AN ACT in relation to courts and judicial
officer* iu the Territory of Utah
f • - Concluded.
| See. 3. That then shall be held iu cocli
; year two terms of the supreme court of
said Territory, and four terms of each dis-
trict court, at such times as the governor
of the Territory may by proclamation fix.
The district courts shall have exclusive
original jurisdiction in all suits or pro-
ceedings in chancery, and in all actious at
jaw iu which the sum or value of the thing
in controversy shall be three huudrod dol-
lars or upward, and in all controversies
whero the titlo, possession, or boundaries
of laud, or mines or mining claims shall
be iu dispute, whutuver their value, ex-
eunt in actions for forcible entry or forci-
ble and unlawful detainer; and thoy shall
have jurisdiction iu suits for divorce. Pro-
bate courts, iu their respective counties
shall have jurisdiction in the settlement of
the estatos of decedents, and iu matters of
guardianship and other like mutters; but
otherwise they shall have no civil, cliau-
cery, or criminal jurisdiction of suits of
whatever ; they shall have jurisdiction of
suits of divorcu lor statutory causes con-
currently with the district courts; hut any
defendant in a suit for divorce commenced
in a probate court shall be entitled after
appearance and before plea or answer, to
have .aid suit removed to the district
court huviug jurisdiction, when said suit
shall proceed iu like manner as if original-
ly commenced iu Haiil'ilist l iut court. Noth-
ing in this act shall be construed to im-
pair the authority of the probate courts to
enter land iu trust for the use aud benefit
of tho occupants of towns in the various
counties of the Territory of Utah, accord
ing to the provisions of "An act for the
relief of tlie inhabitants of oities aud
towns upon public lauds," approved March
second, eighteen hundred aud sixty-seven
and '*An net to auiend an act entitled 'An
act for the relief of the inhabitants of
cities and towns upou the public lands,'"
approved June eighth, eighteen hundred
and sixty eight; or to discharge the du-
ties assigned to the probate judges by an
act of the legislative assembly of the Tcr-
litory of Utah entitled "An act proscribing
rules and regulations far the execution of
the i rust arising under an act of Congress
entitled 'An act for tho relief of the inhab-
itants of cities and towns upon the public

pose, specify aud designale, and such ap-
peal shall vacutu the judgment appealed
from, anil the ease shall he tried do novo
ill tbe appellate court. Appeals may be
tuken from both justices' and probate
courts to the district court of tboir respec-
tive districts ill oases where judgments
have been heretofore rendered and remain
unexecuted; but this provision shall not
enlarge the time for taking an appeal be-
yond the periods now allowed by the ex-
isting laws of said Territory for taking
appeals. A writ of error from tho Supreme
Court of the United State-* to tho supreme
court of the Territorp nhall lie in criminal
cases, where tbe accused shall have been
sentenced to capital punishment or con-
victed of bigamy or polygamy. When-
ever tho condition of the business iu the
district court ol any district is stioh that
the judge of the district is unable lo do
the same, he may rcqne-t tbe judge of
either of tho other districts to assist him,
aud, upon such request made, the iudgo so
requested may hold the whole or part of
any term, or any branch thereof, and his
acts as judge shall be of equal force as if
he were duly assigned to hold the courts
in Mich district.
Sec 4. That within sixty days alter the
passage ot this act, and iu the month of
January annually thereafter, the clerk of
the district, court in each judicial district,
and tbe judge of probate of the county iu
whiuh tbe district court is n»xt to be, held,
shall prepare a jnry-list from which grand
aud jietit jurors shall he drawn, to serve
in the district courts, of such district, un-
til a new list shall be made as herein pro-
vided, Said clerk anil probate judge shall
alternately solect the name of a male citi
zen of the United States who has resided
in the district for the period of six months
next preceding, and who can read and
write iu the English language ; and, as se-
lected, the name and resilience of each
shall be entered upon the lis', until the
same shall c'ntain two hundred names,
when the lame shall be duly ceilified by
such clerk and probate judge; and the
same shall be tiled in the office of the clerk
of such district court, and a duplicate
copy shall lie made and certified by such
officers, and filed iu the office of said pro-
bate judge. Whenever a grand or p»iit
jury is to be drawn to serve at any term
of adlstiict court, the judg.> of mi'rIi dis

