willing to provide engineers for switch en-
gines that are Idle because of the strike. He
snld: "We are prepared to furnish the
Southern pac.fic company cns'.neovs at auy

grand chief of the order has telegraphed me

portaace of protecting fully the contract we
have with the company and we will supply-
men where they are needed to run engines.
1 will add further that In this controversy
the firemen wanted to leave the settlement
of the matter to a vote of the switch en-
gineers. We would not sgree tl that but

Talki of the Situation.
Timothy 8hea. second grand master of the
Brotherhood of Locomotive Firemen who
ordered the present strike on the Southern
Pacific system called at the office of The
Post last night
Mr. Shea say there are l?5 firemen mem-
bers on the line of road In the affected dis-
trict and that he ts advised that every mem-
ber bai gone out on strike. He diaputea the
claim made by the company and by the en-
gineers that some of the firemen have sur-
rendered their membership in the firemen
and will go with the engineers and he d.s-
pules also the claim ot tai company that
trains are being operated without incon-
venience. "I have reports from all along the line and
While they have some new men they are
not operating their trains and they arc un-
able to hanoie the switch engines as usual."

company to operate tha passenger trains.
They are the trains the people - and they
caa make tha public believe everyihlng Is
all right when passenger trains are going.
There are no desertions from our ranks and
we are satisfied witu the conditions at te

Mr. Shea ststes that the present trouble
dates back some time; that there has for
years been a controversy between the engi-
neers and firemen on the subject of the Jur-
isdiction of switch engtneers whom he claims
era firemen. "We were SHlisfled with con-
ditions" be aald last night "as they were
under our agreement of 1943 to which has
been added a supplement adopted In 1W4
which gives us the seniority claims that we
are asking for in thin instance. The agree-
ment made with the engineers last spring
however abrogates the supplement which
was granted as a part of the agreement In
lu4 and that has caused the contention.
We claim that when the oompany made the
agreement with the engineer this year
which abrogated a section of our agreement
gave us a grievance. Yet Oeneril Manager
Fay Insists that there is no grievance be-
tween the company and the firemen. No-
vember It I offered the following proposal
for arbitration i
Shall the agreement between the rep-
resentatives of tiie firemen organi-
sation and the management of the South-
ern Pacific railway relative to the sen-
iority and assignment of switch engi-
neer be applied and carried out in fu
ture as was understood and the practice
prior to the revision of the engineer
agreement effective May 1. 10.
The board of arbitration to consist of
three m Tribe re on ot whom shall be se-
lected by the Brotherhood of Locomotive
firemen one to be aslccted by the com-
pany and the two so chosen to select
the third. Bald arbitrator must have
had at some time practical experience In
the transportation department of a rail-
road as an employ in the operation of
trains but must not be In the employ of-
the Southern Pacific railway.

Switchmen's Union Seems to Have Lost
Out in Galveston.

GALVFSTON" Texas December !4.-A
forecast In The Post several day ago the
members of the Switchmen' union who have
been actively enraged against the ewttchmcn
ot the Brotherhood of Railway Trainmen
are being replaced by brotherhood men In
the Southern Pacific yards. Saturday night
several of them were released and Sunday
other were let out. Today they are all
being paid off.
The Brotherhood of Railway Trainmen ha
a contract with the Sunt Fe the Southern
Pacific and the tiniveston. Houston and Hen-
dersonthe latter also Including the Katy
and the lnternniional and Qreat Northern.
While the Brotherhood switchmen in all
these yards in Galveston have been tn the
majority no serious objection was mad td
switchmen who were members ot the dwitch-
mens union working In these yards. In
fact the Brotherhood representative claim
that the Switchmen's union men were given
the same privileges and protection as the
brotherhood men under th brotherhood con-
tract. ltut slrce the brotherhood men were given
the contract with the Galveston Houston and
Henderson which brought on a fight by
the Swkchmen's union men against the
brothel hood men. It is charged that th
Switchmen's union men working In the other
yards have taken up the fight and have made
it unpleasant for the brotherhood men In all
the yards. As the brotherhood has contracts
with nil the roads entering Galveston it now
proposed to supply all th yard except the
wharf terminal yards with brotherhood
switchmen exclusively. The brotherhood has
agree to furnish the railroads with all the
men necessary.
Grand Master Hawley of the Switchmen's
union who has been here for two weeks
directing the strike of his organisation in
theOalveyton. Houston and Henderson yards
left Saturday morning for Bt. Louis lie did
not call tiie strike off and while maintain-
ing the strike la still In effect and that the
work being done in the Galveston. Houston
and Henderson yards by the brotherhood
men is unfair practically concedes the
Switchmen's union ha lost the battle. This
organisation is affiliated with the American
Federation of Labor as is the wharf labor
organizations: but the wharf organisations
refused to go out on a sympathetic strike
and the Switchmen's union did not receive
tiie support they claimed was due them.
TEXAS COMMISSION ACTING.
Complaint of Shippers of Live Stock
Has Been Filed at Austin.
It appears that the Texas railroad com-
mission will take a hand in tne strike propo-
sition just now. Judging from advices re-
ceived last night from Austin. The Post
has the following from th State capital

