Notice is hereby given that a
hearing will be had by the county
commissioners' court on the 29th
day of December, A. D. 1923, on the
petition of VV. D. Wilson and one
hundred and thirteen (113) other
persons for the establishment of a
Conservation and Reclamation Dis-
trict, filed herein on the 17th day
of November, 1923, which petition
and order of court thereon are as
follows:
PETITION TO COMMISSIONERS'
COURT OF MATAGORDA COUN-
TY, TEXAS, FOR ESTABLISH-
MENT OF MATAGORDA COUN-
TY CONSERVATION AND RE-
CLAMATION DISTRIC NO 1.
THE STATE OF TEXAS
County of Matagorda.
To the Commissioners' Court of
Matagorda County, Texas:
We, the undersigned resident cit-
izens of Matagorda County, Texas,
respectfully petition your honorable
body to establish a conservation and
reclamation district in Matagorda
County, Texas, to be known as
Matagorda County Conservation and
Reclamation District No. 1, in the
territory hereinafter described, and
in the metes and bounds herein-
after set out.
Your petitioners respectfully rep-
resent as follows:
1. That the signers of this peti-
tion are each resident free-holders
and tax payers in the proposed
Matagorda County Conservation and
Reclamation District No. 1.
2. That the State of Texas, by an
Act passed by the 38th Legislature,
at its second called session, the
said act being chapter 48, pages 102,
103, 104 and 105, of the General
Laws of the State of Texas, passed
by the 38th Legislature at its 1st,
2nd and 3rd called sessions, released
the inhabitants of, and property in
that portion of Matagorda County,
embraced in Commissioners' pre-
cincts Nos. 1, 2 and 4, as described
in the minutes of the Commissioners'
Court of said county, comprising one
district, for a period of 25 years
from the payment of taxes levied
for state purposes, as in said act set
forth and specified, upon condition
that Wharton county, conprising
one district, and that portion of Mat-
agorda county, comprising Commis-
sioners' precincts Nos. 1, 2 and 4,
comprising another district, shall
each be organized into a conservation
and reclamation district, and that
the resident property tax payers
who are qualified xoters in each of
said districts after its organization,
shall by or before October first,
1924, vote an issue of bonds for the
purposes and in amount as therein
sat out.
3. That the territory hereinafter
described comprises and includes all
of Commissioners' precincts Nos. 1,
2 and 4, of Matagorda County, Tex-
as, as described in the minutes of
the Commissioners' Court of said
county.
4. The lands belonging to each
of the petitioners herein and to each
of the signers hereto in said px*o-
posed conservation and reclamation
district will be affected by the es-
tablishment of said proposed Mata-
gorda Coutft.y Conservation and Re-
clamation District No. 1.
5. That the drainage of said pro-
posed district is a necessity, and will
be a public utility, and the drainage
of said proposed district and the
protection thereof from overflows is
practicable and feasible.
6. A necessity exists for the es-
tablishment of said proposed con-
servation and reclamation district
for the following reasons:
(a). The fact that logs, trees and
other drift has formed in the channel
of the Colox-ado River in said district
so as to dam up and retard the
flow of water; that during every
rise in said river it overflows the
country adjacent thereto and inun-
dates a large territory of fertile
lands on both sides of said river in
said district, whereby great property
damage is sustained, crops and live-
stock destroyed;
(b). It is a public utility because
by creation of such conservation and
reclamation district an economical,
practicable and feasible method of
drainage will be secured, as well as
the protection of crops and other
properties within said district from
overflows, adding much to the value
of the lands and properties therein.
(c). The drainage of said district
as well as the protection thereof
from overflows, is feasible and prac-
ticable, for the reason that the
cleaning out and deepening of the
channel of said Colorado River will
greatly increase its water carrying
capacity, thereby giving a complete
drainage system during ordinary
freshets and heavy rains, and in
conjunction with sufficient levees,
will also prevent the inundation of
many acres of fertile lands during
floods in said river.
6. The metes and bounds of the
proposed Matagorda County Con-
servation and Reclamation District
No. 1, comprising Commissioners'
precincts Nos. 1, 2 and 4, £f Mat-
agorda county, Texas, as described
in the minutes of the Commission-
ers' court of Matagorda county,
Texas, are as follows:
Beginning in the center of the
Colorado River opposite the S. E.
corner of the Buckeye Irrigation
Farm, in the C. G. Cox league;
thence W. with the south line of
said farm to the west line of the
said C. G. Cox league; thence W.
to the east line of the G. J. Williams
league; thence N. to the J. E.
