LAWS, I WOULD HOPE THE BILL WILL BE UNANIMOUSLY REPORTED,
THESE LAWS, IF THEY EVER SERVED A LEGITIMATE PURPOSE,
ARE TOTALLY OUT OF DATE IN 1975, THEY COST THE CONSUMER
OF THIS COUNTRY AN ESTIMATED $1,5 TO $3 BILLION A YEAR,
THEY RUN COUNTER TO THE FUNDAMENTAL GOAL OF OUR FEDERAL
ANTITRUST LAWS: THE PROMOTION OF EFFECTIVE FREE COMPETITION
IN THE MARKET PLACE,
TO PUT THE MATTER IN PROPER LEGAL CONTEXT, SO-CALLED
"FAIR TRADE" LAWS PERMIT AGREEMENTS BETWEEN A SELLER AND HIS
PURCHASERS WHEREBY THE PURCHASERS WILL NOT RESELL THE PRODUCTS
IN QUESTION BELOW A STIPULATED MINIMUM PRICE, THESE ARE
PRICE-FIXING AGREEMENTS IN PURE FORM, ABSENT SOME FORM OF
EXEMPTION THEY WOULD CONSTITUTE PER SE VIOLATIONS OF THE
FEDERAL ANTITRUST LAW, THE MILLER-TYDINGS AND MCGUIRE ACTS
ARE THE EXEMPTION,
EARLY IN THIS CENTURY SOME STATES SOUGHT TO PERMIT SUCH
AGREEMENTS BY STATUTE, BUT A FEDERAL ANTITRUST EXEMPTION WASl
