Yesterday, while looking over some oil
legnl pnpeis, I happened t"> run across an
entry on a justice's d«>oker entitled, "The stat
of Kansas vs. General P. H. Sheridan efi al.
an<i further on found where the justice hud
fined the general *i<ki for assault and baiterv.
As this CHSe w/is made and tried in l.SfiS. nnd
l<fcal history of that date failing t) give raor
then a mere mention of it, I hinted up all
the facts in the case, and now send them to
you to show future generations how law was
applb'tl in that day in Kansas, but in order to
do so will have to start with Grant at Vicks
burg, for it was at th itpoint be ijrst conceived
a liking for the person who was subsequent!)
the prosecuting v\iin<ss in this case. In that
locality Above mentioned Grant heard of some
exploit of bravery performed by one M. L.
Dunn, a private sol I er, and wishing to re
werd all *ucb, made Dunn an orderly-sergeant
on his stall', and as he paid strict, attention to
his duties and w as withal a g'*>d soldier, he re-
ceived another promotion making him wagon-
master of that department. At the close of
the war Dunn was discharged, and. with the
indorsement of General Grant. was made post
sutler at, Fort Leavenworth. This last promo-
tion proved to be his ruination. It was fl ish
toimos in Kansas; there was plenty of money
among the soldiers a rid t he sutler's store was a
veritable bonanza to its prop iotor. Dunnoined
rnonev. and there was nothing too kood or too
rich for him He drove the finest team, drank
the b *st wine, and had the most fragrant
brands of cigars that money could command.
Other honors were thrust upon him, and he
was urule postmaster in addition to his other
duties As his honors increased, so <}L1 his ap-
petite for forbidden things, an I, not being
content with those enumerated afcove, added
women to the list, and he w is lost. It is said
that some ot t be orgies he and bis friends in-
dulged in, were more horrifying than amus
ing; that th^ women were made drunk and all
the revels of a bacchanalian feast were in-
dulged in. To such an extent was this car-
ried or that it was repotted to department
headquarters, and the following order was
issued:
Fort I eaix niworthy (Kan.) July 20, 1868.—
Major General, Albert Gibbs, Commanding
Fort Leavenworth, Kan. — General: The
major general commanding directs that M.
L. D inn be i "moved from the reservation, and
that he be forbidden to return until further
order* from these headquarters. Very re-
spectfully, Chauncy mckkevbh,
Assistant Adjutant General.
A copy of the order was sent to Dnnn. and
he left the reservation, but returned on the
25, and shortly after entering the postolHce a
sergeant with a tile of men waited upon him
and he was informed that it was their duty to
escort him off of the reservation. Dunn ob-
jected. but the order was imperative, and
rather than stand a siege tn concluded to go
out we«t, bur. with his going there was a regis-
tered oath that he wouid get even with bis re-
movers, and, going before a justice of the
peace, swore out a wuriant, of which the fol-
lowing i- u copy:
" M. L. L Mi mi vs. P. H. Sheridan, Alfred
Gibbs, Chauncy McKeever. Peter Leary and
Richard I\ I«ec Charges: Assault and battery
with sabres; taking postage-stamps, postai-
envelopes. United States treasury notes, and
postal currency to the value of #2000—all on
July 35, about noon."
Wh'-n the ca-e was called for trial all the
charges but the one for assault and battery
were withdrawn. The case occupied two days,
and among the witn"sie.s for the defense were
some of the brightest and best officers our
country ever knew. There was the gallant
Custer, with his long auburn locks: that little
rtarhting Irishman, Lieutenant Leary, and the
hrave Lieutenant Moylan; but the character
of the witnesses avaiied the defense nothin
ami the jury brought in a verdict of guilty
against General Sheridan and Corporal Lee,
the former hav ing ismie i the order and the
latter executed it. After the verdict had been
rendered. Justice of the Peace Tholen assessed
a tine of $1 a .-ainst all the parti s with the
exception of Sheridan, whom he fined $100
and costs.
When Rh> rfdnn left the court room it is said
cfifit he actually swore. In fact, ne damned
