(d) Beginning in the 2011-2012 school year, a student in Grade
8 or lower who takes a high school course for credit is required to take
the applicable EOC assessment specified in the TEC, 39.023(c). The
EOC assessment result shall be applied toward the student's [course
grade requirement as speifed by subsetion (e) of this seion and]
assessment graduation requirements, as specified in 101.3022 of this
title.
(e) If a student earned high school credit for a course for which
there is an EOC assessment as listed in the TEC, 39.023(c), prior to
enrollment in a Texas public school district and the credit has been ac-
cepted by a Texas public school district, or a student completed a course
for Texas high school credit in a course for which there is an EOC as-
sessment prior to the 2011-2012 spring administration, the student is
not required to take the corresponding EOC assessment as listed in the
TEC, 39.023(c).

EO assessment for a course for which a student received credit

TEC, 39.023(c), only if the student previously failed the EOC assess-

101.3022. Assessment [and Cumulative Seore] Requirements
for Graduation [the tMinimum-,; Reeo tmeded, and Distinguished
Achievement High School Programs].
(a) Beginning with students first enrolled in Grade 9 in the
2011-2012 school year, a student must meet satisfactory perfor-
mance on each end-of-course (EOC) assessment listed in the TEC,
39.023(c), except in cases as provided by subsection (b) of this sec-
tion and 101.3021(e) of this title (relating to Required Participation
in Academic Content Area Assessments), in order to be eligible to
receive a Texas diploma. [under-]
1(4-) the minimum high school program (M ISP) must take
an end-of-~our se (O) assessment for courses in which the student is
enrolled and for which an EOG assessment is available. If a student on
the M4SP takes a course that is not specifically listed as a requirement
of the MUS the student must take the applicable E G assessment as
listed in the Texas Edueation Gode (TE (39.023(), and the student
will have the option of using the assessment's score toward the st-
dent' cumulative score requirement specified in subsection (of this-
setion 1

Algebra 14 in order to fulfill the mathematics redit requirements of

World History Studies or World Geography Studies in order to fulfin4

(@) If a student on the MUSP elects to substitute Itn-
tegrated Physics and Chemistry with either Chemistry on Physics forcredit in order to fulfill the science redit requirements of the M SP
the student has the option of using the 1G assessment score for that
course toward the studentss umulative score requirement specified in
subsection b) of this seetio or
(2) the recommended or distinguished achievement hig
school program must take all 42 EOG assessments listed in the T1C
9.023( ) , ecpt in cases as provided by 10~.821(e) of this title
(relating to Required Ptrticipation in Academie Content Area Assess-
ments and Course Grading) and meet the cumulative score require-
ment specified in subsein secti onb) of this section in each of the founda-
tion content areas of English language ats mathemti, science, and
soi-ol tu, ics
(A) To receive a diploma under the recommended high
school program a student must achieve satisfactory performance on
the Algebra and English I EO assessments. The standard in place
when a student first takes a mathematics or English EOC assessment
is the standard that will be maintained throughout the student's school
career for the content areas If a student earned high school credit for
Algebra oT English ti prior to enrollment in a Texas public school
district and the credit has been accepted by a Texas public school dis-
trict or a student completed Algebra I o English HII for Texas high
school credit prior to the 2011 2012 sprng administration this pr

(B) To receive a diploma under the distinguished high
school programa a student must achieve the standard on the Algebra I
and English II assessments determined by the commissioner of educa-
tion and the commissioner of higher ucat under thefa TyaA v4fr4,, .
Ifa student earned high school credit for Algebra I or English mt prior
to enrollment in a Texas public school district and the credit has been
accepted by a Texas public school district or a tuent completed Alge-
bra T or English II for 4Texas high school credit prior to the 2011 -204-2
spring administration this provision does not apply .
(b) A student who was administered separate reading and writ-
ing EOC assessments under the TEC, 39.023(c), for the English I or
English II course has met that course's assessment graduation require-
ment if the student has met the following criteria:
(1) achieved satisfactory performance on either the reading
or writing EOC assessment for that course;
(2) met at least the minimum score on the other EOC as-
sessment for that course; and
(3) achieved an overall scale score of 3750 or greater when
the scale scores for reading and writing are combined for that course.
(c) Exceptions to subsection (a) of this section related to Eng-
lish I shall apply to English language learners who meet the criteria
specified in 101.1007 of this title (relating to Assessment Provisions
for Graduation).
