Conservation News
E. C. Kennedy and Johnson
Avery, both of the Smyrna Con-
servation Group, are very enthus-
isastic about conservation farming
after attending short course, Ark-
ansas A and M and sponsored by
the press. Mr. Kennedy, leader of
the group says, ''I saw much con-
servation on the ground. But the
work I have seen in the Marion-
Cass Soil Conservation District is
comparable to that which I ob-
served on the trip. Mr. Kennedy
signed a district agreement the
first part of the year and has al-
ready established a aericea mea-
dow and flat broken, leveled, fert-
ilized and seeded his terrace out-
lets. At present, he has contracted
for his stock water pond to be
built. Terrace construction is to

farmers could do just one conserva
tion job a year we would even-

Joe Fulcher of the Naples Con
servation Group, and Mr. Roy
Melton, of the Lone Oak Conserva
tion group are building their stock
water pond this week.
Wilder B. Allsup of the Nichols
Conservation group came in Thurs
day morning to the office of the
Soil Conservation Service request-
ing the farm engineers assist him
in locating a stock water pond and
for the soil scientist to furnish
technical data on his soils.
W. Garrett Baker of the Baker
Conservation group is now in the
process of building over a mile of
drainage ditches in his pasture.

These ditches were designed by
the farm engineers of the soil con
servation service to give the water
the greatest amount of velocity.
The dirt forms a level on one side,
forcing overflow water to spread
on the upper side. This will permit
all receding flood water to get
back into the ditch which will leave
the pasture dry. Mr. Baker plans
a heavy seeding to lespedezas and
clovers and says that his pasture
carry 1 cow per acre.

viding for the submission*of .his Amend-
ment to the voters of this State; proscrib-
ing tho form of ballot; providing foi the
proclamation and publication thereof.
BE IT RESOLVED BY THE LEGISLA-
i'UHE OF THE STATE OF TEXAS:
Section 1. That Section 15 of Article
XVI of tho Constitution of the State of
Texns be amended so as to read as fol-
lows;
"Section 15. All property, both real and
personal, of tho wife, owned or claimed by
her before marriage, and that acquired
afterward by gift, devise or descent, shall
be the separate property of the wife; and
laws shall be passed mors clearly defining
tho rights of the wife, in relation as well
to her separate property hs that held in
common with her husband; provided that
husband and wife, without prejudice to
pro-existing creditors, may from timo to
time by written instrument as if the wife
were a feme solo partition between them-
selves in severalty or into equal undivided
interests all or any part of their existing
community property, or exchange between
them*< r>e*h tho community interest of one
apouse in any property for the community
interest of the other spouso in othor com-
munity property, whereupon the portion or
interest set asido to each spouse ithall bo
and constitute a part of tho separate prop-
erty of «uch spouse.
This Amendment is self-operative, but
laws may be passed prescribing require-
ments as to the form and manner of exe-
cution of such instruments, and providing
for their recordation, and for such other
rc.'isonnble requirements not inconsistent
herewith aa tho Legislature may from time
to time consider proper with relation 1o
the subject of this Amendment. Should tha
Legislature pass an Act dealing with the
subject of this Amendment and proscrib-
ing requirements as to the form and man-
ner of the execution of such instruments
and providing for their recordation and
other reasonable requirements not incon-
sistent herewith and anticipatory hereto,
such Act shall not bo invalid by reason of
its anticipatory character and shall take
effect just aa though this Constitutional
Amendment was in effect when the Act
was passed."
Sec. 2. Tho foregoing Constitutional
Amendment shall bo submitted to a vote of
tho qualified electors of the State of Texas
at an election to be held throughout tho
State on the second day of November, 1948,
at which election all voters favoring said
proposed Amendment shall write or have
printed on their ballots the words:
"FOR the Amendment to the Constitu-
tion of tho State of Texas provided that
husband and wife from time to time may
in writing partition between themselves in
severalty or into undivided interest com-
munity property existing at the time of
partition so aa to convert same into sepa-
rate property of tho resepctive spouses
without prejudice to the rights of pre-
existing creditors."
Those opposing said proposed Amend-
ment shall write or have printed on their
ballots tho words:
"AGAINST the Amendment to the Con-
stitution of tho State of Texas providing
thnt husband and wife from timo to timo
may in writing partition between them-
selves in severalty or into undivided inter-
ests community property existing at tho
time of partition so as to convert same
into separate property of the respective
spouses without prejudice to the rights of
pre-existing creditors."
Sec. 8. Tho Governor of the State of
Texas is hereby directed to issue the neces-
sary proclamation for aaid election and
have same published as required by the
Constitution for amendments thereto.

