IN THE COMMISSIONERS COURT OF GRAYSON COUN-
TY, TEXAS
PETITION TO CANCEL SUBDIVISION
To TOE HONORABLE COMMISSIONERS COURT:
Now comes Loy Dl Bennett, and Euleta Bennett, who
are the owners of all the lots and the park area contained
in the addition known as Meadows Addition, Grayson County
Texas, as shown by plat thereof, recorded in Vol. 4, page
20, Plat Records of Grayson County, Texas, and would re-
spectfully show the Court that none of the roads contained
in said Subdivision have ever been opened, nor is there any
intention on the part of the owners of said subdivision to
ever open same in the future, and the owners of such sub-
division hereby “request the Commissioners Court to cancel
said subdivision or addition in accordance with the proced-
ures set forth in Article 7227, Vernon Annotated Texas Sta-
tutes.

Annotated Texas Statutes, notice is hereby given to the pub-
lic that the within and foregoing application for cancellation
of a subdivision known as Meadows Addition, Grayson Coun-
ty, Texas, as per plat thereof recorded in Vol. 4, page 20,
Plat Records of Grayson County, Texas, will be considered
by the Commissioners Court of Grayson County, Texas, at
its regular meeting on the 9th day of August, 1971, in the
Commissioners Courtroom, Courthouse, Sherman, Grayson
County, Texas, said meeting to begin at 10:00 o’clock, A.M.
Any person who is interested in such lands is commanded
to appear at such meeting at the date, time and place spec-
ified, to protest, if desired, the request made for cancella-
tion of subdivision known as the Meadows Addition
In accordance with provisions of Article 7227, Vernon’s
Annotated Texas Statutes, both the within and foregoing ap-
plication and this order commanding any interested person®
to appear in objection to such application, shall be published1
in the English language in a newspaper in Grayson County,
Texas, for at least three weeks prior to the action therein
by said Court.

TEXAS: GREETING:
WHEREAS, on the 1st day ot June, A.D. 1971, in the 59th District Court,
Grayson County, Texas, in Cause No. 75,565, The City of Sherman, et al vs.
Mrs. John E. Webster, et al the following named Plaintiffs, and Interveners,
to-wit:
The City of Sherman and Sherman Independent School District are Plain-
tiffs and State of Texas and County of Grayson are Intervenors; recovered a
judgement against the following Defendants, to-wit:
Mrs. Lillian D. Stillwell Webster, individually and as community survivor
of John Webater, Deceased; John M. Webster; Jane Webster Winner-man and
James Gilmore Webster; whose attys are R. C. Slagle, m and Robert Bush,
for taxes, penalty, interest and court costs for the years hereinafter shown upon
the following property:
FIRST TRACT:
Lot 14, Block 5, Fisher Fair-mount Addition to Sherman, Grayson County,
Texas;
The respective amount of the taxes, penalty, and interest recovered by each
of said parties with interest thereon from the date of said judgment, against
each of said tracts and the respective amount of court costs recovered by each
erf said parties against each of said tracts is as follows :
City of Sherman and Sherman Independent School District, taxing units, 1953
through 1970, 13,298.47, taxes, penalty and interest.
State of Texas and County of Grayson, taxing units, 1953 through 1970,
$1,117.45, taxes penalty and interest Total all taxing units, $4,515.92
AM), WHEREAS, said judgment directs the foreclosure of the liens created,

