vices -against James Halfpenny, and has made
oath in writing before the undersigned Jus-
tice of the Peace, that the said James Half-
penny is a transient person and his residence

distribution of the estate of Isaiah Curd, de-
dcased, setting forth that the heirs at law of
Mary Ann MayfieJd, are parties interested in
said partition and distribution, who resido be-

therefore to command you to summon tlie
said heirs at law of Mary Ann Curd, by pub-
lication in the Texas Ranger & Lone Star, a
newspaper published in the town of Wash-

A PROCLAMATION. Whereas, by an act of
fSL tlie late extra session of the Legislature, ap-
proved February 7th, 1853, certain appropriations
were made for internal improvements in this
State, subject for its adoption to a popular vote,
which act is in the woids and figures following,
to wit : ""

ment of the Rivers of the State.
Section 1. Be it enacted by the Legislature of
the Slate of Texas, That the sum of thirty three

Sec. 2. That a board of internal improvement,
consisting of three members, shall he elected for
each of the following rivers : Sahine, Trinity,
Brazos, Colorado, San Jacinto, San Bernard,
Navidad, Sulphur Fork of Red River, and Nue-
ces; and one board, consisting of three members,
shall be elected for the Neches and Angelina
rivcis ; and a board., consisting of thieamembers
shall be elected for the San Antonio, and one for
the Guadaloupe ; and a board, consisting of
three members shall he elected for Feiry Lake,
and Cypress Bayou, and Jim's Bayou ; and a
hoard, consisting of three members shall be elect-
ed for Mission liver and the bay at its mouth,
which said boards shall be elected by both houses
of. the Legislature in joint session ; and each
member of said boards, befcre entering on the
duties of his office, shall enter iuto bond, witn
sufficient security in the sum of ten thousand
dollars,t jayqhhfto.thc Governor and his succes-
sor in office for thefaithfuldischarge of the du-
ties which may be assigned them, which said bond
shall be appio'tedby the Governor and filed with
the Secretary ol State, upon which suit may be
brought, from time to time, and not to be void
upon a first recovery for a forfeiture, thereof ?
and each member shall take care and subscribe
the following oath before any person legally au-
thorised to administer the same; "I do hereby
solemnly swear, (or- affirm, as the case may be;)
tiatl will well and truly discharge, all.the duties
as a member of the board of internal improve-
ments to which I have been elected, which may
be imposed upon me by the Legislature, from
time to time;" and siid members of the board
shall rcceh 0 two dollars per tlay for each and
every u-y tney may be necessarily engaged in the
discharge of their duties
Sec. . Tnii; the several boards shall lay off
the woik to be done infections of convenient size,
let cut the woik to the lowest bidder, who shall
enter into a bondin double the amount of his bid,
for the faithTul performance cf his work, with
securititj u be approved by tho board ; they
shall superintend the work, and see that it is done
in conformity viith the contracts, hut neither of
them shall either directly or indirectly be inter-
ested in any bid or contract.
Si-c 4. That the said respective boards shall
elect one of their numbers as President of the
same, who shall preside at all the meetings of
the boaid, should he be present: and he shall
hme the power to convene the board, with the
concurrence of one other member, whenever he
maj deem it necessary to do so, and two members
of said boarJ shall constitute a quorum for tho
transaction of business ; and the said board shall
keep a lecord of their proceedings touching all
their transactions in the discharge of their duties
a copy of which shall be by them transmitted
once in every three months, to the Governor, for
his inspection, and which shall by him be filed
in the office of the Secretary of State, for the in-
spection of all who may dcoire to see it; and the
said board shall, from time to time, draw drafts
on the treasury in favor of the contractor, for
such sums as they may think necessary aud pro-
per, to enable such contractor to progi ea with
his work. Provided, That in no ease shall they
draw for more than two thirds ot thework ac-
tually done and performed until the wiiole of the
contract shall have been completed.
Snc 5 That all the proceedings of the respec-
tive bo.rds touching their dut'es, shall be by
them laid before tho nest session of the legisla-
ture after they aie had ; also, all the proceedings
of the Governor touching his duties and trans-
actions with the said boards, shall be by him
laid before the nest session of the Legislature,
after they are had, and in the case of a vacancy
in the board during the recess of the Legislature
it shall be filled by the two remaining members
of the board, should there be two remaining
members, which appointment shall bo in force
until the meeting ot the next Legislature ; and
in the event that there shall be at any time only
one member of the board, or ne member of the
boaid, it shall behe duty of tffe Governor to fill
tlie vacancy or vacancies, which appointments
shall, m like manner, continue in office until
the next session of the Legislature.
Sec. 6. Tint each member of the board may
make out his account every three months, for his
scrices, which shall be sisnerf by each member of
the board, and submitted to the Governor for his
approval, and if by him approved, the Treasurer
shall pay the same , but should the Governolr dis-
approve the same, he shall return it to the same
board with his reasons for his disapproval.
Sec 7. That the Governor shall cause this act
to besubmitted tothc qualified electors at thenext
general election to beheld in August next; and
then if thei 0 are more votes cast in favor of than
against the adoption of this act, then itshalltake
effect and be iu force, and not etherwise.

Now, therefore, 1, P. Hansborough BellGov-
ernor of the State of Texasagdo hereby in pur-
suance of tbe 1 equirement3 of said acS order
and direct that the Chief Justices of the several
counties, (and in case of a vacancy in the office
of Chief Justice, or the inability of that officer
to act, 'then any two of the County Commission-
eis,) cause polls o be opened at the several pre-
cincts, in their respective counti , on the first
Monday, (being the first day "oT August next,
and the votes of all those voting fjr Rcpresenta-
thes in the State Legislature to be taken for and
against the adoption of the said act. The Chief
Justices of the several counties, (and in case of
vacancy in the office of Chief Justice or inability
of that officer to ?ct. then an two of the County
G ommissioners,) will return to the Secretary of
State complete lists, showing the number of votes
cast for and against the adoption of the said act.

A PROCLAMATION.- Whereas, by adjoint
Resolution of the late extra session of.the
State Legislature, approved February 7th, 1853,
a cortain amenement to the constitution of the
State is proposed, which Joint Resolution is-in.
the words and figures following, to wit r
" Joint Resolution proposing an amendment to
the Constitution."
" Be it resolved by the Legislature of the State -of
Texas, That the following be proposed as an
amendment to the amendment to the Constitution
of the State of Texas, to be added to such amend-
ment as section 3, which when ratified as provided
for by the thirty-seventh seclioncf the seventhr
article of said Constitution, shall be valid to all
intents and purposes as a part of said Constitu-
tion: "See. 8. That in case a vacancy shall fronrany
cause occur in any of the offices mentioned in the
first section of the amendment of the Constitution
the Governor shall appoint some suitable person
to fill such vacancy, who shall continue to disr
charge the duties of such office untilhe tlmeof
the next general election- established by law 'for
the election of State aial County officers,, and
until his successor shall have been elected and . -qualified."
