One of the most interesting and novel
legal points that has ever been brought
to the attention of an El Paso oonrt
will oome np before Judge Walthall on
the 22nd instant.
The lawyers are discussing the mat-
ter among themselves, and the attor-
neys for the complaining witnesses have
already began to prepare for the legal
battle.
The oase is that of Francisco Villalo-
bos, justice of the peace of the San Eli-
aario preolnot. «, ___i
The public is familiar with the facts
involved.
An effort is being made to unseat
the justioe on aooount of alleged in
competency and the alleged arbitrary
manner in which he oonduots his offioe.
At the last session of the county ooin
mlssioners court Villalobos resignation
was acoepted as justice of the peace at
San Elizario and at the same session
the commissioners appointed him to fill
the vacancy occasioned by his own re-
signation. A petition from the citizens
of San Elizario having been presented
for that purpose.
This is the first step taken by Villalo-
bos towards fighting the effort made to
unseat him. He is very indignant, and
denies the charges made against him.
Now the question comes np whether
the defendant can be called to aooount
for aots which occurred during his pre-
vious incumbency of offioe.
Villalobos is at present holding the
offioe by virtue of his appointment by
the county commissioners and there
fore any questions regarding his prior
election are barred from consideration.
The attorneys interested state that as
yet they have found no authorities
bearing on the point at issne, and the
arguments in the case will therefore be
based on general principles of law.
NOT IN SESSION.
Judge Walthall’s oonrt was not in
session yesterday. Two theft oases
which it was intended to take up were
postponed on application of the defend
ants, as their attorney,.Mr. Richardson,
was engaged in looking aftersome legal
matters on the other side of the river.
The regular jury panel was excused
until Monday- So there will be no jury
cases today, but the judge will probably
hear some motions.
GRAND JT7RV.
The grand jury will be in session to
day. There are several prisoners now
in the ucounty jail whose cases are
awaiting their investigation.
REHEARING DENIED.
Notice was received yesterday by
Beall & Kemp from the court of civil
appeals to the effect *hat the motion for
a rehearing of the El Paso Gas, Electric
Light aod Power company against the
city of El Paso had been overruled.
The suit was brought for the enforce-
ment of a five years’ contract. The
mayor signed the contract with the
company, but subsequently bereoonsid
ered his decision, which resulted in bis
vetting the measure authorizing said
contract.
Mayor Magoffin’s action was sustain
ed by the city council.
The case was originally tried before
Judge Walthall and was decided in
favor of the city. On being taken up to
the oonrt of appeals the decision of the
lower oonrt was sustained.
Now that a motion for a rehearing
has been overruled, it is said the oase
will be taken to the supreme court on a
writ of error.
NOT RELEASED.
Bias Aguirre, who was accused of
stealing a horse and the trial of whose
oase occupied two days of the district
court, was not released upon being
found not guilty by the jury. But ow
ing to the fact that there is another In-
dfetment against him be will have to
stand trial again.
NO NEW SUITS PILED.
For several days no new snits have
been instituted in the district oonrt, but
it is said that two or three important
ones will be filed in the next few days.
So far only two civil suits have been
filed in the federal court for the April
term. However, the attorneys generally
wait until just before court convenes to
file their cases, There are some railroad
enite now pending in the district oonrt
Whioh the attorneys in the same pro-
pose to try and have transferred to the
United States. This is chiefly owing to
the crowded condition of the docket of
the state courts which will necessitate
some delay before the more recent oases
are reached for trial.

bonds at said hank: and
Wrekbas, each of said bonds state that It Is
secured by u-first mortgage or deed of trust
to William H. Thompson aud Henry L. New-
man, trustees on "all the railways now built
and to be built with these bonds, tracks,
switches. Iron, and right-of-way In El Paso.
Texas,and all the cars,tools and buildings,and
all other property and franchises In the city
of EI Paso, El Paso County, Tex ns, belonging
to the said El PasaStreet Railroad Compauy;"

