tain conditions; providing for an
election on the question of the
adoption of such amendment and
providing for the proclamation and
publication thereof; describing the
form of ballot and making an ap-
propriation therefor.
BE IT RESOLVED BY THE
LEGISLATURE OF THE STATE
OF TEXAS:
Section 1. That Section 1, of
Article XVII, of the Constitution
of the State of Texas, be amend-
ed so as to hereafter read as fol-
lows :
“Section 1. How the Constitu-
tion is to be Amended. The Legis-
lature, at any biennial session,
by a vote of two-thirds of all the
members elected to each House,
to be entered by yeas and nays
on the Journals, may propose
Amendments to the Constitution,
to be voted upon by the qualified
electors for members of the Leg-
islature, which proposed Amend-
ments shall be duly published once
a week for four (4) weeks, com-
mencing at least three (3) months
before an election, the time of
which shall be specified by the
Legislature, In one weekly news-
paper of each county, In which
such a newspaper may be pub-
lished; and it shall be the duty

that a majority of the votes oast,
have been cast in favor of any
Amendment, the said Amendment
so receiving a majority of the
votes cast, shall become a part
of this Constitution, and proclama-
tion shall be made by the Govern-
or thereof; provided, however, that
in cases of extraordinary emer-
gency affecting the State as n
whole, Amendments to the Consti-
tution may be proposed In the man-
ner hereinabove set out upon the
submission of the pro|to#ed Amend-
ment by the Governor at any Spe-
cial Session."
Sec 2. The foregoing Amend-
ment shall be submitted to the
electors of this State who are
qualified to vote on proposed Con-
stitutional Amendments at an elec-
tion to be held on the 24th day
of August A. I>. 1935, at which
election each ballot shall have
printed ther<*on for those favor-
ing the Amendment the words:
“FOR the Amendment to Section
1, Article XVII, of the Constitu-
tion of Texas, providing that
Amendments to the Constitution
may lie proposed at Nis-cial Ses-
sions of the Legislature under cer-
tain conditions." And those
against the Amendment shall have
printed the words;
"AGAINST the Amendment to
Section 1, Article XVII, of the
Constitution of Texus, providing
that Amendments to the Consti-
tution may I** proposed at Special
Sessions of the legislature under
certain conditions.” Each voter
shall strike out with pen or pencil
the clause which does not indicate
his desire regarding the above
proposed Amendment.
S«h\ 3. The Governor Is hereby
directed to Issue the ne<-essary
proclamation for said election, and
to have the above proposed Amend-
ment published In the manner and
for the time required by the Con-
stitution and laws of this state.
Sec 4. The sum of Five Thous-
and Dollars <*5.000.90), or ns much
thereof as may Is* mss-ssary Is
hereby appropriated out of any
funds' in the State Treasury not
otherwise appropriated, to i>ay
for the expenses of said publica-
tion and election.

HOUSE JOINT RESOLUTION
proposing an Amendment to Sec-
tion 15, of Article 1, of the Con-
stitution of Texas, and providing
that the Legislature may authorise
the temporary commitment of
mentally ill persons, not charged
with a criminal offense, for treat-
ment and-or observation without
the necessity of n trial by jury.
HE IT RESOLVED BY THE
LEGISLATURE OF THE 8TATE
OF TEXAS:
Section 1. That Section 15, of
Article 1, of the Constitution of
the Htate of Texas be so amend-
ed as to hereafter read as fol-
lows :
“Sec. 15. The right of trial by
jury shall remain Inviolate. The
I/egislatnre shall pass such laws
as may he needed to regulate the
same, and to maintain Its purity
and efficiency. Provided, that the
Legislature may provide for the
temporary commitment, for obser-
vation and-or treatment, of men-
tally 111 persons not charged with
a criminal offense, for a period of
time not to exceed ninety (90)
days, by order of the County
Court without the necessity of a
trial by Jury."
See. 2. The foregoing Constitu-
tional Amendment shall l>e sub
milled to the qualified electors of
the State, qualified to vote on the
Constitutional Amendments, at an
election to Is- held throughout the
Htate on the 4lh Saturday of Au-
gust. A. D. 1935. at which elec-
tion each ballot shall have print-
ed thereon the words:
“For the Amendment of Article
1, Section 15, of the State Con-
stitution by adding to said Sec-
tion a provision to the effect that
the legislature may provide for
the temporary commitment of men-
tally ill persons not charged with
a criminal offense by the County
Court without the necessity of a
jury trial."
“Against the Amendment ofj
Article 1, Section 15, of the Con-1
stitutlon by adding to said sec-
lion a provision to the effect that I
the legislature may provide for
the temporary commitment of;

election, and have the same pub-
lished as required by the Con-
stitution and laws of the State
of Texas.
Sec. 4. The sum of Five Thous-
and Dollars ($5,000) or as much
