submitted to the people in the specin
elections called for May 24. There
can be no others submitted on that
dato by the present Legislature, be
cause of tholimitcd time for complying
with the laws requirements in the
matter of advertising.
Governor Hobby has said that he
will call the Legislature in special
session about June 17 to vitalize the
amendments, which may 'bo adopted
on May 24. The amendments arc em-

The bill was passed this morning in
tho House under suspension Of rules
It npplies to every county In tho State
but is directed at Bexar, Harris, Dal
las and Tarrant Counties, where it is
claimed large profits arc made by
Sheriffs on fees allowed for prisoners
board. The. bill will not become ef
fective until December 1, 1920, giving
protection to tho present Incumbents
Bo it enacted by the Legislature of
tho State of Texas:
Section 1. Tho Artldo 1142 of the
Code of Criminal Procedure, 1911
shall bo so amended ns to hereafter
read as follows:
Article 1142. All expenses for sup
plies, labor of materials necessary for
tho bare, feeding and maintenance of
prisoners confined in jail or under
guard, shall bo incurred and paid for
by the county in tho manner now pro
vlded by law for tho purchaso of sup
plies by counties upon requisition
therefor by the Sheriff, Including ne-
cessary medical bills or reasonable
funeral expenses in case of death, pro
vided thnt this act shall not be con-
structed so ns to repeal any part of
title 29, chapter 2, roviscd civil statu
tcs, 1911, and shall bo cumulative
thereof.
Section 2. That article 1144 of the
Codo of Crimial procedure, 1911, shall
be so amended as to hereafter read as
follows:
Artlclo 1144. It is the duty of the
Sheriff to pay tho expenses of jurors
impanelled in case of felony, oxcopt
where they nre paid by the juror him-
self, for which he shall be reimbursed
by the propjer county according to
the rates fixed by law. It shall bo
the duty of the Sheriff to guard, feed
and care for nil prisoners legnlly
committed to his care, the expense for
which shall bo paid In the manner
provided by nrticlcs 1142 and 1143 o
this code.
Section 3. Thnt article 1148 of tho
Code of Crimial Procedure, 1911
shall bo so' amended ns to hereafter
read as follows:
Article 1148. At each rcgulai
term of tho Commissioners' Court
the Sheriff shall file his report under
oath, setting forth the "namo of each
prisoner confined In jail or under
gunrd and show upon what charge
held and tho day and hour received
or released, together with a list of
the expense incurred and the supplies
on hand, and he may include any other
facts or recommendations desired.
Said report shall be carefully checked
by the County Auditor, If there bo
one for said county, who shall report
his findings to the Commissioners'
Court.
Section 4. That article 1149 of th
Codo of Criminal Procedure, 1911,
shall bo so amended as to hereafter
read as follows:
Article 1149. Tho report of the
Sheriff shall be filed in the office of
the clerk of the County Court, nnd
shall bo open to tho Inspection of any
person dcsidlng to see tho same. It
shall be tho duty of the Commiss
ioners' Court to cxamino the same to
gethor with the report of the auditor
and to supervise from time to tlmo
the feeding of prisoners, and to cntoi
such orders ns may be necessary to
enforco their adequnte and mnlntance
Section 5 Tho fact that there is
now no law authorizing counties to
feed nnd core for prisoners by con
tracting for and furnishing supplies
for said purpose, creates nn impera-
tive public necessity nnd nn emer-
gency requiring that constitutional
rulo requiring bills to bo rend on
three several days be and is hereby
suspended, nnd thnt this net shall
take effect from and after its pusaago
and that it is so enacted.
