The Vote on the Street Railway Franchise not Unanimous
Length of Time Brings on Heated Discussion.
Last night's meeting of the city
council was teeming with features and
oratory. The oratory was not confined
to speech making but was rather a
round-table talk in which everybody
was privileged to take part. The dis-
cussion was precipitated by the pre-
sentation of a street railway franchise
ordinance wjiich grants to Messrs.
W. S. Walker and A. E Chandler -a
franchise' for constructing and main-
taining a street railway system in the

There is not a newspaper man in the
state of any prominence who has not
at some time stated that rather than
have the anti-pass law killed he would
prefer to have it even with the ex-
change contract clause in it and that
was no doubt the sentiment of the
Governor. Besides as a lawyer he
knew that the clause was not binding
upon the railroads and that it could
be avoided if they desired it. Other
competent attorneys have since re-
peatedly advised the Texas Pivss As-

exchange advertising for transporta-

nance in such manner as to give the
public reasonably good and efficient
service shall be good and. sufficient

franchise hereby granted.
Sec. 11. The work of construction
of said railway shall begin on or be
fore the 15th day of January 1909 and
shall be completed (from the Frisco
depot through the business section of
the city as stated inSectlon one (1)

rights privileges and franchise hereby
granted and conveyed the said W. S.

men of the city and policemen in the
employ and pay of the city annual
pass cards for free transportation on
the cars of the said railway company.
And on the 10th day of January of
each year during the life of this fran-

shall report under oath the gross re-
ceipts of said railway company for
the previous calendar year and for
the first twenty (20) years of the life
of this franchise pay to the city of
Brownwood one (1) ir cent of the
two (2 j per cent of the gross recepts
from the operation of the said railway
line for the calendar year just preced-
ing shall be paid to the city of Brown-
wood Texas. The city of Brownwood
bond by the City Council of Brown-
wood. And operation of said line shall
commence and be continuous from

the city.
Sec. S. "The cars on this line shall

tern. Sec. 9. The regular transportation
shall not exceed five (5) cents or each
person from the point of embarking
to the point of disembarking (children
under six (0) years of age shall be
exempted from paying fares). It fs

way company in the construction and
operation .of the said street railway
shall adopt such reasonable system
that will enable parents or guardalns
of pupils attending the public schools
or college's of the city to obtain trahs:

In raising objection to the ordinance
Messrs. Kfdd and McChristy say they
are as anxiotis as any Browood citi-
zen to get a street car system but that
they find from experience of other
towns that the council cannot be too
.-ureful in giving their franchises.
They want to know that the car line
will be built if the franchise Is gra'nt-
ed. therefore they insist on a larger
bond or guarantee money. "Street
car franchises." said Alderman Mc-
Christy. "are going to be worth some-
thing before many years and when
they are worth a price Brownwood will
.get a car system then why hurry to
give ours away especially for a term
of forty years."
After reading over the franchise

length of time because it Was cus-
tomary to give long term franchises
for street railways but that he would
object to the amount of the bond. "I
think the guarantee money should he
sufficient to. insure the building of the
road if the franchise Is granted be-
cause the council does not care u
waste time in considering a franchife
where people are merely speculating
and a man who means to build tile
road is not going to object to giving
a bond worth the city's while to ac-
cept. The road constructed after the
pians ouumeq would cost in the
neighborhood of $:10000 to $40000 and
a $500 bond is not a good guarantee
that such an investment will bfl
