your inability to perform satisfactor-

''The post qT attorney ceneral was
the first high nnblic nlare eves held
by Mr. Daughenty and his adminis

was perhaps more continually under

Mr. Daughery was frequently as-

Result- of Conspiracy.
"I have often advised you that my
nomination is part of the program
how being carried out; tho origin of
tho persistent and vindictive attempt
to discredit mo as attorney general
rs woH known It principally proceeds
from two sources: the powerful indi-
viduals and organizations who resent

"This partnership of the rioter and
the war profiteer has ceaselessly
sought to break down the faith of the
American people in me and in tho de-
partment of justice. In the high
court of impeachment their attempt to
fasten guilt upon me collapsed in dis-
grace to its originators and they did
not dare appeal again to the constitu-
tional -caurL In the low . court of
scandal gossip rumor and inuendo to
which appeal is now made it will
iave no better success with the peo-
ple of this country who read and
think and believe in justice and the
3quare deal but coupled with threats
of similar treatment of other public
men it has impressed politicians who
think everything of personal and par-
ty expediency and nothing of the prin-
ciple involved with the necessity of
offering me as a sacrifice to propitiate
the vengeful interests which seek my.
destruction.
Request Is Vntlntcly.
"I cannot escape the conviction Mr.
President that your request for w
resignation is also most untimely. It
somes at a time wliep the truth is
banishing falsehood from the public
mind even though I have not as yet
had an opportunity to place upon the
witness stand before the senate com
mittee a single witness in my defense
or in explanation or rebuttal of thef
whispered and gossipy charges!
against me.
"No better . evidence of the failure
to substantiate charges of wrongful
action on my part could be offered:
than the character of the proceedings
by the senate committee engaged in i
conducting tnc present inquiry. If
my accusers had believed mc guilty
they would have been scrupulously
careful to select as members of tho
tribunal men of judicial character
with open minds in order that an un-
prejudiced verdict might be rendered.
Tho choice 'as majority members of
this committee of men .some of whom
who hayet ppenly bitterly and falsely
assailed me' under senatorial immuni-
ty and who had assailed my adminis-
trationfof the department of justice;
the .designation of a merahcr of this
court as prosecutor who is the respon-
sible author of the resolution agaifist
me; the refusal to apply to the pro--cecdings
any rule of evidence or. to
grant to me tho customary Immediate
rieht of cross exnmlnntinn ami nnt-lv
opportunity for rebuttal; and above
all the character of the witnesses in
cluding blackmailers. DOotlOffirers.
confessed corruptionalists and dis-
charged and discredited government
employes not one of whom has given
testimony that would be admitted as
evidence in the most loosely conduct-
ed court of the land all this proves
to fair-minded men that in the ab-
sence of comnetent anrl.crnrlihin ioqtU
-mony the elements in control of this
commitee seek to conyict me by im-
material and malicious gossip related
by irresponsible witnesses. In su6h
a tribunal by such methods and out
of the mouths of such witnesses an
honet man could be convicted of any
crime."
