trations and reading matter suited
to the holiday season No effort
will be spared to make this the

afford a splendid medium for the
holiday advertiser Only a lim-
ited amount of space will be sold
to advertisers and the first to
make application will be accom-
modated
HOLDING COTTON
TAgeneral request has gone out
from the headquarters of the
Texas Farmers Union to far-
mers all over Texas asking them
to hold their cotton for 12 cents
and not sell an more for less
than that price It is believed
the request will meet with favor
Farmers are already holding their
cotton
Speaking of this matter the
Fort Worth Record says
Each of the three railroads
having headquarters here reports
that the gross earnings for Oct-
ober this year as compared with
October of last year show a de-
cided falling off The exact
amount of this decrease cannot
be obtained but one auditor
stated that it would surprise the
public if the figures were to be
announced
Of course tho cause of the
falling off in the receipts is due
entirely to the farmers holding
their cotton for better prices
said one auditor yesterday And
of course it goes without saying
that in time the railroads will get
the tonnage that was not gotten
during October
When one stops to consider
that in nearly every town in the
state the banks are read yes
even anxious to lend as much as
10 and in some places as much as
45 a bale on cotton one can see
how and why the farmers are pre-
pared to hold nnd arc holding
heir cotton If cotton touches
10 cents and remains at that price
for a few days we will havcall the
tonnage wc can care for
EXCUSE US
We hope the public will excuse
us if wc refuse to go into a quar-
rel with an alleged afternoon
paper that is picking at us at
present Wc have better use for
our space besides wc consider
the game too small for our gun
Be generous to them Dont
blame them for being envious
hey have a reason to be The
Herald is growing and has no
fault to find with its business
The Daily Butinsky will please
excuse us from any further notice
Wc cant afford to give it public-
ity except at regular advertising

Peters alias Frank Mclntyre ontered
a plea of guilty to the charge of
swindling in Jndgo Scotts court this
morning and was given two years in
tho state penitentiary There are sev-
eral other indictments against Peters
on tho saino charge but bis pica of
guilty will likely cause these to be
dismissed
The Peters case 19 quiio a noted one
in tho state and one in which all of
tho railroads will take an especial in-
terest Peters is known as tho hand-
hold damage man and has been able
according to statements of tho rail-
road officials to get a considerable
sum of money first and last from the
railroads by getting in their employ
and soon afterward ho would get hurt
and get a considerable amount of
damages in this way
Tho story of Melvin Peters alias
Frank Mclntyre is a long ono and be-
gins in April 1902 at Palestine On
that dato he claims he was a brakeman
on tho International and Great North-
ern railroad and was injured by a fall
from a box car the hand bar on tho
car pulling out and allowing him to
fallHe
He underwent a thorough medical
examination claiming injury to bis
spine and partial paralysis to the
lower extremities The International
and Great Northern railroad paid him
S2000 in settlement
Tho next chapter of tho story oc-
curred at La Grange Texas in Octo-
ber 1903 when Frank Mclntyre was
injured in a similar mannor while in
tho employ of the Missouri Kansas
and Toxas railroad The railroad com-
pany allowed him 2750 in settlement
Somo time ago at Mart Texas
a man giving his uamo as Melvin
Peters was injured whilo in tho em-
ploy of tho International and Great
Northern
Dr W G Jameson of Palestine ex
amined tbo man who claimed that his
spine was injured as a result of tho fall
GETTING TIIE EVIDENCE
Dr Jameson did not notice at this
time tbo similarity between the pres
ent caso and tho one in April 1902 at
Palestine j
Peters was allowed 5WTaB5J n
afterward disappeared
Tho fact also that he was willing to
accept the small sum of 500 in con-
sideration of tho extent of his injuries
set tho International and GreatNorth
cm authorities and Dr Jameson to
thinking
Referring to tho case of Frank Mc
lntyre in April 1902 who was injured
in tho samo way a link was estab-
lished
H G McCauloy general claim agent
for the Katy at Dallas was conferred
with and another chain of evidence
was established between tho three
cases two In tho narao of Frank Mc
Intyro and tho other in tho namo of
Melvin Peters
Aftor leaving Mart Peters went to
Fort Worth where ho was arrested
and brought to Waco on a charge of
swindling Sheriff Baker haying made
tho arrest While at Fort Worth ho
made tho following sta ment
I am from Minnesota said Peters
I camo to Texas a month ago and se-
cured employment with tho Interna-
tional and Great Northern railroad as-
a brakeman Two weeks ago whilo
on top of a box car I was knockod
oir in somo manner and struck on my
back partially paralyzing mo This
occurred at a little town called Irene
midway between Italy and Waco
Sinco that time I havo beon unablo to
walk and am compelled to uso
crutches
Tho International company pro-
posed a compromiso and offered mo
500 cash If I would sign a release not
to hold tho company liable any fur-
ther I accepted the monoy believing
tho matter had been amicably settled
I havo done nothing criminal and
hopo to bo ablo to provo It
Tho company had threo physicians
to examine my injuries which they
did and pronounced mo badly hurt
The superintendent and other officials
of tho company assisted mo on tho
train at Waco last night and my wifo
and I camo on to Fort Worth You
know tho rest
Peters had an examining trial in tiiis
city August 7 and was bound over to
await tho action of tho grand jury
Tho last grand jury returned soveral
indictments against him in connection
with his work with tho railroads and
this morning when tho caso was
called Peters was brought into court
He entered a plea of guilty to tho
charge of defrauding tho railroads
and the jury after consultation as
sessed his punishmont at two years in
tho penitentiary Uo was accompanied
by Ills wifo and children and tho
sceno was rather a pathetic scono for
thorn However tho wifo scorned to
bear up better than was expoctcd
No action has been taken in tho other
oases but it is believed that thoy will
bo dismissed as Peters placed himself
at tho mercy of the court aud pleaded
for clemency
