cent citizen? lawlessness and anarchy to
such mi eitent that it has Instituted a reign
of t. rr.r in the Goldfield district.
It is further alleged that the Goldfield
union Is a criminal society.
T1m court Is asked to cite the defendants
licftue It lo answer the allegations of the
complaint an1 to Issue a writ of Injunction
restraining the miners from obstructing the
business of the t'onsolldated Mines company
by threat. intimidation or picketing. An
Injunction aualnst lioycott Is further asked.

Union from holding any more meetings.

a deaperat. shotgun and pistol duel between
Mouited Officer James Brannon and a ne-
K"o by th. nam. of James Williams the
latter was lodged In the city hall police sta-
tion this morning with a charge of asaault
t murder against him. Three ether negroes
whom it sj claimed by the officers were
connected with the affair were looked up
also. An ugly looking pistol was found on
one of them. While no arms of any kind
were found on either of the other two under
arrest the officers claim that they were
mlaed us In the trouble.
The trouble occurred near tne corner of
Ashland snd Alamo streets Mr. Brannon
being sent to that neighborhood by a re-
port to the effect that th. negroes were
fighting among themselves. When the offl-
eer reached the scene of the dkptnrbassoe the
"wroas osaeea their fighting and turned
then- attention to th. officer. According to
Mr. Brannon. the negro Williams as soon
as he reached the Seen on horseback turn-
ed the gun la his dh-ecOec and fired en blm
almost before be had) alighted from his
Mr. Brannon Immediately pulled his re-
volver and returned the fire of the negro.
In the meantime the negro had discharged
both barrels of the shotgun at the officer
and had raAtaded. Ono more time he turned
the gun In the direction of Mr. Hrannon. th.

close to his head. Something seemed to
have gone wrong with the gun held by the
negro at this time and he turned and started
to run. Mr Brannon in the meithtlme had
been shooting all the time and his revolver
was empty when the negro turned and ran.
He followed close after the negro and waa
Just behind blm as he ran Into a house oc-
cupied by a negro on Alamo street. The
negro occupant of the houee told Mr. Bran-
non that no negro had run Into his house
and tried to keep him from entering. The
officer forced the door open and entered the
room and as lie did so the man with whom
he had 'the shooting affray stepped from
behind the door and aimed a vicious blow
at Mr. Brannon's head with tlm shotgun.
This the officer warded off by throwing up
his left arm. hut the gun descended with
such force acriws the arm that the stock
was broken off near where the barrel Joins
It. Mr. Brannon then clinched with the ne-
gro. In the meantime the other negro In
the room had come to the assistance of the
one the officer was trying to arrest.
Mr. Brannon had great difficulty In keep-
ing the other negro from getting hold of
him and only did so by keeping the negro
Williams between himself and the oOter.
He finally managed to kick open the door

porch where he struck Williams over the
head with the revolver. In the meantime
two young men who happened to be passing
went lo the assistance of the officer and
both negroes were taken in clmrire. The
broken shotgun waa pent to the police sta-
tion with the two negroes. An examination
developed the fact that one of the barrels
contained a loaded shell. It Is presumed
that the only reason the nepro did not fire
the last charge at the officer Is the fact
that the shell had become cIo-kc.1 in the
extractor In such a manner th.it the firing
pin could not hit the cap.
Mr. Brannon phoned thnt he having
much trouble with the negroes In that sec-
tion and Chief of Police Hrandenhurg.
Mounted Officers Ryan. Davis and (laney
went to the scene of the trouhle. They ar-
rested two of the negroes and Mr. Brannon
secured th. other two.
It was the universal opinion of all around
the police station this morning that Mr.
lirannon exhibited considerable nerve In en-
tering the house when be knew his pistol
waa unloaded and th:it there was a desper-
ate negro armed with a shotgun inside wait-
ing for him.
The other three nroc ' were Joe
Caldwell Edgar Wylle and Karl Evani.
While the negro Wlllum: o.t considerable
blood from the blow on the head from Of-
ficer Brannon's pistol his hurfs were not
serious enough to require medical lUientton.

