The board of education probably
will meet Monday night to hear City
Controller H. A. Giles' explanation
of the school bond sinking fund shor-
tage according to C. H. Hurlock
president of the board.
In a report made to the board
Thursday Mr. Giles charged a surplus
of 115404 on certain of the Issues
against the total deficit of 194139.
and J. G. Donovan chairman of the
finance committee of the board of
education. In a public statement
questioned the legality of such a pro
cedure. Mr. Donovan objected also to
the deduction from the total shortage
of a 14586 deficit in cM district
bonds and $7000 which has accrued
between May 1 and August 1.
Mayor Holcombe wrote to Mr. Hur
lock Saturday and asked him to con
vene the board for the purpose of
hearing Mr. Gl.es' explanation of bis
statement. School superintendent H.
Ft. Coustr.s has ben requested to
notify the numbers of the special
meeting.

Sam R McKaskle. convicted of the
murder of I. J. Robertson Feb. H
and sentenced to 2 years in the State
per.itrntiary. Notice of appeal was
given.
Sentence of not lss thin five years
nor more than 2 was passed on Mc-
Kaskle but suspended until the ap-
peal is heard.
Motion for a new trial for Tom
Hare also was overruled. Hare was
given a senter.ee of 15 months on a

Convicted here In criminal district
court with Judge Ewlng Boyd on the
bench and given a sentence of 16
years in the Stat penitentiary Mc-
Gowen was granted a new trial by
Judge Boyd when U became known
that one of the jurors had been con-
fined in an asylum In the east some
years previous and had been dis-
charged but given parole. A change
of venue also was granted.
The trial as well as the shooting of
George Emrey formed one of the most
sensational cases in the history of
Harris county. Emrey was shot down
as he approached the home of Mc-
Gowen to settle differences arising
between Mrs. Emrey and Mrs. Mc-
Gowen In regard to chickens and flow-
ers. A man's cuff was seen at the
window through which the shots were
fired according to testimony. Mrs.
McGowen reported to be of the Hun
garian nobility electrified the court
room in the habeas corpus hearing
when she claimed to hive fired the
shots that killed Emrey. .
McOowen claimed self defense when
the case went to trial here before
