2 0 7-///-; citizens or
matagorda county.
The Commissioners' Court
feels that particular attention
§ hoi1 Id >>e called to certain
phases of the law governing the
i s.> of, or the injury to, the pub-
lic roads.
The roads of Matagorda
County have been constructed at
a cost of hundreds of thousands
*•' dollars. Their maintenance,
tinder the best of conditions,
cost annually the citizens of the
vounty and taxpayers many
thousands of dollars.
From various sections of the
. junty, almost daily, there are
vompl'aints of injuries to the
roads by reason of the passage
n>-.,r the roads and culverts of
tractors equipped with lugs thai
cut and injure the roads, cul
< . rts and bridges, and this in
reliance of Article 822 (482a)
of the Revised Criminal Stat
i:Us of 1911, which reads as fol
fcws:
"Unlawful to carry over anv
\»>hUe road or culvert any trac-
tion engine, when.—It shall lr
unlawful for any person t
transport or carry over any
public bridge or culvert, upoi
ny public road or highway, oi
any street or alley in any incor
porated town or city, any trae
t'on engine with lugs on the
viitil's thereof, c'tiu Lu carry ol
transport over any such publi
ri 'ge or culvert any tractioi
engine or separator, without
leaving first provided and placer'
position skids upon which th'
' /heels of said traction engine, or
separator shall be run, whicl'
rfaid skids shall not be less thai
three inches thick, twelve inche
in width and sixteen feet ir
! ngth; and any person violatin
I'he provisions of this articl
.-/-.all be deemed' guilty of a mis
demeanor, and, upon convictio:
thgveof shall be fined in an1
.•■inn not exceeding five hundre
.-Miliars.
Another serious cause of in
i.iry to the roads that is not un
common in sections of the coun
i v is the plowing by adjacen
i- nd owners out into the risrht
of-way or into the barroW-pit
of the roads, and in a few in
stances, the allowing of wast
vvater from artesian wells
which of itself is a crime, to flow
into the barrow-pits of the road-
ay. Another common sourc<
of injury to the roads is the usr
of the barrow-pits of the road?
as irrigation ditches.
Each and every one. of these
act; are inhibited by the follow-
ing articles of the Revised Crim-
inal Statutes of 1911:
Art. 821 (482) Destroy, injuro
«:</• misplhce bridge, culvert,
ditch, signboard, etc.—Any per
son who shall knowingly or wil-
fully destroy, injure or mis-
place any bridge, culvert, drain,
fewer, ditch, signboard, mile-
post, or tile or anything, of like
character placed upon any road
for the benefit of same, shall be
sr.ilty of a misdemeanor, and
upon conviction thereof, pun-
ched by- fine of not more than
five hundred dollars, and shall
c<> liable to the county and any
person injured for all damages
thereby.""
"Art. S2G (48oa) Wilful ob
fitmct'ion of publtc ditch or di
r< rsion of water.—If any per
.-'■n shall wilfully obstruct air
r Jilie ditch, or shall wilfully di
vf-rt the water from its nrope-
i li^nnel, he shall be deeme
guilty of' a misdemeanor, and
upon conviction thereof, shal'
be fined in any sum not less thar
flyp nor-more than five hundred
dollars, and shall also be liabl
for any and all damages accru-
ing to any person or persons or
cnrnnv+'^ri or county for an*
:yucli aci'."'
It is manifestly unjust to a1
low such injuries to the road
tri continue an-'1 a1" the sair
rime ask that the damages b
paid bv the-taxpayers of Mata
vcorda County; and for this res
son the court asks the co-oner
;*ti'on o* the eitize"sh"'n of
"(rrda County and request' that
Hie/ lie thoughtful and'careful
ftr- the use of the roads and that
v'flen individuals are found'who
