4 SUBCHAPTER C. POWERS AND DUTIES
5 Sec. 8471.101. GENERAL POWERS AND DUTIES. The district has
6 the powers and duties necessary to accomplish the purposes for
7 which the district is created.
8 Sec. 8471.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9 DUTIES. The district has the powers and duties provided by the
10 general law of this state, including Chapters 49 and 54, Water Code,
11 applicable to municipal utility districts created under Section 59,
12 Article XVI, Texas Constitution.
13 Sec. 8471.103. RESIDENTIAL OR PLANNED COMMUNITY
14 DEVELOPMENT; WASTEWATER TREATMENT FACILITY. (a) In the event that
15 a residential subdivision or planned community is developed in the
16 territory of the district, the district shall develop a wastewater
17 treatment facility in coordination with Hays County and the City of
18 Wimber ley.
19 (b) A developer who proposes to build a residential
20 subdivision or planned community in the territory of the district
21 must agree to develop the property in a manner that works in
22 conjunction with the design and specifications of any wastewater
23 treatment facility developed under Subsection (a).
24 (c) If a residential subdivision or planned community is
25 developed in the district, the district shall import water to
26 provide for the needs of that development.
27 Sec. 8471.104. LIMITATION ON USE OF EMINENT DOMAIN.5
