The Injunction suit filed by S. Rouse
proprietor ot Rouse's drug store to com-
pel the Southwestern Telegraph and Tele-
phone company to furnish him service
over a public telephone without Installing
a slot Instrument In hla place of busi-
ness was submitted on briefs for both
sides yesterday and Judge Ashe an-
nounced during the afternoon that he
probably" would render a decision In the
case today.
In connection with the hearing yester-
day a motion was filed by counsel for
the plaintiff asking that Manager Pren-
tice of the telephone company be cited
to appear end show cause why he should
not be fined for contempt for alleged vio-
lation of the temporary Injunction order
Issued by Judge Ahe. The hearing of
this contempt proceedings has been set
for Wednesday morning at 10 o'clock.
In the motion it Is alleged that after
the issuance of a temporary restraining
order by Judge Ashe commanding the
defendant to furnish service over the
public telephone In the establishment of
the plaintiff the defendant's agents in
four Instances failed to give service.
Will Carry Case Up.
Should the outcome of the Injunction
suit be unfavorable to the telephone
company. It Is stated that the company
will carry the case through the higher
courts to have the question Involved
tested.
Mr. Rouse Is seeking to compel the
telephone company to furnish him service
over a telephone which he has Installed
In his place of business for the use of
his patrons. - He charges In affidavits
that have been filed with the court that
the company Is discriminating against
him. In that It Is refusing to furnish him
service over a telephone such aa It Is
furnishing- to large numbers of Its other
subscribers.
In support of that allegation an affi-
davit was filed by Guy Graham counsel
for the plaintiff in which he alleges that
he communicated with the chief operator
and ascertained that she had not been
instructed to discontinue service to any
one else except Mr. Rouse although oth-
ers are using telephones for the same
purposes.
The company claims that a subscriber
has no right to establish a free telephone
service; that It has for such purposes pay
telephonea which it Is willing to Install.
Condemnation Suit Appealed.
From the action of the condemnation
commissioners fixing the value of land
sought to be condemned by the Hous-
ton Belt and Terminal Railway company
for right of way purposes for its belt
line around the eastern portion of the
city J. R. Check and Daniel Ripley have
filed an appeal In the county court.
Cheek claims that the land sought to
be condemned by the railroad Is worth
12500 per acre and th.ut the remaining por-
tion of his land through which the rail-
road will run will be damaged to the
extent of J90.000.
He alleges that the property Is between
the city and Magnolia Park and of suffi-
cient distance from the ship channel and
turning basin to be valuable for residence
property. It was acquired by Mr. Cheek
with a view of plotting It. he asserts.
It Is alleged by the defendant that the
railroad projected will cross the land
diagonally and will segregate from the
main body a triangular piece of land
amounting to about sixty-four acres.
In the appeal of Daniel Ripley it 's
alleged that the commissioners allowed
him 11200 per acre for 7 94-100 sought to
be condemned by the railroad company
which land he claims is reasonably worth
13500 per acre.
He alleges that his property consist-
ing of a one-half interest In 342 71-100 acrs
of land will be damaged by the construc-
tion of the railroad to the extent of about
$500 per acre.

Alf Gardiner filed suit In the district
court yesterday against the Adoue-Blalne
Hardware company to recover J2904.25 al-
leged to be due as salary and his part
of the profits from a gun club.

A summary of weather conditions that
prevailed during the past month over the
State show that temperature were
slightly in excess of the normal and
precipitation somewhat deficient' -
The mean temperature gathered from
reports from 110 stations showed a deT
parture from the normal of plusNl.4 de-
grees. The highest monthly .mean yraa
89 at Fort Mcintosh and the lowest
monthly mean 72. JV. degree at-Dalbari.
The highest temperature waa 111 degree
at. Eagle Pas -on June (. The lowest
temperature on June U of 42 degrees at
Plemons. The monthly range - of tem-
perature was 71 degree for the Btate
the greatest dally range being 10 degree
recorded at Bonn era and Romero.

the State determined from reports from
166 stations- was 1.90 inch or 1.37 Inch
less than normal. The greatest rainfall
during the month was 7.3S Inches at
Grand Saline. The least monthly precip-
itation was .04 at Bonham. The greatest
rainfall In twenty-four consecutive hours
was 3.66 at Galveston on June 22 and 1.
Over the State the greatest number of
rainy days was four. The general wind
direction was south and the maximum
veloeitv recorded was fifty-two mllei
from the northwest at Corpus Chrlstl on
June 5. There were eighteen clear days'
eight partly cloudy and four cloudy.

Declaration.
Rudoifo Fernandex a native of the
Philippine Islands appeared before Dep-
uty Clerk L. C. Maaterson of the United
State court yesterday and declared hla
intention of becoming a citizen of the
United States.
Fernandex while a small boy waa
brought to thla country from the Phlllp-
jplnea by General John A. Hulen of Hous-
ton. He has beeh educated In the publio
school of Houston. He gave his occu-
pation yesterday as that of an office
clerk and student. ' .
He I 19 year old and now reside at
2301 San Jacinto street. He arrived
with General Hulen at San Franciann
April 1. 1901 on the United States t rani-
port Logan.
