Commissioners court tables
action on lease of ‘school land’

After receiving only one
bid, Upshur County Commis-
sioners Court on Wednesday
tabled for further study
awarding an oil and gas
lease on part of the coun-
ty’s “school land” in West
Texas.
The court decided to allow
time to review the bid from
Petex, a firm in Brecken-
ridge, for the lease on about
900 acres in Throckmorton
County. The sealed bid was
opened during Wednesday’s
meeting.
Certain revenue from
about 17,000 acres of Upshur
County-owned “schoolland”
in Baylor and Throckmor-
ton Counties is distributed
among the nine school dis-
tricts lying partly or wholly
in Upshur County.
Petex offered a 3/16
royalty, and $1 per acre for
a “shut-in royalty.” The firm
could shut down a well if
oil prices drop below $40 a
barrel.
In other business Wednes-
day, the court approved a
resolution adopting the Up-
shur County Hazard Mitiga-
tion Action Plan.
The Kilgore-based East
Texas Council of Govern-
ments devised the plan,
which County Judge Dean
Fowler said keeps the county
in compliance with Federal
Emergency Management
Agency (FEMA) regula-
tions.
The court also heard Tom
Woody of MMI Construction
in Weatherford report that
he believes renovation of
the courthouse being done to
comply with the Americans
With Disabilities Act is on
schedule.
“Everything looks good,”
Woody said of the project,
which involves work at the
basement’s eastern end. The
court then voted to move the
Adult Probation Office from
the basement’s northwest
corner to the southeast cor-
ner, thus trading places with
the building maintenance
department’s quarters.
In another matter, the
court approved letting the
Sheriff’s Office contract with
an online service which tries
to help find stolen items that
have been taken to area pawn
shops.
Fowler said pawn brokers
use Leads Online, LLC, to
enter data on pawned items,
and that the Sheriff’s Office
can key in a description of
a stolen item with its serial
number. If a pawn broker has
entered that item, the Sher-
iff’s Office can be directed to
that pawn shop to recover it,
the judge said.
The Sheriff’s Office has
used Leads Online on a trial
basis and solved one burglary
as a result, Fowler said. The
court approved a 12-month
contract of $2,848.
In other action, the court
effectively approved giving
the new court coordinator
in the 115th District Judge’s
office, Teena Henson, a check
making up for a shortfall in
her pay by the next day, af-
ter she threatened the court
with a lawsuit if it didn’t act
promptly.
Discussion established
that Miss Henson had taken a
job in Judge Lauren Parish’s
office, but had not been paid
the same salary as the person
she replaced.
On Thursday, Pet. 3 Com-
missioner Frank Berka said
he understood that Judge
Parish “did not make it clear”
she wanted Miss Henson
to receive the same salary,
and that County Treasurer
Myra Harris’s office, which
handles payroll, did not ques-
tion it.
During the meeting, Miss
Henson told the court, “You
owe me four weeks of pay, and
all I’m going to say is, if it’s
not done by noon today, there
will be a lawsuit filed.”
Berka then called the situ-
ation an “error of omission, ”
and asked her if there was a
problem with making up the
shortfall on her next check.
She said yes, because “I need
the money now.”
Berka assuredher it wasn’t
the court’s position “to short
you.”
County Auditor Janice
Tucker said, “I’m thinking a
phone call should have been
made” from the payroll de-
partment to Judge Parish.
“If I was doing payroll, I
would have questioned this, ”
Ms. Tucker said.
Since Mrs. Harris was at-
tending a school in Austin,
one of her deputies, Brandy
Vick, represented the Trea-
surer’s Office at the meeting.
After Mrs. Vick said it was
hard to run a payroll for just
one person, and would take
until the next afternoon,
Miss Henson agreed to give
the county until 5 p.m. the
next day to pay her, and the
court approved changing
her pay effective Wednesday
(May 15).
