Final Agreement on Bank Guaranty

Austin Texas May 11 The gen-
eral appropriation bill carries as fi-
nally agreed upon approximately 8
600000 This however does not in-
clude the Hill amendment thereto
The committee finally agreed on 240
000 a year for the University of Tex-
as The house bill carried an appro-
priation of 230000 and the senate
bill 260000 and a compromise was
reached on the amount indicated here-
in Another compromise is that for
the holding of state encampments
The house bill carried 10000 for the
next two years while the senate bill
carried 25000 as agreed to by the
committee the amount for encamp-
ments was fixed at 20000 or 10000
a year which Is satisfactory to Adju-
tant General Newton and will insure
encampments for the next two years
The San Jacinto battlefield amend-
ment was left intact The house bill
carried 30000 for the two yeais and
so did the senate bill and it was left
in the measure This insures a con
tinuation of the work of beautifying
the San Jacinto battlefield as the
commission will now have the sum
given above besides an unexpected
balance of 23000 in the treasury
As soonas both branches of the leg-
islature adopts the free conference
committee Teporjts on these measures
and the bills signed final adjourn-
ment will be had which is expected
to be some time this afternoon
Bank Guaranty Bill
The changes made in the bill which
had been accepted by the senate are
in a large degree merely corrective
amendments and there are innumer-
able changes of this caliber
One Important Point
Perhaps the mos important point
in the whole of the committees pro-
ceedings is that it failed to adopt the
feature of the house bill regulating
the amount of capitalization for banks
according to the population of the
towns and cities in which they are lo-
cated The house members strongly
supported this provision but failed to
obtain agreement on the part of the
senate members
There remains however in lieu of
the provision mentioned the provision
that the minimum capital stock shall
be 10000 and the provision of the
senate bill providing for the increase
ofgthe capital stock 25 per cent In

daily deposits The plan provides for
the increase to be made in case the
average deposits on October 1 of each
year are five times more than a capi-
tal stock of 10000 or less six times
10000 to 20000 seven times 20
000 to 40000 eight times 40000 to
75000 nine times 75000 to 100
000 ten times 1QO000 or over Pro-
vision was also made that it shall be
required that a bank which purchases
the assets of any other bank shall In-
crease its capital stock to such an
mounkthat same will have the ratio
to the total deposits of the bank the
assets of which it has purchased is
already defined
The provisions of the act were
changed so as to provide thatbanking
charters filed with the secretary of
state shall be turned over to the
banking board which after the bank
has been satisfactorily examined by a
state bank examiner and the board
has satisfied itself that the law has
been complied with shall turn over
the charter and the certificate pro

Depositors Guaranty Fund
The depositors guaranty fund will
be according to the senate bill which
provides for a maximum of 2000000
to be raised by assessment of one per-
cent of the average daily depositors
for the first year and subsequent an-
nual assessments of one fourth of one
per cent Whenever the fund Is Im-
paired it may be replenished by an as-
sessment not in excess of two per-
cent In any one year Regarding the
collection of this fund a compromise
was made providing that the state
treasurer shall hold twentyfive per-
cent of same and seventyfour per-
cent to be held by the guaranteed
bank as demand deposits to the credit

Provision was made that the fiscal
year as far as the tax on the average
daily is concerned shall end on No-
vember 1 of each year and October 1
1910 is fixed as the date previous to
which banks shall exercise their op-
tion as to the method of guaranty
which they will employ
It was decided to include the sec-
tions of the house bill providing ac-
cording to the national law that no
bank shall make any loan on the se
curity of its own capital stock nor be
the purchaser of any such stock un
less such security or purchase shall
be necessaiy to prevent a loss upon a
debt previously contracted in good
faith and such stock shall be sold
within six months from the date of
purchase and the section making it
unlawful for any bank to hypothecate
as collateral security for money bor-
rowed upon bills payable or certifi-
cates of deposit its securities to an
amount more than fifty per cent great
er than the amount borrowed or the
issuance of any bills secured by the
hypothecation of a banks securities
unless same contain provision allow-
ing thirty days of grace in which the
bank commissioner in event of tak-
ing charge of the bank may redeem
such securities
It is also provided that no bank
may go on the security bond of any
other bank but allowing bank and
trust companies to do so It also pro-
vides that bank and trust companies
under the guaranty fund system shall
not make bond for hanks under the
same system
With these exceptions and a few
minor alterations the measure agreed
upon remains the AlexanderTerrell
McLennan measure passed by the
senate last Thursday

becomes a religious or educational af-
fair if one of the performers wears
pink whiskers The case in question
is a test case begun against one of
the vaudeville managers of this city
to test the meaning of the law relat-
ing to Sunday performances in the-
atres The outcome of the trial Is of
considerable importance as the de-
feat of the manager means not only a
fine but also the loss of his theatre

Birthday Short Sketch of
Interesting Career

ator William Alden Smith of Michi
gan was fifty jears old today He
will have occasion to lemember the
anniversary for he was kept busy dur-
ing a good pait of the day receiving
congratulations and good wishes from
his colleagues in the senate and nu-
merous other friends in official life
Senator Smiths fifty years cover a
notable and highly creditable career
He was boin of pooi parents and his
first money was earned as a popcoin
vender While selling corn he made
a fiiend of Speaker J T Rich of the
Michigan house of representatives
and Rich appointed young Smith a
page in 1S79 He saved his money
studied law and while still young
man became general counsel for the
Chicago West Michigan railroad
Later he built several small lailroads
in the Michigan timber belt and
realized a fortune by selling them to
the Pere Marquette He was elected
to congress fiom the Fifth Michigan
district in 1894 and two jears ago he
succeeded Russell A Alger in the sen-
ate
The Michigan senator is one of
three representatives that the great
family of Smith now has in the upper
branch of congiess The other two
are John Walter Smith of Maryland
and Ellison Dmant Smith the new
senator from South Carolina