ily were about to sit down to their Christ-
mas dinner a the home of Mrs. Jennie Rees.
Mrs. Amesbury's mother here today.
Dr. Ameebury waa placed Vider arrest im-
mediately after the shooting.
Mrs. Amesbury had come from Virginia
to pass the holiday with her anns. Walter
Amesbury. Jr. and Ira Amesbury. who live
with their grandmother Mrs. Rees. Dr
Amesbury came from Mllford where he hss
practiced for some time to the Christmas
festivities st the family home.
According to the police Dr. Amcsburr
fired two shots. Both took effect In Sirs
Amesbury's right side. Her death was al-
most Instantaneous.
After his arreet Dr. Amesbury declared
that the shooting was accidental. He would
not make any further statement.
Mrs. Amesbury was i years of age and a
native of Kentucky. Since her mariiaye to
Dr. Amesbury they had lived at different
times In Kingston and Duxhury. Mass and
Corslcana. Teias. Home time ago Mrs.
Amesbury went to Virginia and began levell-
ing music in FBnanoke college.
According to the police lr. Amesbury and
Mrs. Amesbury became engaged In a quarrel
regarding a family matter They were con-
versing In the kitchen alien suddenly the

a distance of two blocks. On the northeast J
corner of Taylor and Wealherf irti streets
he had stopped snd was looking directly at
the building when the explosion occurred.
As sown as he had somewhs'. recovered from
the Jar of the explosion for It was of such
force as lo almost fell him lo the ground.
Mr. MrClosky ran to the build nc snd flred
s shot through the open door In the hope of
thwarting Ihe would be robbers In their de-
signs. Hearing no further noise he ventured
In and then rapidly made s detour of the
wood yard snd the neighboring territory In
the hope of locating some one thst might
be connected with the plot Wit ft this bsief
rsconnoltev made Mr McCloaky then went
to the nearest phone snd proceeded to call
up President Lechner or the Southwestern
Detective agency whit h maintains the alarm
system and to notify the police. Mr. Lech-
ner and Mounted Officer Turner arrived
shortly afterwards and made note of all evi-
dence on which a clew might be founded.
The dynamite had been placed under the
safe which leads the officers to believe
that the aould be robbers were amateurs.
To make their work more secure the safe-
blowers had exploded giant flrecrxrkers snd
torpedoes In the vicinity at frequent Intervals
for the st a e of some thirty minutes before
putting their plan Into execution. As fire-
works had been exploded pretty frequently
during the entire evening residents of the
neighborhood paid but very little heed to
the noise which continued to grow with
Increased volume as the shte of the explo-
sives were gradually Increased. Passersby
were freeraent even though the hour was
grow lag late which adds to the venture.

later than usual Tuesday evening going
home about 9 o'clock. He later went up town
and passed the office en route home about
midnight. He heard the noise of the explo-
sion and immediately got out of bed snd
dressed As he was dressing some one
knocked s; his door to inform htm of the
incident. Sir Zlnn has no Idea who the per-
petrators of the plot are.

stsnding in the aisle running through the
livery stable adjoining st the time and says
the Jar was so great as to almost knock Mm
down.
Detective l-eohoer and Mounted. Officer
Turner feued an old soft felt hat behind the
building that apparently had been lost by
the would be robber In his flight. They also
found fresh tracks leading out through the
yard which leads to the belief thst the plot-
ters made their entrance from the rear and
that they might have remained crouched be-
hind a woodpile while the fus- burned up
to the dynamite charge. That the entrance
wss made through the rear Is practically
a settled fact.
The safe on which the attempt was made
is thirty-six Inches In height aad across the
aid. about twenty-eight Inches.

While disclaiming exact ksowledge as to
the reuse of Admiral Brown son's resigna-
tion the surgeon general's statement leaves
little room for doubt that th. eoatttnrarty

"Admiral Brownton and I have keen
friends for years snd at on. time I was his
family physician. His resignation asfkhiet
of ths bureau of navigation has been as-
signed to various causes smong ethers the
differences of opinion as to the command of

LINE OFFICERS NOT DESIRABLE.
Surgeon General Rlxey then said the Re-
lief belonged to the army snd waa always
commanded by a medical officer whan used
ss s hospital ship. In attempting to unify
the medl'nl sen ires of the army' and. the
navy he sa's that a joint army ami navy
board of medical officers -which was oon-
ver.ed b executive order more than a year
ago. re i-nniended that the hospital ships
should le commanded by medical officers

by both Ihe secretary of war and the secre-
tary of the navy In general orders...
Since the Civil war he says all hospital
ships and medical transports of the army
had been placed under the surgeon general
of the army. He says further that Japanese
naval hospital ships were commanded by
naval hospital officers after having trie!
land officers. These ships he says a re
simply Posting hospitals properly under
the control of the medical department and
should be conducted In pesos exactly as In
time of war. This Is especially so be adds
because during war time line officers ean
not be spared and do not desire to nosamand
these ships. V
He maintains that It always hag seen a
doubtful question If the Geneva and Hague
agreements couM guarantee tha neutrality
of these ships If combatant (line orOeers) and

Surgeon General Rlxey's statement waa

Mariano Gaewi was called to the door of

and shot and killed by an unknown Fount
man. John Frank. Janitor of the building
pursued the murderer who fled up the stair-
way and. reaching the root disappeared.
