Gays sue over Canada's pension benefits

TORONTO — An Ontario Superior Court
judge was told that "almost equal is not equal"
as the proceedings for a nationwide class-
action suit began Monday on behalf of gays
and lesbians seeking Canada Pension Plan
benefits for their deceased partners.
The $400-million lawsuit alleges discrimi-
nation against same-sex couples by denying
survivor pension benefits to gays and lesbians
whose partners died before Jan. 1, 1998.
The federal government imposed the 1998
cutoff date when it introduced Bill C-23, which
granted a variety of rights to same-sex couples

first authorized equality promise
in 2000.
The Crown contends that providing bene-
fits retroactively to Jan. 1,1998, was generous,
and is in step with the evolving legal status of
same-sex relationships.
The suit seeks benefits retroactive to April
17, 1985, when equality guarantees were
included in the Canadian Charter of Rights
and Freedoms.
Last December, a judge gave his approval
for the nationwide class-action suit to proceed
on behalf of gays and lesbians, combining two
separate suits launched in British Columbia
and Ontario.
A lesbian and four gay men were appoint-
ed as representative plaintiffs of same-sex
partners who were denied survivor pensions.
Quebec is the only province not represent-
ed in the lawsuit because it operates a separate
pension plan.

HONG KONG — The head of Hong Kong's
Roman Catholic Church met with gay rights
activists Monday to hear their complaints
about a church publication that criticized
same-sex marriages.
Bishop Joseph Zen told reporters that he
cannot support gay marriage because it is
against church doctrine.
Yeo Wai Wai, of the gay rights group
Rainbow Action and one of seven activists to
attend the meeting, said she was disappointed
by Zen's remarks. "He does not know our
pain," she said.
Last month, several gay activists stormed
into the Cathedral of the Immaculate
Conception and disrupted Sunday Mass, in a
protest against articles in the Hong Kong
Catholic weekly newsletter against gay mar-
riages.
The Hong Kong diocese later denounced
the protest.
Hong Kong's government does not recog-
nize same-sex marriages. T
