ED, That you summon, by making

judicial district; but if there be no
newspaper published in said judicial
district then in a newspaper published

judicial district, once in each week
for four consecutive weeks previous to
the return day hereof, Henry F.
Loeschner whose residence is unknown,
to be and appeear before the Hon.
District Court, at the next regular
term thereof, to be holden in the Coun-
ty of Matagorda, at the Court House
thereof, in Bay City, Texas, on the
7th day of October, A. D. 1929, then
and there to answer a Petition filed
in said Court, on the 13th day of
August A. D. 1929, in a suit numbered
on the docket of said Court No. 11860,
wherein Lina Greene is plaintiff and
Henry F. Loeschner is defendant. The
nature of the plaintiffs demand being
as follows, to-wit: Plaintiff alleges
that she is the owner in fee simple
and is in possession of a certain twenty
acx-e tra' t of land situated in Mata-
gorda County, Texas, being Lot No.
42 in Block "H" of a subdivision of
the J. Tilley Survey and the J. E.
Picrc:.' Survey; that on the 25th day
of August 1913 the defendant Henry
F. Luescher conveyed said 20 acre
tract to Jno. W. Gaines and Carey
Smith by general Warranty deed and
retained therein a vendors lien evi-
denced by three promissory vendor lien
notes of even date for $1,000.00,
$1,000.00 and $750.00 respectively, due
two years after date. Plaintiff alleges
that all of said notes were paid and
releaeses taken but that releases were
not put of record; that all of said notes
are more than four years past due and
are therefore barred by Statute.
Plaintiff says that the record of said
notes and their non-release is a cloud
upon plaintiff's title. Wherefore plain-
tiff prays that said defendant be cited
to appear and answer herein; for
judgement cancelling said notes and
for quieting plaintiff's title to said
property so far as affected by said
notes, for costs of Court and for gen-
eral relief.
HEREIN FAIL NOT, And have you
before said Court, on the said first day
of the next term thereof, this Writ,
with your endorsement thereon, show-
ing how you have executed the same.

to the defendant on the 15th day of
April, 1S07, and lived with him as his
wife until the 10th day of October,
1923, and that said marriage rela-
tion still exists; that plaintiff at all
times conducted herself with propriety
and has been guilty of no act or omis-
sion that might bring about the sep-
aration; that on or about the 10th day
of October, 1923, the defendant with-
out cause or provocation on part of
plaintiff, abandoned plaintiff, since
which time they have not lived to-
gether; Wherefore plaintiff prays that
defendant be cited to appear and an-
swer herein; for judgement dissolving
the said marriage relation and for gen-
eral relief.

Wiley, to-wit:Lots 1, 2 and 3, in Block
105, in the City of Palacios, Texas,
and on the First day of October A. D.
1929, being the first Tuesday of said
month, between the hours of 10 o'clock
A. M. and 4 o'clock P. M., on said day,
at the Court House door of said County
1 will offer for sale, and sell at public
auction, for cash, all the right, title
and interest of the said J. S. Wiley
in and to said property.

notes were given in part payment
thereof; that all of said notes have
long since been paid by paintiff and
are in his possession; that no release
of the vendor's lien has even been
given and the record of said notes
and their non-release casts a cloud up-
on plaintiff's title; Wherefore plain-
tiff prays that the defendants be cited
by publication to appear and answer
herein; for judgment cancelling said
notes and removing the cloud from
plaintiff's title and for general relief.
