the arrest.

Pueblo Posse Engages In
Hot Battle at Border
of City.

Pueblo, Colo., March 2C—An tin-
known member of the Black Hand
was shot through the heart and In-
stantly killed shortly before 4 o’clock
this afternoon in a fight with a sher-
iffs posse In charge of Uadersheriff
Warren Hill. A companion escaped
on horseback but Is believed to
have been shot through the arm.
The affair was the culmination of
threats made by letter to Tony San-
tuso of this city. He was ordered to
place I2.000 in a can at a point sev-
eral miles beyond the county poor
farm. This afternoon he complied
with the repeated demands and when
the two men were taking the money
from the can the sheriffs jtosse
which was concealed nearby, ordered
them to throw up their honds. They
refused and opened fire on the posse
and after many shots had been fir-
ed. the volley was returned by the
posse. At the first volley one of the
Plack Hand men fell dead from his
horse.

iforts reached Denver today of import-
ant changes in the control of tho
Denver & Rio Grande and the West-
ern Pacific railroads. The Times this
evening says: Edwin Hawley is said
to have secured important’holding in
the Denver & Rio Grande ami is now
declared to be in a position to dic-
tate tho traffic policy of that road
and the Western Pacific.
The Western Pacific lias $70,000,-.
(.00 stock outstanding. The Denver
& itio Grande acquired $.70,000,000,
or two-thirds of the entire issue. The
Denver & Rio Grande then deposited
ail of this stock with the Bankers
Trust company of New York as col-
lateral securities for its recently au-
thorised $1.70.000.000 bond Issue. The
deal ties up the Western Pacific
stock so that no person or company
can secure a majority of it without
acquiring control of the Denver & Rio

McCall. Mr. Hotchkiss said he would

When seen this afternoon Justice
McCall said that he did not care to
discuss the Insurance Inquiry except
to say that he never had any rela-
tions or transactions with Mr. Shel-
don, with his company or with any
fire insurance company except the
Munich. He said that he was for
ho rue three years the retained counsel
for the Munich company.
Letters Read.
It was later in the day when the
letters relative to the court of appeals
were read. There were two of them.
The first, dated April 29. 1903. was
from Sheldon to Buckley. It read
in part:
“1 note that the court of appeals
has derided that the franchise tax
law Is constitutional. I wish I could
have got onto this early enough for
1 am satisfied that this Is one of the
things that has been hanging over the
market and if I could have learned1
previously what the decision was llke-
I- to he. there would have been mon-
ey in this for all of us. Whenever
anything like this is pending in Al-
bany it will always pay you to advise
me, if you can, of tho probable out-
come."
Buckley's Reply.
Buckley replied the next. <lay as
follows:
“1 am sorry that I did not know
that it would be „f any interest to
you to have information about the
franchise decision I told some of onr
friends two weeks ago that it would
be but I was advised from very Im-
portant quarters that as long as the
decision would be that the law was
constitutional it would not have much
effect on the market and 1 did not
think It advisable to nay much about
it. If It had been tlu. other way you
would have lieen advised, because I
knew of your intereHs in ’Big Gas’

Daytona. Fla., March 24.—A drench-
ing tain marred the final day's pro-
gram of the Daytona Bench Automo-
bile speed carnival and the 12,000 j£
spectators who had conic out with the '
expectation of witnessing a repition
of yesterday's world breaking records
went away soaked and disappointed.
No records were broken and the fea-
ture of the program—the three hund-
red mile race for a $5,000 trophy-
had to he cancelled because of the
delay of more than an hour caused
by the storm.
In the one mile speed record trials
some of the running was witnessed
but none of the well known racefs
were able to approach the record es-
tablished last week by Barney Old-
field, although Oldfield himself cover-
ed the distance today in 27.88.
Summary:
First event, 10 miles stock chassis,
101 to 230 Inches, won by Pete Hari
in n Hitick: Altman in a Hudson was
second. Time, 12:58.
Second event, 10 miles, handicap:
Kercher, driving a Darracq, won;
Oldfield. Knox, second; Bond, Steams
third. Time, 7:21.
Third event, mile, time trials: Old-
field, in his Bonr., made the distance
in 27.88; Ben Kercher driving a Dar-
racq, 37.24: Walter Christie, driving
the Christie. 33.13.
10 mile handicap, the second handi-
cap at the same distance today, was
won by Altman (Hudson). Time,
12:45; Oldfield (Knox) second; Ker-
seber (Darracq) third.
