THE STATE OF TEXAS,
To the Sheriff or any Constable
of Washington County—Greeting:
You are hereby commanded, that
you summon, by making Publica-
tion of this Citation in some news-
paper published in the County of
Washington if there be a newspaper
published therein, but if not, then in
any newspaper published in the 21st
judicial district; but if there be no
newspaper published in said judi-
cial district, then in a newspaper
published in the nearest district to
said 21st judicial district, for four
week previous to the return day
hereof, J. A. Russell whose residence
is unknown, to be and appear before
the Hon. District Court, at the next
regular term thereof, to be holden
in the County of Washington at the
Court House thereof, in Brenham
on the First Monday In March 1913,
being the 3rd day of March, 1913
then and thero to answer a Petition
filed in said Court, on the 4th day of
February, A. D., 1913, in a suit
numbered on docket of said Court,
No. 14541, wherein The Washington
County State Bank is plaintiff and
J. A. Russell, J. H. Thornton and
J. Z. Norton are defendants. The
nature of the plaintiff's demand be-
ing as follows, to-wit:
That on January 15th, 1907, the
said J. A. Russell executed and de-
livered to M. L. G. Stone four prom-
issory notes in writing, each for the
sum of $277.41, due in one, two,
ihree and four year* after the
thereof, payable in Brenham, Texas,
bearing interest at 8 per cent per
annum from date and providing for
10 per cent attorney's fees. That
afterwards for a valuable considera-
tion the said M. L. G. Stone convey-
ed said notes to the Washington
County State Bank, the plaintiff who
is now the legal owner of said notes.
That the other defendants, J. II.
Thornton and J. Z. Norton, for a
valuable consideration assumed the
payment of said notes. That by
reason of the premises the defend-
ants and each of them became lia-
ble and promised to pay said notes,
but they have wholly failed and still
fail and refuse to pay said notes or
any part thereof. That said notes
were given in part payment for
154.12 acres of land out of the W.
D. C. Hall Survey in Palo Pinto
County, Texas, being Subdivision of
No. 7, of said Survey, sold by M. L.
G. Stone to tho defendant, J. A. Rus-
sell.
That afterwards the said J. A.
Russell sold said tract ot land to the
defendant J. H. Thornton who as-
sumed the payment of said notes.
That afterwards the said J. H.
Thornton sold said land to the de-
fendant J. Z. Norton who assumed
the payment of said notes. That by
reason of assumption of said notes
by defendants, they became liable
and promised plaintiff to pay off said
notes. That plaintiff has placed
said notes In the hands of an attor-
ney for collection. Wherefore plain-
tiff sues and prays for judgment for
the amount of satd notes, interest
and attorney's fees, with a foreclos-
ure of the vendor's lien upon said
land, for cost of suit and such oth-
er relief as it may be entitled to.
Herein ff.il not, and have you be-
fore said Court, on the said first day
of the next term thereof, this Writ,
with your endorsement thereon,
showing how you have executed the
same.

said Court, at office in Brenham this,
the 4th day of February A. D., 1913.

There is but a small change in the
markets from last wei\, very little
cotton has been sold, prices are
somewhat better than last week.
Eggs are getting mo,re plentiful
as tho warm weather is bringing
out the chickens. Prices are firm
and all that are offered find a rea-
dy market at 17c per dozen.
Very few chickens have been on
the market this week aud as there
is a scarcity at present prices are
very firm.
The rain ha8 retarded the plant-
ing of potatoes to some oxtent and
the outlook for an early crop ire at
present not flattering.
Cotton seed is still at the same
price with very little moving, nei-
ther is there any change In the
price of hulls.
Butter fat prices are unchanged
the creamery here taking all first
class cream that is offered.

has been every incentive for farm-
ers to grow more cotton and they
will consequently add to the area
when planting season begins if they
can get time in which to make their
preparations. I certainly would
like to see the sun shine once more."
Hubbard Bros. & Co., of New
York wire; Liverpool continued to
show strength this morning and our
market opened higher, advancing
tq 12.50 for May, when sufficient
realizing appeared to check the im-
provement. The natural tendency
to take profits was of course Increas-
ed by the fact that tomorrow Lin-
coln's birthday is a holiday here.
The market, however, has a good
undertone with some demand from
the spot people and considerable
covering in evidence. The Bombay
movement continues a distinct disap
pointment and this falling off in the
Indian receipts is of importance in
getting an additional strain on a
crop which is already regarded as
moderate in view of the excellent
trade.