A JOINT RESOLUTION
proposing an amendment to Section 28 of
Article III of the Constitution of the State
of Texas, so as to provide for a Board for
apportioning the state into senatorial dis-
tricts and representative districts in the
event the Legislature fails to make such
apportionment; providing for the issuance
of tho necessary proclamation by the Gov-
ernor: and making an appropriation.
BE IT RESOLVED BY THE LEGISLA-
TURE OF THE STATE OF TEXAS:
Section 1. That Section 28 of Article III
of the Constitution of the State of Texas
be amended so as hereafter to read as fol-
lows:
"Section 28. Tho Legislature shall, at its
first regular session after the publication
of each United States decennial census,
apportion the state into senatorial and rep-
resentative districts, agreeable to tho pro-
visions of Sections 25, 20, and 2C-a of this
Article. In the event the Legislature shall
at any such first regular session following
tho publication of a United States decen-
nial census, fail to make such apportion-
ment, same shall he done by tho Legisla-
tive Redisricting Board of Texas, which
is.hereby created, and shall bo composed
of Ave (5) members, as follows: The Lieu-
tenant Governor, the Speaker of the House
of Representatives, the Attorney General,
tho Comptroller of Public Accounts and the
Commissioner of the General Land OtTic . u
majority of whom shall e<fc.stitute a quo-
rum. Said Board shall assemble in 'he
of Austin within ninety (90) days after
tho final adjournment of such regular m>-
sion. Tho Board shall, within sixty (GO)
days nfter assembling, apportion the state
Into sonatorial and represent a' ivo districts,
or into senatorial or representative dis-
tricts, as tho failure of action of such Leg-
islature may make necessary. Such appor-
tionment shall be in writing an I signed by
three (3) or moro of tho members of the
Board duly acknowledged as the act and
deed of such Board, and, when so executed
and filed with the Secretary of State, shall
have force ami effect of law. Such appor-
tionment shall become effective at the next
succeeding statewide general election. The
Supremo Court of Texas shall have juris-
diction to compel such Commission to per-
form its duties in accordance with the
provisions of this section by writ of man-
damus or other extraordinary writs con-
formable to tho usages of law. The Legis-
lature shall provide necessary funds for
clerical and technical nld and for other
expenses incidental to the work of the
Board, and tho Lieutenant Governor Mid
tho Speaker of tho House of Representa-
tives shall be entitled to receive per diem
and travel* expense during the Board's ses-
sion in the same manner and amount «i*
they would receive while attend'.ng a *pe-
cial session of tho Legislature. Thii amend-
ment shall become effective January 1,
1951.M

resentative districts in the event the Leg-
islature fails to make such appoit<r>nmrnt.
"Against the amendment to Section 28,
Article III of the Constitution -if Texas
providing for a Board for apportionment
of the stato Into senatorial districts and
representative districts In the event the
Legislature fails to make such apportion-
ment."
Each voter at such election shall mark
out one of such clauses on the ballot, leav-
ing the clause expressing his vote on the
pioposcd amendment.
Sec. 3. The Governnor of the State of
Texas shall issue the necessary proclama-
tion for said election, and shall have the
same published as required by tho Con-
stitution and laws of this state.
Sec. 4. Thto sum of Ten Thousand (110,-
000.00) Dollars or so much thereof as may
be necessary, is hereby ftporoprinVd out of
any funds in tho trensury of this state not
otherwise appropriated, to pay tht expenses
of such publication and election.

amount of erosion, on the farms
of the Marietta Group at present.
