Wednesday—State vs. Perry
Hunt—murder. This case went
to the jury at 1 o'clock. The
jury is composed of eight white
men and four negroes ; the Ut-
ter have hung, and an agree-
ment is exceedingly doubtful.
State vs. Lewis Babb, (col.)
murder—defendant plead guil-
ty to manslaughter, and the
jury gave him two years in the
penitentiary.
This ends a case that has
been pending in court for the
past five years. Lewis murder-
ed another negro near Long
Point about five years ago. He
was tried, convicted of mur-
der, and sentenced to fifty
years in the penitentiary; he ap-
pealed, and on a technicality
his case was reversed; upon the
second trial he was again given
fifty years; again appealed, and
again had his case re-
versed upon a technicality,
and the facts in the case
were never disputed, and
had Babb got justice he
would have been hung
and forgotten long ago. He
now gets off with a term of
two years in the penitentiary
for a fust-class murder. So
much for the law's delay and
technicalities. Legal tecenical-
ities have saved many a neck
that should have been broken.
Swartz still ahead.
The Jollities.
Owing to the sickness of the
advance agent there has been
no advertisement nor any bills
posted announcing the coming
of Lillian Brown's famous Jolli-
ties company, which will appear
at the opera house to night.
They have already played Gal-
veston, San Antonio and Austin
and in each place have been
highly complimented by the
press. The play, "The Elec-
trical Doll," is a sort of a com-
edy, opera, drama, and is a com-
ical combination of singing,
dancing and comedy. The Aus-
tin Statesman of yesterday says:
"The man or woman who de-
sires a performance to make
him laugh, made up cf dioller-
ies wrought to the highest state
of absurdity by the talent of a
good actor, will hear the Jolli-
ties and pronounce it the best
Mr. James H. Holt was in thing he ever heard, for that was
the city yesterday, and informs I just what wasseen last night. It is
of the negro at Wehren s store I jn ^js con)pany now play-
by himself, the other day, was j„g w;n bring it out, but other-
purely accidental; that his shot- wise than that (unless a man be
critical enough to admire talent
even in this art of making an
absurdity, still more so) he will
find little to amuse in "The Jol-
lities." In a word, if you like
to see talent employed in gro
tesque situations and inimical
awkwardness as the talented
clown presents it in the circus,
this company will be your ideal
and you'will laugh—and all you
will want of it. To this end is
the plot, the dancing, the acting,
the singing, the dress, every-
thing in it. Such is the Jolli-
ties and the sprightly company
now presenting it.