me levying and assessment or taxes on and against the same ana the delin-
quency thereof, and said taxes remaining unpaid and due to the parties named
in this suit as said liens now existing and at any time heretofore existing by
reason of such levying, assessment, and delinquency, for and on the dates and
tor the years above shown, ail of which is of record and fully shown by said
judgment on file in said cause,
NOW, THEREFORE, YOU ARE HEREBY COMMANDED to seize, levy
upon and advertise die sale as under execution each of said above described
tract or tractB and sell each of same to the highest bidder for cash for each
as under execution, provided, however, that none of said tracts shall be sold
to the owner of said tract direcUy or indirectly or to anyone having an interest
therein or to any party other than a taxing unit which is a party to this suit
fix- less than the amount of the adjudged value of said tract or the aggregate
amount of the judgments against said tract in said cause, whichever is lower;
the said adjudged value or reasonable fair value of each of said tracts as set
by this Court in accordance with the provisions of law is as follows:
First Tract, $4,515.92.
If the Defendants or their Attorneys shall at any time before the sale file
with the Sheriff, or other officer in whose hands this Order of Sale shall be
placed, a written request that the property described therein shall be divided
and sold in less tracts than the whole, together with a description of said sub-
divisions, then such officer shall sell the land in such subdivisions as the De-
fendants may request, and in such case shall only sell as many subdivision
as near as may be to satisfy this judgment, interest and costs; and it is further
ordered by the Court that the net proceeds of any sale of such property made
hereunder to any party other than a taxing unit who is a party to this suit
shall belong to and be distributed to all such taxing units which have been found
to have tax liens against such property, pro rata and in proportion to the
amounts of their respective tax liens as hereinbefore established, but any ex-
cess in the proceeds of sale over and above the amount necessary to pay the
taxes due, defray the costs of suit and sale and other expenses chargeable
against said property, shall be paid to the Clerk of this Court and retained and
disposed of by said Oerk in accordance with the terms and provisions of Arti-
cle 7345b, Section 8.
And it is further Ordered, Adjudged, and Decreed that the owner of such
nrooertv. or anyone having an Interest therein, or their heirs, assigns, or legal
representatives, may, wimin two (2) years from the date of the filing for record
of the purchaser’s deed and not thereafter, have the right to redeem said pro-
perty as provided for by law.
The officer executing this Order of Sale shall make proper conveyance to
the purchaser of said land, under and by virtue of said sale, upon compliance
with the terms of said sale within the time and in the manner provided for by
law, and shall execute this writ according to its terms and the requirements
of law.
HEREIN FAIL NOT, under penalty of law, and due return make of this
writ, within 90 days from date hereof, with your endorsement thereon, showing
how you have executed the same.

THE STATE OF TEXAS — COUNTY OF GRAYSON— SHERIFF’S SALE
WHEREAS, on the 1st day of June, 1971, in Cause No. 75,565 in the District
Court of Grayson County, Texas, wherein The City of Sherman and Sherman
Independent School District were Plaintiffs, State of Texas and County of Gray-
son are Intervenors, recovered judgment against Mrs. Lillian D. Stillwell Web-
ster, individually and as community survivor of John Webster, Deceased; John
M. Webster; Jane Webster Winner-man and James Giilmore Webster, whose
attorneys are R. C. Slagle, in and Robert G. Bush, both of Sherman, Grayson
County, Texas; Defendants, for taxes, penalty, interest and cost against the
hereinafter described property;
WHEREAS, on the 22nd day of June, 1971, by virtue of said judgment and
the mandates thereof the Oerk of the above mentioned District Court of said
county did cause to be issued an Order of Sale commanding me as Sheriff of
said county to seize, levy upon, and sell in the manner and form as required
by law the hereinafter described property;
WHEREAS by virtue of said judgment and said Order of Sale and the man-
dates thereof I did on the 22nd day of June, 1971, seize and levy upon as the
property of the above defendants the following described property, situated in
Grayson County, Texas, to-wit:
(Said description showing the number of acres, original survey, locality in
county, and name by which said property is most generally known.)
FIRST TRACT:
Lot 14, Block 5, Fisher Fairmount Addition to Sherman, Grayson County,
Texas;
And I will on the first Tuesday in the month of August, 1971, the same
being the 3rd day of said month, proceed to sett all the right, title, and interest
of the Defendants in and to said property at the Court House door of said county
in the city or town of Sherman, Texas between the hours of 10:00 a.m. and 4:00
p.m. to the highest bidder for cash, provided, however, that none of said pro-
perty shall be sold to the owner of said property directly or indirectly or to
anyone having an interest therein or to any party other than a taxing unit which
is a party to this suit tor less than the amount of the adjudged value of said
property or the aggregate amount of judgments against said property in said
suit, which ever is lower, subject also to the right of the Defendants to redeem
same in the time and manner provided by law and subject also to the right of
the Defendants .to have said property divided and sold in less divisions than
the whole.
