••Gentlemen:
“This is to inform you that on
August 29, 191 A, 1 was standing on
a sidewalk in the city of Sherman,
in conversation with a friend and
while in that position one Andrew
Burris, a policeman in the employ
of the said City of Sherman, with
gross negligence and Without cause,
discharged a pistol, which is a
deadly weapon, and the bullet dis-
charged from said pistol struck me
mouth and entered into the
back of my throat and lodged into
the back of my neck and caused tne
serious physical pain and much men-
tal suffering and almost- caused
the loss cf my life, f have suffered
at all times since the happening of
said incident, and my health has
been greatly impaired so that at
this time I am an invalid and un-
able to perform any duties what-
ever. I have been put to great
expense for the services of physic-
ians and for hospital fees and drug
bills,which will amount approxi-
mately to f500.
Before I was wounded, as above
set out, 1 was earning from my pro-
fession about *1,000 per annum.
