increased their
levies and property valuations.
During the 1941-42 school year
local districts bore 51 per cent of
the cost of education. They col-
lected taxes amounting to $47,-
375,861. The state supplied $44,-
610,190.
Both state and local support
jumped in 1946-47. The legisla-
ture in 1945 increased the maxi-
mum tax rate that may be voted
by common and independent
school districts to $1.50.
The result was that the dis-
tricts took advantage of it. Local
tax support in 1946-47 totaled
$64,116,512. The state supplied
$73,392,576.
The larger districts, especially,
increased their levies. During the
last school year more than 50
per cent of alj children of scholas-
tic age in independent school dis-
tricts resided in districts which
now.levy a tax rate above $1.00.

H. J. R. No. 13
amending Section 15 of Article
XVI of the Constitution of the
State of Texas, by adding thereto
a provision that the husband and
wife from time to time may in
writing partition between them-
selves in severalty or into un-
divided interests all or any part
of their community property,
whereupen without prejudice to
the right of existing creditors the
portion or interest set aside to
each spouse shall be and consti-
tute a part of the separate pro-
perty of such spouse; fux-ther pro-
viding that such Constitutional
Amendment if adopted shall bo
self-operative and self-executing;
providing for the submission of
this Amendment to the \oters of
this State; prescribing the form
of ballot; providing for the pro-
clamation and publication thereof.
Be it resolved by the Legisla-
ture of the State of Texas:
Section 1. That Section 15 of
Article XVI of the Constitution of
the State of Texas be amended so
as to read as follows:-
"Section 15. All property, both
real and personal, of the wife,
owned or claimed by her before
marriage, and that acquired after-
ward by gift, devise or descent,
shall be the separate property of
the wife; and laws shall be passed
more clearly defining the rights of
the wife, in relation as well to her
separate property as that held in
common with her husband; pro-
vided that husband and wife, with-
out prejudice to pre-existing credi-
tors, may from time to time by
■written instrument as if the wife
were a feme sole partition be-
tween themselves in severalty or
into equal undivided interests all
or any part of their existing com-
munity property, or exchange be-
tween themselves the community
interest of one spouse in any pro-
perty for the community interest j
of the other spouse in other com-
munity property whereupon the J
portion or interest set aside to'
each spouse shall be and consti-
tute a part of the separate pro-
perty of such spouse.
This Amendment is self-opera- I
tive, but laws may be passed pre-
scribing requirements as to the •
form and manner of execution of
such instruments, and providing
for their recordation, and for such
other reasonable requirements not
inconsistent herewith as the
Legislature may from time to
time consider proper with relation | Located
