Terrcnce JJ. Martin, alleging that said defendant
is indebted to him upon two promissory notes
both executed on the 18th day of February, 1850
one for the sum of four hundred and fifty dollars',
due six months after date (on which said note is
a credit for forty dollars paid the 1st of January,
1851, and eighty dollars paid the 1st of Novem-
ber, 1851) and another for the sum of one hun
dredand fifty dollars, due twelve months after
-date ; that neither of said notes have ever Teen
paid, nor any part thereof except as above stated.

and for cost. And oath having been made by

in the District Court of said county his petition,

owner of one fourth of a league of land lying on
the Brazos river, opposite the mouth of thcNavi-
soto, the upper part of ahalflcagc granted by
the Government to Andrew Robinson, sen., made
a certain contract with Miller and Somerville,
Asa Hoxey and 1 homas Gay, to sell to them an
undivided interest of three-fourths of cix hun-
dred and forty acres, part of said quarter of a
league, for the purpose of laying off a town, and
that afterwards in Jan. 183G, suid Hall executed
title in conformity with said obligation, to said six
hundred and forty acres, described as follows .

agreed in writing to lay off a town, to ho called
"Washington ; that said town was surveyed and
divided into streets, -blocks, lots, &c; that vari-
ous sales of lots were made, and John W. Hall
was authorized as agent to make title upon pay-
ment of the purchase money ; that a portion of
said town tract was not divided into lots ; that
many persons have purchased lots and received
their titles thereto ; that it is believed some have
purchased and made payments who have never
received their titles.

therein, or that the same be sold and that the
proceeds thereof be divi led among those having
right therein in proportion to their respective
shares.
And it being alleged in said petition that the
heirs of Peter M. Grayson are unknown and
their residence unknown, and that John W. Hall
jr , is absent from this State and his residence
unknown, and oath having been made to the
truth of the alligations of said petition.
These are therefore to command you that you
summon John W Hall, jr., and the unknown
heirs of Peter W. Grayson, dec. and all other un-
known persons interested therein by making pub-
lication of tliis writ in the Ranger & Star, a
newspaper published in the town of Washington,
for eight successive weeks before the next term
of the District Court of Washington count; , that
they be and appear before the said District Court
to be held at the courthouse thereof in Brenham,
on the first Monday in October next, A.D.1853, to
answer the petition of said Wilson Y. McFarland,
filed in said court, and of which a statement is
given above.

To the Sheriff of McLennan county, Greeting:
WHEREAS nichard Brown and George
Brown have filed their petition in the dis-
trict court of McLennan county and said State of
lexas. against Hiram Baker and Carolina is. Ba-
ker, his wife, alleging in said petition that on
the 13th day of December, A. B. 1851, the said
Hiram Baker was indebted to them in the sum of
one hundred end twenty-five dollars jn a promis
sory note, made payable six months after date;
and further alleging that Hiram Baier and Car-
oline E. Baker, his wife, signed, scaled and deliv-
ered to them a mortgage in consideration of the
promise in said promissory note, to pay said turn
of money, and did bargain, sell and convey unto
them a piece and parcel of land, conveyed to Hi-
ram Baker as assignee of one Hamey Rodes, by
patent in 1848, which land as described is situa-
ted in Milam Land District, on the tributaries of
the South prong of the Bosque, nine miles from
the Waco village; and further alleging in the
petition that said promissory note has not been
paid, and that said sum of money is still due
them, wherefore they pray a foreclosure of said
mortgage, and the oath having been made, he
prays that the defendants be duly and legally
cited ; wherefore you are hereby commanded to
cite the said Hiram Baker and his wife, Caroline
E Baker, by making publication as the law di-
rects, to be and appear at the next term of the
District Court of McLennan county, and State of
Texas, to be holden in the town of Waco, on
the sixth Monday after the first Monday in Oc-
tober A. D. 1853, then and thcie to answer the
petition, a brief of which is above given.

Joint Resolution proposing an amendment to
the Constitution."
" Bi it rcsolo-d ly the Legislature of the Stite
of Texas, That the following be pioposed as .in
amendment to the amendment to the Constitution
ofthe f ... of Texas, to be added to such amend-
ment ux section 3, which when ratified a- "- "dod
for by the thirty-seventh section of t ..th
article of said Constitution, shall be valid to all
intents and purposes as a part of said Constitu-
tion: Sec. 3. That in case a vacancy shall from any
cause occur in any of the office mentioned in the
first section of the amendment of the Constitution
the Governor shall appoint some suitable person
to fill such vacancy, who shall continue to dis-
charge the duties of such office until the time of
the next general election established by law for
the election of tate and County officers, and
until bib successor shall hae been elected and
qualified."
Now, therefore I, P. Hansbrough Bell, Go-
vernor of the State of Texas, do hereby, in pur-
suance of the Law and the Constitution, order
and direct that the above recited joint resolution
be published in the public prints ot this State, for
the consideration oT the people, at least three
months pi e ions to the next general election to
be held throughout the State, on Monday, the
first day ot August ensuing.
And I do further older and direct the Chief
Justices of the several counties (and in case of
vacancy in the oflicc of Chief Justice, or inability
of that officer to act, then aiiy two of the County
Commissioners,) to cause polls to be opened at
the several precincts in their respective" counties
of the said first day of August next, and the
otes of all those oting for representatives in the
State Legislature to be taken for and against the
adoption of the said proposed amendment. The
Chief Jusiices of the several counties, (ami in case
of a vacancy in the office of Chief Justice or ina-
bility of that officer to act, then any two of the
County Commissioners) will return to the Secre-
tory of State complete lists of the names of all
those voting for representatives in the Legislature
which lists must show who voted for and who
voted against the said proposed amendment, as
well as the names of those who did not vote at
all upon the question, as a majority of the whole
number of votes cast for Representatives through-
out the State seems to be contemplated as neces-
Isary to an amendment of the Constitution.
