He leaves a widow and two small chtl-1

Funeral services were held from the!
family residence Sunday afternoon I
with Rev. Arthur aiartman of Bt
Paul's Evangelical Lutheran church I
officiating.
Ths foregoing la an onlnlam handed
down by the attorney general's depart-
mentand was written bv Assistant
Attorney General L. C. Sutton In re-
ply to aa Inquiry by R B Walthall
secretary to the governor. The In.
qulry aa worded by the secretary was
as follows: -A party was sentenced
to the penitentiary for two years. He
had served all but M days ef his sen-
tence when the governor granted hlirl
a M-day furlough. At the exniratbm
ef thla furibugh will the party be 'en-
titled to. a discharge or will U be
necessary that ha return to the peni-
tentiary and serve ths rest of hia sen-
tence T" i - "..(
In ths opinion of the attorney .geni
eral's department the man will not be
required to serve the N days because
of ths fact that be was really serving
part of his sentence on the outside of
the confines of the prison walla. The
furlough In this ease Is treated In ths
opinion as follows: "No conditions
have been broken nor Is there any
express .provision or understanding
that the time of the furlough Is not
to be counted aa time served.
Upon principle however we are of ths
opinion that the furlough does not dis-
close aa intention on the part of the
governor to suspend the execution of
the sentence for the period of tno
furlough so as to require that the con-
vict serve such time in the penltn-
tlary In addition to what would other-
wise be ths end of his sentence."