AUSTIN. Texas December St. The
railroad commission today received a tel-
egram from live stocli shippers of Mar-
sthon ccm plaining that although there
are eara there in which to load live stuck
for shipment to market the Boutheni
Pacific had locked up its stock pens anut
would not permit loading.
The commission immediately wired
General Freight Agent Christian of that
road afkir.g for an explanation of the al-
leged refusal to accept these shipments.
Mr. Christian replied that on account
of the strike of firemen on the Southern
Pacific the road la not accepting any per-
ishable freight for shipment.
Chairman L. J. Storey and Commis-
sioner O. B. Colquitt had a connuitation
on the subject an! decided that such re-
fusal en the part of the road was an un-
just discrimination and a telegram was
sent to Mr. Christian notifying him that
unless Lhe shipments were accepted the
read would be charged with discrimina-
tion for which a penalty provided. No
further rei-ponse has been received from
the road.
It ia understood the cn-j-pany will today
reply to the commission on tnis subject. The
company is not prepared yet to say how
soon It can handle perishable freight on ac-
count of the strike but from Manager Van
Vleck it is learned that freight service t to
be resumed as rapidly a poswible.

ORANGE Texas December 24. There has
been absolutely nothing doing In th South-
ern Pacific yards at Orange today on. ac-
count ot the strike of the firemen. The yard
crews were called out yesterday and all the
switching done that could be done by 5
o'clock at which time the yard engine was
run onto a siding end left Unless arrange-
ments are made soon for a resumption of
worn In the yards her much loea will result

A car of fuel oil cam ill on the last

ernoon for the electric light plant but It was

With no smltch engine at work the mills
ere unable to ship lumber over the Southern

Northwestern railroad and shipments going
out by water.

EL PASO Texas December 44. Superin-
tendent C. 8. Marks of the Galveston Har-
risburg end Ban Antonio railway (Southern
Pacific Atlantic system) informed the Asso-
ciated Press tonight that all trains both
freight and passenger on hi (El Paso) divi-
sion are fully manned and that the strike of
the firemen has caused by little inconveni-
ence. 7
Joseph Bedford ot th local committee of
th wrthwhood of Locomotive Firemen
stated that the firemen had nothing to say
at present but may mak a statement to-
morrow. He stated that the number of local
men affected was fifty-five. There has ben
no change in the strike situation here and
no suggestion of disorder Advice from Al-
pine on th Valentine-Sanderson division

NEW ORLEANS December 24. The New
Orleans gateway for transcontinental freight
for Western point was almost completely
closed today by. the Southern Pacific strike.
None of th railroads offered '.hrough freight
to the Southern Pacific today. Union offi-
cials claim that fifty men are oa strike in
this city. Deeplte this the Southern Pa-
cific official themselves are uncertain
whether the strike will prove serious. It was
stated that passenger trains are moving as
usual but it may be several day before the
road learns exaetly what It can do toward
moving freight.
At the big freight terminal on th west
bank of the Mississippi considerable secrecy
was maintained admission- being denied to
every one except employes. It was learned
as train were made up and about ready to
start attempt were made to secure men to
fill vacancies. It was announced today that
most through freight which has heretofore
been transferred between the roads affected
by the strike but which were compelled to
use Southern Pacific tracks to effect tha
trensf-rs. win be temporarily transferred at
Jackson Miss.

