ONE The Texas Tidclands As
far back as 1030 the State Superintendent
of Public Instruction
was Informed that one source of
money for tho school children of
Texas might well be from leases
of the tldclands to oil prospectors
Dr L A Woods then Superintendent
requested tho Attorney Generals
department to make a study
of such possibilities and as a result
a brief was written showing
on what bases Texas had full right
to ownctshlp of the land ten miles
out from shore This brief was written
and presented by an Assistant
Attorney General Ralph Yarborough
This brief has been tho
bases for and used almost in toto
ever since In arguing for tho Texas
Tldclands
In 1910 the Attorney General of
Texas was In Washington directed
there by the late Buford Jes
ter then Governor of Texas to
force claims to the oil rich tldc
lands At this time a resolution
was passed by tho lower house
of tho Texas Legislature proclaiming
our legal rights to the do
lands It was passed on to tho
Texas Senate for approval there
Here It met sudden death Tho Li
cutanant Governor Allan Shivers
directed tho resolutions to a committee
where it was held so no
vote could bo taken This we read
in tho Texas Journal of 1040 This
issue Mr Shivers wished to sidetrack
until ho could use for his
own political advantage
TWO Mr Shivers and tho Texas
Realty Co Allan Shivers purchased
an option on some land in
Hidalgo county and for this option
he gave a note which under oatli
he said he did not even sign This
option expired and everyone kn
ows when an option expires it Is
not worth the paper it is written
on Not this one The week after
this option expired Mr Shivers
sold to tho Texas Realty Co a
corporation with capital stock of
1000 this option on this Hidalgo
land for 125000 A nice sum of
money for an option that had al
icady expired This seems to bean
unusual trade but tho 01 question
was answered soon after Mr
Shivers became governor as he
directed his Water Doaul to issue
v Nit turned out to be a phoney
w or permit just to cover tills
land Then the Texas Rcolty Co
went about selling flic sago brush
Kuil as land soon to be Irrigated
They knew and all know that no
water was available even it tho
bogus water right had been granted
No extra water had been available
for 20 years We recall that
tile late Gene Howe Old Tack
warned people In his own column
not buy tho Hidalgo land as it
would be worthless Many did invest
their life savings and as a
result there have been 103 foreclosures
and 20 fraud suits Their
money went into tho pockets of
Allan Shivers and tho Texas Realty
Co Again we see hero and
thrre these words FOR TEXAS
AND SHIVERS
THREE The Texas Constitution
is no barrier to Mr Shivers when
there is a chance for him to profit
at the expense of tho citizens
of Texas The Constitution reads
Article 10 Section 21 No member
or officer of any department of
the government shall bo in anyway
interested in such contracts
for printing and all contracts
shall be subject to the appioval of
the governor Tho governor did
appiove a contract to tho Mission
Times for doing considerable printing
for the State of Texas According
to a sworn statement by the
management of the paper at that
time the owners were Allan Shivers
his wife Ills motherinlaw
and a Mr Cook Tills flagrant violation
of tho Constitution was called
to tho attention of the now Attorney
General Mr John Den
Sheppard and ho explained it away
by saying that the Govornor
had transfered ills stock to his
wife Mr Sheppard Is performing
well for the Shiver Machine We
still can read here and there FOR
TEXAS AND SHIVERS
It would be too lengthy to cover
the Insurance Scandal how the
Governor aided in killing n natural
gas tax for school children of
Texas in the last special session
of the Legislature You see tho gas
people arc scllng natural gas to
tho people of Minneapolis at a
cheaper rale than what wo are
paying The members of tho Legislature
wished to add tax to till
natural resource for tho school
but not Mr Shivers Ho looms to
be very kind to tho gas and oil
interest when it comes to taxo
