The court was asked to appoint sales
agents who under supervision of trus-
tees shall sell the yards giving prefer
ence to buyers in una order;
Live stock producers stockholders in
the yards other than the defendants
common carriers serving tbe yards local
citiaens or municipalities or focal' syndi-
cates. The packers asked the court to fix the
minimum prices of shares in the various
yards at the same figures as proposed in
tbe disapproved plan with the exception
of the yards at 8t Louie. They asked to
hive those share priced at $120 instead
of $no.
A separate plan was presented for the
sale of the yard at Jersey City to local
interests. Tbe yard was offered to the
Pennsylvania railroad which declined to
buy.

In 117 W. J. Johnson then City Attorney conducted for ths City Council
s democratic primary election under the prefarohtial ballot to fill the vacancy
in the office of Mayor.
He participated in the campaign aa a manager for one of the candidates
and took the ballot pledge to support the nominee.
Joseph C. Hutcheson Jr. was declared the nominee and aa such nominee
wss duly elected by the people. y
Johnson though obligated by hta pledge to support the nominee and by
hia professional duty as City Attorney to advlee and defend the City Council
took private employment and brought suit to enjoin the City Council from
seating Mr. HfUeheson.
In this suit' he declared the preferential primary Illegal and the nomination
of Mr. Hutcheson void though he had as City Attorney advised the calling of
it and as a participant took part in it under the pledge to' support the nominee
