“Open Meetings”Law
Passed by State Legislature
Texas has a new “Open
Matings Law.”
This law, designed to protect
the people from secret and closed
meetings by goverment bodies,
goes into effect next January 1.
The new law (an expanded
version of one already in ex-
istence) was overwhelmingly ap-
proved by the recently adjourned
State Legislature.
The new law defines
“meetings” as any “deliberation
between a quorum of members of
a governmental body has supervi-
sion or control is discussed or
considered, or at which any for-
mal action is taken.”
According to the law, all city
councils, commissioners’ courts,
school boards, water districts and
all political sub-divisions are
affected. '
Fines of up to $500 or imprison-
ment in the county jail “for not
less than one month nor more
than six months’’ or both
penalties are provided to
violators upon conviction.
Although specific exceptions
permit governmental bodies to
hold a closed meeting, the new
state law — unlike the old —
requires that ALL meetings be
publicly announced.
The new law read, “Except as
otherwise provided in this Act or
specifically permitted in the Con-
situation,every regular, special, or
called meeting or session of every
governmental body shall be open
to the public; and no closed or
executive meetings or sessions of
any governmental body for any of
the purposes of which closed or
executive sessions are hereinafter
authorized shall be held unless
the governmental body has first
been convened in open meeting
or session for which notice has
been given as hereinafter provided
and during which open meeting
or session the presiding officer
has publicly announced that a
closed1 of executive meeting or
session will be held and identified
the section or sections under this
Act authorizing the holding of
such closed or executive session.”
Provisions are made under the
new law for emergency meetings
requiring only two hours notice.

Caraway, 74, retired lineman
for Western Union who died
Wednesday at a Sherman nurs-
ing home, were held Friday
at Flesher Funeral Home Cha-
pel, conducted by Rev. Wil-
liam Murley, Baptist minister.
Burial was in Van Alstyne
Cemetery.
Caraway was born in Texas.
He was a member of the First
Baptist Church in Van Alstyne.
He married Pearl Strickland
July 30, 1918 at Van Alstyne.
Surviving are his wife, of
Van Alstyne; two daughters,
Mrs. Betty Trammell of Abi-
lene and Mrs. Glyn Haworth
of Dallas; one son, John G.*
Caraway of Denver, Colo.,
six grandchildren and two
great-grandchildren; one sister
Mrs. Erskine Bearden of Howe;
one brother, Ebb Caraway of
Carthage, N. Y.

which they are located or re-
lated solely to activities con-
ducted on the property are
exempted by the act along
with underground utility mark-
ers, signs erected for official
purposes by Federal, State and
Local governmental agencies
and, in some cases, those
posted by churches, and non-
profit service organizations.
Although approximately 15,
000 permits have been approv-
ed it is estimated that thou-
sands of signs remain in viola-
tion of the act.
Permits should be requested

Injured Motorist
Discovered
A Sherman man, who appa-
rently lay in a. ditch north of
here for several hours after he
was injured in a car accident,
was reported in satisfactory
condition at Sherman Com-
munity Hospital.
Injured was Paul Wheeler of
1612 S. Elm. He -sustained a
head injury, according to a
hospital spokesman.
Wheeler was found lying in
a ditch about 6:20 a.m. Mon-
day just south of the Depart-
ment of Public Safety com-
munications office, according
to a Department of Public
Safety dispatcher.
She rman ambulance atten-
dants said Wheeler was semi-
conscious but told them he hac
been injured about 1 or 2 a.m.
The dispatcher siad Wheeler
apparently had been north-
bound in his vehicle on High-
way 75 when the accident
occurred. He said Wheeler,
in a dazed condition, appar-
ently had wandered across
Highway 75 and fallen into a
ditch along the west access
road.
A passerby apparently not-
iced him about 6:20 a.m. and
summoned help.
