Weekly Report

On Monday morning at ap-
proximately 4am, deputies re-
sponded to a report of a man and
woman fighting in the front yard
of an Archer City residence.
Upon arrival, officers located
the subjects and determined
that alcohol was involved in
the altercation. The woman was
eventually arrested for Public
Intoxication and transported to
the Archer County Jail.
Just before 9am, deputies,
Scotland and Windthorst 1st
responders, and a DPS Troop-
er responded to a one vehicle
rollover accident on US 281
approximately 2 miles north
of Scotland. AirEvac was also
dispatched to the scene of the
accident. The driver, 20 year
old Stephanie Shurtz of Wichita
Falls, was ejected from the ve-
hicle. She was transported to a
Wichita Falls hospital where she
was later pronounced deceased.
DPS is investigating.
A short time later, deputies re-
sponded to a report of a possible
burglary in progress at a cabin
at Fake Kickapoo. The owner
of the cabin who lives out of
town was contacted by a neigh-
bor who told him there was a
vehicle parked at the cabin and
possibly people inside. When
Officers arrived they conducted
a registration check on the vehi-
cle parked in the driveway. The
vehicle belonged to an Archer
City man who had reported the
vehicle stolen in Wichita Falls
the latter part of July. Officers
searched the property but there
was no evidence that anyone
had been inside the cabin. The
vehicle was impounded as evi-
dence for Wichita Falls Police
and the owner notified of its re-
covery.
Just after 6pm, deputies re-
sponded to a report of a sui-
cidal man who lives in Fakeside
City. The man called a Wichita
Falls mental health facility and
told them he was going to com-
mit suicide by drinking alcohol
and taking pills. Officers went
to the residence and found the
man who had been drinking al-
cohol. He was transported to the
Wichita Falls State Hospital and
admitted for evaluation.
Shortly after 9pm, deputies
responded to Kell West emer-
gency room to investigate a re-
port of a dog bite that occurred
in Scotland. The victim, a 4
year old child, was bitten by a
family member’s dog while she
was visiting at the residence.
The dog had previously been
vaccinated for rabies and will
be quarantined on the owner’s
property for 10 days as required
by law.
Just before 11pm, deputies,
Holliday Police, and a DPS
Trooper responded to an anony-
mous report of a couple fight-
ing in the yard of a Holliday
residence. The caller said the
fighting had been going on for
4 hours and that clothes were
being thrown all over the yard.
When officers arrived, the fight-
ing was determined to be verbal
in nature and no assault had oc-
curred. The female involved
agreed to leave the residence to
avoid any further conflict.
On Tuesday morning, deputies
and a Game Warden responded
to a report of an abandoned mo-
torcycle sitting in the lake bed
of Fake Wichita on the Archer
County side. A Wichita Falls
Police Officer patrolling on the
Wichita Falls side could see the
bike and what appeared to be a
person lying on the ground be-
side it. When officers arrived,
they found the bike and a bunch
of gear including a helmet on
the ground however no rider
was located. It was determined
that the bike was stuck and the
rider had left to get help getting
it out.
Shortly after midnight, depu-
ties responded to back up Archer
City Police on a disturbance call
at an Archer City residence.
When deputies arrived they
found the police officer trying to
detain a female subject who was
intoxicated on an illegal sub-
stance by her own admission.
The female was then detained
and arrested for Public Intoxica-
tion and transported to the Ar-
cher County Jail. After being re-
leased from jail at approximately
7am, officers again responded to
the same residence when the fe-
male became involved in anoth-
er altercation with family mem-
bers. Officers issued a Criminal
Trespass warning to the female
and she left the residence to stay
in Wichita Falls.
On Wednesday afternoon, dep-
uties responded to a Fakeside
City residence on a complaint
of phone harassment. The resi-
dent reported that he had been
receiving numerous harassing
phone calls from a woman after
she had been told to stop call-
ing. A report was made and an
investigator will follow up with
a warrant issued if the case is
confirmed.
Eater that night, deputies re-
sponded to Megargel on another
report of phone harassment. The
reporting person told officers
that she had been getting harass-
ing calls and texts from an ex-
boyfriend and his sister on nu-
merous occasions. A report was
made and an investigator will
follow up.
On Thursday just after 6pm,
a deputy and Holliday Police re-
sponded to a report of two men
fighting in the street in Holliday.
The caller advised that one man
owed the other some money and
he went to collect it and that’s
when the fight began. Officers
arrived on scene and spoke with
both men. Neither man wanted
to press charges against the
other and one of the men left the
area after being advised to do so.
No further action was taken.
On Friday afternoon, deputies
and Archer City Police respond-
ed to a report of a disturbance at
an Archer City residence. The
caller, a male juvenile, reported
that his father slammed him on
the ground and he wanted him
arrested. Officers arrived on
scene and after speaking with
both parties, determined what
occurred was a discipline issue.
No further action was taken.
Eater that evening, depu-
ties responded to a report of a
disturbance between two male
subjects at JP’s Quik Stop in
Fakeside City. The caller ad-
vised that two men were having
a heated argument in the park-
ing lot of the business and were
yelling at each other. The caller
advised that the men left the
store headed south on Hwy 79
driving an older minivan with
Oklahoma registration. Officers
located and stopped the vehicle
on Hwy 79 and FM 2224. Both
occupants were checked and the
driver was issued a citation for
an invalid driving license. They
calmed down and were released
to go on their way.
Then a young male in Archer
City called dispatch and request-
ed officers, saying his father had
just assaulted him. Officers ar-
rived and found the young male
to be a juvenile and the incident
was determined to be a disci-
pline issue and not a crime.
In the afternoon of the next
day, Saturday, deputies located
a Scotland man who had an
outstanding warrant for Assault
Causing Bodily Injury - Fam-
ily Member. While at his resi-
dence deputies found a woman
who also had arrest warrants out
of Wichita County. They were
both arrested and transported
to jail for booking without inci-
dent.
In the early morning hours of
Sunday a Holliday woman called
to report that her boyfriend was
drunk and had thrown her per-
sonal belongings in the pool.
Deputies and Holliday Police
Officers arrived and found that
both subjects had apparently
been drinking and arguing. No
arrests were made at the scene.
The Holliday Police Department
is investigating the incident.
Eater that evening, a Holliday
woman called to report that her
boyfriend had stolen the title to
her vehicle. Deputies and Hol-
liday Police Officers arrived and
conducted a civil standby so that
both parties could divide the
property from their residence
amicably.
At approximately the same
time, deputies were requested
at United Regional Hospital in
reference to an assault. Depu-
ties located a young man in the
E.R. that was being treated for a
laceration on his head. The man
stated that while he was visit-
ing a woman in Archer City, her
male roommate struck him in
the head with a chair, and then
kicked him several times af-
ter he was on the ground. The
woman he was visiting was later
located by officers and subse-
quently arrested for an outstand-
ing Archer County warrant for
Theft By Check. Investigators
are following up on the assault
incident.

