PRESENTED BY THE
STATE BAR OF TEXAS
Q: I want to sell my house,
but I don’t have a copy of the
deed to my lot. What should
Ido?
A: The County Clerk’s
Office is the place where
permanent records of land
transactions are kept. Any
real estate transaction
should be recorded in the re
cords of the County Clerk
for the county in which the
land is located. Go to the
Clerk’s office, tell them the
date the property was
bought and sold, and from
whom you bought the prop
erty. They should be able to
find a copy of your deed with
this information.
Q: Up to a few months ago
I was living with a woman in
Oklahoma. We split up, and
now I’ve moved back to Tex-
as to live with another wo-
man. My former girlfriend
now has filed a civil suit
against me in Oklahoma. If
she wins, can she come to
Texas and collect?
A: Yes. If she obtains a
valid judgement in Oklaho
ma, she can come into Texas
and attempt to collect or re
move the property in ques
tion. Whether or not the
attempt is successful will de
pend largely on what prop
erties are owned.
Q: My son lost his job last
fall and was unable to pay on
his account with a large de-
partment store. Now that he
is working, he has paid the
account in full. But, he can’t
get credit again. They say
he has to wait seven years.
Is that true? Isn't there any-
thing he can do to regain a
good credit rating?
A: When extending ere
dit, stores check with a ere
dit reporting service to learn
the applicant’s credit histo-
ry. The service can legally
keep information for seven
years, but after that, it must
be destroyed. However,
your son may be able to re-
gain credit. Most stores try
to learn the reasons for the
past nonpayment. If there
was a good reason, such as
the loss of a job, most stores
will try to examine his cur-
rent circumstances and ex-
tend a small line of credit.
He should seek a conference
to explain, and if he obtains
credit, pay on time.
Q: I was recently involved
in a collision. The other car
was totalled, and the driver
got a ticket for driving with-
out a license which was later
dismiss'd. f didn’t get a
ticket, but m> car was dam-
aged to the tune of $800. We
don’t have any insurance.
Can the other driver make
us bus him another car of
equal value?
\: If the other driver files
suit, a jury will decide
whether one or both of you
were at fault under our sys-
tem of comparative negli-
gence. This means that if the
jury found that both were
equally at fault, you would
have to pay 50 percent of the
other driver’s damages. On
the other hand, if the jury
found the other driver more
at fault than you. you would
owe nothing. But. if you
were more at fault, you'll
end up paying for your dam-
ages, plus a percentage of
the other driver's damages
as determined by the jury.