given out in Galitcston today relative to
the strike of locomotive firemen on the
Southern Paoiflc are to the effect that
freight and passenger trains are moving on
schedule time as usual. New men were
placed on the eglne the moment they ar-
rived here last night and today the railroad
agents declare there is no Interruption of
traffic. -
Freight l being accepted subject to delay
however and very naturally thi proviso
has had some effect upon traffic for a great
deal of perishable freight is being diverted to
other lines.
The firemen are not talking and refer re-
porters to the beads of the organization
with the information that the grand master
Is doing all the talking for the brotherhood
men.
It Is yet too early to size up the situation
In Galveston as the strike took place Sun-
day night and all trains In and out bound
were taken to the end of the divisions and
some of them have hardly been delayed.

dred strike-breaker from the North ar-
rived here tonight to replace the Southern
Pacific striking firemen. Half of them were
detained in New Orleans and half sent to
ftouaton.
Southern Pacific officials announced lata
tonight that all local freight except on tha
Alexandria La. division was moving todsy
but that no through freights ran. To pre-
vent a large quantity of local freight from
being tied up. the Southern Pacific officials
have permission from Illinois Central and
Louisville and Nashville switch engine to
run ever the Southern Psclflc tracka for
the purpose of loading eara

of the Southern Pacific when seen today re-
fused to discuss the strike of the firemen on
that srystem. It is estimated however that
u men on this section of the lines sre In-

to report that employes refused absolutely
to respond. In consequence of notification
that no more freight would be accepted by
the Southern pneitic many railroud line
centering here are now diverting freight to!

Delay in Passenger Train Caused by
the Strike.

JACKSONVILLE Texas December M.
The strike of the Texaa and New Orleans
firemen went into effect here yesterday after-
noon upon the arrival ot the westbound pas-
senger from Beaumont to Dallas. This train
was delayed one hour and fifteen minutes
and was sent out with the roundhouse fore-
man on the left side of the cab. No freight
train are running today but the agent re-
port passenger trains a running on time.
All Trains Are Banning;
At the Grand Central station last high
tho passenger train of th Southern Pacific
system were operated ae usual. The bulle-
tin board indicated that train were being-
operated about on time and the attaches of
the station reported that no trouble ha been
experlenc.il it has been ascertained that
on the Southern Pacific system from El Paso
to New Orlea ns the aval age wage for the
firemen is luo per month and the average
deys work has been eight hours and forty
even mlnuies. It Is estimated It will cost
th firemen r brotherhood t&000 per month

preme court of the United State today III
the case of Sheriff Sblpp and twenty-six
others of Chattanooga charged with con-
tempt of court In lynching a negro named
Johnson after tha court had taken eognl-

Involved. In handing down th opinion. Jus-
tice Holmes announced that the preliminaries
disposed of the court would proceed with
the prosecution. He did not say when th
next step' would be taken. '
I'robahly the. most important point raised
by the attorney for Shipp and hi cedefend-
ants was the objection to th court' assump-
tion of jurisdiction In Johnaon'g oese. On
this point Justice Holme ald! : ' "
"Even If the circuit court had no Jurlsdio-
tlon to entertain Johnson' appeal and If
this court had no Jurisdiction of th appeal
this court and this court lon could decld
that such nasi the law. It and It alone
necessarily had Jurisdiction to decide wheth-
er tho case was properly before it On thle
question at leist It was Its duty to permit
argument and to Uk the time required for
such consideration as It might need. Until
judgment declining jurisdiction should be an-
nounce.! It had authority from the necessity
of the cane to take orders to preserve the ex-
isting conditions and the subject of the peti-
tion just p.m the said court was bound to
refrain from further proceeding until the
same time. The foot that the petitioner was
entitled to argue his case shows what need
no proof that the law contemplate the pos-
sibility of a decision either way and there-
fore might provide for it."
He also dealt with the contention that the
defendants had purged themelve of eon-
tempt by the statement that they had not
been participants In the murder of Johnson
Which the court did not accept.
Justice Holmes decided that the court . I
hofe party. "There Is nothing that affect
the Judges" he said "In their own person.
Their concern is only that th law should be
obeyed and enforced and their Interest la no
other than they renretwnt In every ease.
Justice Holmes also annonnoed the conclu-
sion of the court that the lynching' consti
tutes a contempt.

gersoll claimed to have been earned by him
In contesting the will ot the late A. J. Davis
of Montana. The court of appeals allowed
$6000. The widow wae not satisfied and asked
leave to bring the case to the supreme court
on a writ of certiorari. Her petition to that
effect was granted today and the court will
give attention to the Case when It 1 reached.