which shall be at least twelve days hefolo
the commencement of micIi term; and on
the day anil at the place thus fixed, the
judge of sui'h district shall hold an open

the drawing of such Jury ; and the clerk
of such court shall write the name of each
peisou on the jury li.ts returned and filed
in his office uikiii a separate slip of paper,
as nearly aa practicable of the samesize
aud form, acil all such slips nhall, by tbe
clerk ill open court, be placed in a covered
box, aud thoroughly mixed and mingled ;
and thereupon the United Statm marshal,
or his deputy, shall proceed to falrlv draw
by lot from said box such number of names
as may have previously been directed by
said judge; aud if both a grand aud petit
jury are lo lie drawn, the grand jury shall
bo drawn first; and when the drawing
shall have been concluded, the clerk of
the district court shall issue a venire to
the marshal or his deputy, directing him
to summon the persons so drawn, and the
sams shall be ilnly served on each of the
persons to drawn at laast seven days be-

dravyn cannot be obtained in a reasonable

peremptory challenges, exoept in oapital
cases where the prosecution and the de-
fense shall each be allowed fifteen chal-
lenges. In criminal cases, the court, and
not the jury, Bhall pronounce the punish-
ment under the limitation prescribed by
law. The grand jury must inquire into
the case of every itcranu imprisoned with
iu tbe district on a crimiual charge and
uot indiotod; into the condition and man-
agement of public prisons within the dis
trict; and into the willful corrupt miscon-
duct iu office of public officers of every
description within the distriot; and they
are also ontitlod to free access, at all rea-
sonable time's, to public prisons, r.nd to
the examination, without charge of all
publio records within the district.
8ec. 5. That there shall be appointed by
the governors of said Territory one or
more notaries public for each organized
county, whose term of ollico shall bo two
years, aud until their successors shall be
appointed and qualified. The act of tho
legislative assembly of tho Territory of
Utah entitled "An act couccrning notaries
publio" approved January seventeenth,
eighteen hundred unil sixty-six, is hereby
approved, except the first section thereof,
which is hereby disapproved: Provided,
That wherever, in said act, the words
"probate judge" or "clork ol tho probate
court" are used, the words "sec.otary of
tho Territory" shall be substituted
Sec. 6. That the supreme court of said
Territory is hereby authorized to appoint
commissioners of said court, who shall
have and exercise all the duties of com-
missioners of tho circuit courts of tbe
United States, and to tako acknowledg-
ments of huil; and, in addition, they shall
have the snniu authority as examining and
committing magistrates in all cases aris-
ing under tho laws of said Territory as is
now possessed by justices »f the peace in
said Territory
Sec. 7. That tho act of the territorial le-
gislature ol' the Territory of Utah, entitled
'An aot in relation to marshals and attor-
neys," approved March third, eighteen
li ii ml red and fifty two, and all laws of said
Terrritory inconsistent with the provisions
of this net, arc hereby disapproved. The
act of the Congress of the Hulled States
untitled "An net to regulate the fees and
costs to be allowed clorks, inarsnals, and
attorneys of the circuit nod district courts
of the United Slates, and for other pur-
poses," approved 1'Vbritary toning sixHi,
eighteen hundred and fifty-three, is ox-
tenilvd over and shall apply to the fees of
'ikeollicers in suiil Territory of Utah. Hut
the district attorney shall not by fees and
salary together receive more than thirty-
live hundred dollars per year; and all fees
or moneys received by him above Slid
amount shall lis.paid into the Treasury of
the United States.
