LAST ACT OF WATERS PERCE
In Texas A Little Drama Which Was
Very Touching For a While
Austin Texas Sept 2C The set-
ting of the date of sale at public out-
cry of the Texas property of the
Waters Pierce Oil company is per-
haps the next to the last step in the
concluding stage of this celebiated
case The sale will he held on Decem-
ber 7 and will be conducted by Robt
J Eckhardt receiver When the
court approves the tonus of the sale
and the deal is closed the Waters
Pierce Oil company will In reality re
tire from the state In conformity to
the decree of oustei by tho trial couit
and sustained by the supreme court
of the United States
Abide from the magnitude of the
case Involving as it does millions of
dollars and aside from the excellence
of piospcutlon anil defense from a
legal standpoint this case furnishes
one of the best examples of downright
stubbornness of fighting and tenacity
of contest in the judicial annals of
Texas It is exact to say that every
inch of the states advance was con-
tested peisistently and stubbornly
and that if the slightest slipping of a
cog in the prosecutions machinery
had occurred or the most trivial
thing for which it was unprepared
had happened the snecess of the state
would not have been gloiified by an
uninterrupted succession of victories
The states motion to sell the prop-
erty thiough the receiveship afford-
ed the last subject of contest The
company had paid the enormous fine
of 1800000 taxed against it for vio-
lations of the antitrust law and it
was ready to comply with the deciee
of ouster and made this argument to
the attorneys for the state The
states attorneys however stood pat
in the position that a judicial sale
should be had in older to reserve to
the state the full force and effect of
the ouster deciee The conference
lasted a day and at its expiration the
state had again triumphed No ob
jection to the motion was made and
an oider was entered accordingly
This is particularly notable when it is
remarked that the determining ques
tion was indeed close and without
precedent