Pierce pasture fence; thence W.
along said fence to the E. line of the
E. E. Dawdy tract; thence S. and
W. with said Dawdy tract to the
west bank of the Tres Palacios
creek; thence up the west bank of
said creek opposite to the south
line of the J. H. Hathaway league; !
thence W. with the south line of the |
Hathaway league to the. west line
of the said league; thence south to
*he N. line of survey No. 4, H. &
G. N. R. R. Co. survey; thence W.
* with the north line of survey Nos
4 and 3 of the H. & G. N R R
Company survey to the W. line of
said survey; thence west across the
Spark survey to the W. line of said
survey to the intersection of the
ravine or gully; thence following
the meanders of said ravine or
gulley from where it intersects Car-
anchua Creek; thence down the east
bank of said creek to the Jackson
County line; thence up said county
line to the corner of Wharton coun-
ty; .thence northeasterly along the
Wharton county line to the Bra-
zoria county line; thence southeast-
erly along said Brazoria county line
to the Gulf of Mexico; thence fol-
lowing the shore of the Gluf of Mex-
ico to the extreme western point of
Matagorda Peninsula; thence in a
straight line to the mouth of the
Colorado River; thence up the cen-
ter line of the main channel of
the river to the place of beginning.
Wherefore, your petitioners pray
for the organization and establish-
ment of said Matagorda County Con-
servation and Reclamation District
No. 1, under Chapter 4, Title 47,
of the Revised Civil Statutes of Tex-
as, as -provided for in the Conserva-
tion and Reclamation District Act,
Chapter 25, General Laws of 1918,
passed by the 35th Legislature at
its 4th called session, so that the
inhabitants of the territory herein-
above described may avail them-
selves of the taxes released by the
State of Texas hereinbefore men-
tioned.

sioners' Court of Matagorda County,
Texas, being in regular session, and
all members being present, came on
to be heard the petition of W, p,
Wilson and 113 other persons, pray-
ing for the establishment and crea-
tion of a Conservation and Reclam-
ation District In Matagorda County,
Texas, to be called and designated
as "Matagorda County Conservation ]
and Reclamation, District No. 1," and

35th Legislature at its fourth called
session, and for the organization
of said district under Chapter 4,
Title 47, of the Revised Civil Stat-
utes of Texas; and also defining its
boundaries.
And it appearing to the court
that the said petition is signed by
more than twenty-five free-hoM
property tax paying voters residing
within the boundaries of said propos-
ed Conservation and Reclamation
District, whose lands will be af-
fected by the establishment of such
Conservation and Reclamation Dis-
trict, and that said petition sets
forth the necessity, public utility
and feasibility of said proposed Con-
servation and Reclamation District,
and defines the metes and bounds
thereof.
And it further appearing to the
court that said petition is accompan-
ied by a cash deposit of two hun-
dred dollars ($200.00) as required
by law;
Therefore, be it ordered by the
Commissioners' Court of Matagorda
County, Texas:
1st. That said petition be, and the
same is set down for a hearing by
this court on the 29th day of De-
cember, A. D. 1923, the same being
more than thirty and less than
sixty days from the date hereof,
and the same being a special term
of said Commissioners' Court of Mat-
agorda County, Texas.
2nd. That the clerk of thjs court
is hereby ordered to give notice
of the filing of said petition and
of the date and place of hearing by
posting written or printed notice
thereof as required by law at least
twenty (20) days prior to the time
set for said hearing in four public
places in said proposed Conserva-
tion and Reclamation District, and
one at the court house door of said
county, and four of which shall be
within the limits of the proposed
Conservation and Reclamation Dis-
trict, and said notice shall also be
given by publication thereof in a
newspaper of general circulation
which has been regularly and con-
tinuously published for a period of
not less than one year in Matagorda
county, Texas, the date of said first
publication of said notice to be full
20 days prior to the time set for
said hearing.
3rd. That at such hearing any
person whose land is affected by
the creation of said proposed Con-
servation and Reclamation District
may appear before said court and
contest the creation of said district,
or contend for the creation of said
district, and may offer testimony
that the creation of said district js
or is not necessary, and would or
would not be of any public utility,
either sanitary, agricultural or other-
wise, and that the creation of such
Conservation and Reclamation Dis-
trict would or would not be feasible
or practicable.
