The obtaining by iny person of any money or other thing
of value with intent to defraud by the giving or drawing of
any check, draft ir order upon any bank, person, firm, cor-
poration with whjch or with whom such person giving or
drawing said chedk, draft or order has not at the time of
or drawing said check, draft or order, or at the
course of business Stich check,
. 3. The obtaining by false pretense the
possession of any instrument of writing, cer-
tificate, field notes or other paper relating to
lands, the property of another, with the intent
that thereby the property owner shall be de-
feated of a valuable right in such lands.
Article 1422. Certain Wrongful Acts in-
cluded.-Within the meaning of the term “swin-

dling are included the following wrongful

believe that sucji check, draft or order will be paid; pro-
vided, that if said check, draft or order is not paid on pres-

said check; and provided further, that if such check, draft
or order is not paid within fifteen days after the same is
returned unpaid, it shall be prima facie evidence that no
good reason existed for believing that said check, draft or
order would be pud and it shall also be prima facie evi-
dence of intent to defraud and knowledge of insufficient

1. The exchange of property upon the
false pretense that the party is the owner or
has the right to dispose of the property given

2. The purchase of property upon the
faith and credit of some other person upon the
false pretense that such other has given the ac-
cused the right to use his name in making the
acquisition.
6. This act shall be cumulative of all
other laws on this subject and should any Sec-
tion or provision be declared unconstitutional
such decision shall not effect any of the re-
maining provisions of this act.