I’ve been an attorney for eighteen years.
I have civil trial experience and have worked as part of the legal team on multi-million
dollar domestic and international cases. Since January 2010 I have served as Co-Public
Defender for Archer County in misdemeanor criminal defense. I have far more experi-
ence than my opponent did when he was appointed to the job in 1992, a little over one year
after graduating from law school.
Nationwide, jury trials account for only about six percent of criminal convictions. Here
in Archer County, my opponent takes credit for “OVER 30 Criminal Jury Trials” over a
period “20+ years” — well below the national average, relying instead on plea bargains.
According to the Supreme Court, our criminal justice system “is for the most part a sys-
tem of pleas, not a system of trials.” Nevertheless, plea bargains must be effective.
“To a large extent... horse trading [between prosecutor and defense counsel] determines
who goes to jail and for how long. That is what plea bargaining is. It is not some adjunct
to the criminal justice system; it is the criminal justice system.” Missouri v. Fry, 566 U.S.
_(2012).
I know how to evaluate. I know how to negotiate. I have used these skills effectively
over the years. A jury trial is a matter of showing Archer County neighbors that our law
enforcement officers did their jobs correctly. I am confident that I can do that effectively
when the time comes.
As County Attorney I will consider each case on the merits, and will give a break where it
is warranted, such as a high school student or a young person in the military. I will not,
however, continue to allow repeat offenders to escape the consequences of their bad choic-
es. “Get Out of Jail Free” cards belong in a Monopoly game, not in Archer County Court.

Archer City Community Hosts Blood
Drive September 18
All healthy Archer City-area
residents are encouraged to do-
nate blood with Texas Blood
Institute (TXBI) in a blood
drive. The drive will be held
from 2 p.m. to 6 p.m., Tuesday,
September 18, at First Baptist
Church Family Fife Center on
225 S. Center. Each donor will
not only be saving up to three
lives by giving, but also receive
a commemorative blood donor
T-shirt, health screenings and
Donor Rewards points, redeem-
able for items in TBI’s online
store.
Any donor who wishes to sup-
port Children’s Miracle Net-
work Hospitals - locally, United
Regional - can forgo the T-shirt.
In turn, Texas Blood Institute
will make a monetary donation
of similar value to United Re-
gional. It’s a chance to ‘dou-
bly give’ to local children bat-
tling critical health conditions
- through the life-saving gift of
blood and support for pediatric
medical research, community
outreach and treatment initia-
tives.
“Someone needs blood every
two seconds,” said John Annit-
age, M.D., president and CEO
of Texas Blood Institute. “This
constant need is why we are ask-
ing everyone to make blood do-
nation a priority.”
Because there is no substitute
for blood, the supply must con-
stantly be renewed.
Although all blood types are
needed, those with O-negative
type blood are especially en-
couraged to donate. According
to the American Association of
Blood Banks (AABB), those
with O-negative blood type
make up only nine percent of the
national population. However,
O-negative blood can be used in
any emergency situation when a
patient’s blood type has not yet
been identified.
Texas Blood Institute is a non-
profit, regional blood center. Its
donors exclusively provide ev-
ery drop of blood needed by pa-
tients in all hospitals in Wichita,
Clay, Hardeman, Foard, Archer,
Baylor and Wilbarger counties.
Anyone, 16 years or older*,
can typically donate blood.
Blood can be given every 56