Whereas, said Street Railroad Company
executed and delivered a deed of trust ifated
the 28th day of may, 1886, wherein It conveyed
to said William H. Thompson and1 Henry L.
Newman, as trustees, for the purpose of se-
curing the payment of said bonds and inter-
est, the following described property:
“All and singular the said Street Railroad
already constructed aud all additional lines
of railroads to be constructed with the
money arising from the sale of said bonds,
together with the Real Estate, Rights of-way,
Ralls and Cars, Tools. Buildings and other
property and franchises now owned by said
compauy in the oity of El Paso, or to be ac-
quired, for the equipment and operation of
said additional lines of railroad to be con-
structed as aforesaid, together with all and
singular the tenements, heredltaments.appur-
tenanoes thereunto belonging or in any wise
appertaining.'1 whioh deed of trust contains a
copy of one of said bonds and is duly recorded
in the records of deeds of trust of El Paso
County, Texas, in Book No, 5, pages 4 to t> in-
clusive; and
Whereas, there is still due and unpaid the
principal of all of said bonds aggregating $25,-
tFO with interest on said sum at eight p.r cent
per annum from October 1st, 1S99; aud
WiiEiiEAS, it is provided in said deed of trust
that upondefault in the payment of any of
said bonds, it shall ho the duty of said
Trustees or either of them, upon the request
of the holder or holders of a majority of said
bonds, to enforce said trust and after ad ,-er-
tlsing same In the manner required in said
trust deed, to sell said property at public
auction, for tho purpose of applying the pro-
ceeds to the payment of said bonds and in-
terest and expenses of executing said trust;
and
Whereas, the title, powers, rights and du-
ties Imposed upon said trustees are several as
well as Joint, aud said William 11. Thompson
has refused to act as trustee In foreclosii g
said lien, and no substitute trustee in his
place aud stead has been appointed and said
trust deed makes it my duty to act alone in
such event; and
Whereas, the majority of the holders of
said bonds have requested mo to sell said
pioperty under the terms of said deed of
trust for tho purpose of paying otf said bonds
and Interest.
Now, therefore, notice is hereby given
that on the llrst Tuesday in February, A. l>.
i960, (the same being the 6t,U day of said
month) I, said Henry L. Newman, will sell at
the north door of the court house of El Paso
County, Texas, In the oity of El Paso, state
of Texas, between the hours of ten a. m. and
four p. in., at public vendue to the highest
bidder for cash.the property above described,
which description Includes, (together with all
other property now owned by said Railroad
.Company), the following property, toiwit:
A line or street railway beginning at the
intersection of Stanton street and St.
Louis street; thence westerly along St. Louis
street and across what is known as "Little

stables in any way incident to suid line or its

ed by the city . f El Paso jo tho al Pa»o Street
Ruilroad company, now existing which are of
record in the minutes of the City Council of
the city of El Paso, to which reference is here
made for further description thereof.
The following described real estate, situ-
ated in theoity of El Paso, county of El Paso,
state of Texas:

granted by an ordinance of the city of El
Paso to said e mpany on the 13th day of
April. 1804, which said ordinance Is of record
in Vol. II of the minutes of the City Council of
Fl Paso, on page 209,et sett, to which reference
is here made The franchises and rights-of
way granted by an ordinance of date the 3rd
day of June. 1889, which is of record in said
minutes iri Vol.K.page 561,et seq.and to which
reference is here made.
The rights-of-way, franchises, Ac., given by
an ordinance of date the 5th day of March,
1886, of record In Vol. D, page 113 of said min-
utes, to which r‘ ference is here made.
The rights-of-way, franchise, Ac.,given by
resolutions In said minutes of date of the 14th
of January, 1881, and tho 10th day of July.
1882, and of rt cord In said minutes in Vol. li,
page 59, et seq.. and Vol O, page 83 et seq, to
which reference is here made.
Certified cop esof said deed of trust and of
each of the above recited ordinances can be
seen at tbeoffice of Henry L. Newman A Son,
hankers, in tho Bronson block, city of El
Paso, Texas.
Also all the rights and franchises granted
to said El Paso Street Railroad Compauy Lty
an act of the congress of the United States,
ontitled'An act to authorize tho construction
of a street railway and wagon read bridge
over tho Rio Orende between tho city of El
Paso and Paso Del Norte, Mexico," approved
