Bentsen for the Senate

IITHETHER YOU VOTE for the Dukakis-Bent-
W sen ticket or not, you should be sure to vote
to return Lloyd Bentsen to the U.S. Senate.
Don’t be taken in by the smokescreen issue of
Sen. Bentsen “running for two offices at once,"
since his name will be on the general election
ballot both as the Democratic vice-presidential
candidate and as a candidate for re-election to the
Senate.
It isn’t only “legally allowable" for Sen.
Bentsen to be listed on the ballot twice. It’s
required by Texas law.
Sen. Bentsen won his party’s nomination for
re-election in the Democratic Primary Election last
March. Four months later, Gov. Michael Dukakis
picked him as the Democratic vice-presidential
nominee.
Under a law passed by the Texas Legislature in
1983, a party’s nominee for the US Senate cannot
resign from his nomination, and cannot be
removed from the general election ballot except by
death or disability. Even if he could resign the
nomination to devote his full attention to the
vice-presidential campaign, the Democratic Party
could not replace him on the ballot.
The 1983 law supercedes the “Lyndon Law” of
1959. You may think it’s a funny law, but take
another look:
Our US Senator, who by coincidence is up for
re-election for a six-year term during a presidential
election year, wins his party's nomination for the
Senate and later is tapped as the vice-presidential
nominee. If he were to resign his Senate seat to run
for vice-president, and if his ticket were to lose,
Texas would lose his seniority in the Senate, and
the seat would go by default to one of his
opponents (in this case Republican Beau Boulter or
Libertarian Jeff Daicll). The new senator would
start at the bottom of the Senate ladder. Texas
would have been "riffed out” by the presidential/
vice-presidential selection process.
If he were not elected vice-president but were
re-elected as a senator, then the state would not
lose his seniority in the Senate.
It he were to be elected to both the vice-presi-
dency and the Senate, he would be legally required
to resign his Senate seat in January, then the
governor would appoint someone to fill his scat in
the Senate temporarily, and call a special election
to pick a new senator for the six-year term. That
way, the next US Senator would be elected by an
honest vote of all voters of all parties.
So this unique Texas law isn’t so funny alter all.
It’s an insurance policy for the state and its voters.
Whether or not you vote for Sen. Bentsen tor
vice-president, you should vote for him for US
Senator. He’s so much better qualified for the
office than the Republican or Libertarian candi-
dates that it shouldn’t even be a contest. Jet,
confusion over the state's two-office law could
endanger his re-election.
Lloyd Bentsen is too valuable to Texas, and to
the nation, to be lost as a US Senator if he isn t
elected vice-president.
