An off-duty Brownwood patrol
officer was arrested Wednesday
night on a DWI charge following
a traffic stop by a Department of
Public Safety trooper in Brown-
wood.
Patrolman Danny Hutchins,
40, of Bangs, spent the night in
the Brown County Jail and was
released Thursday morning on
$2,500
bond,

October 2001, will be placed on
paid leave pending the outcome
of the case and an internal inves-
tigation.
The charge is a Class B misde-
meanor. State standards on law
enforcement state that an officer
convicted of any charge higher
than a Class C misdemeanor can-
not have a peace officer license
for 10 years, Corley said.
A deferred adjudication pro-
bation, while not a conviction,
would be treated as a conviction
by state standards, Corley said.
Independent of the criminal
case, the department will also
begin an internal investigation,
Corley said.
“The mission here is not to fire
Danny Hutchins,” Corley said.
“The mission is to investigate
the allegation and be fair during

Ark fundraiser
draws near

Time is running out to
purchase tickets for the
20th Annual Mystery Din-
ner Theater and Dance,
the Ark’s key fundraiser
of the year.
This year, the theme
surrounds the 1940s and,
for the first time, organiz-
ers have added a swing
orchestra to the entertain-
ment lineup.
The Bill Smallwood
Band, from Fredericks-
burg, will have 10 pieces,
including three saxo-
phones, two trumpets,
a rhythm section and a
vocalist.
“It’s a condensed ver-
sion of our 18-piece swing
band,” said Bill Small-
wood.
The set list will include
the classics “In the Mood,”
“Moonlight Serenade,” “At
Last,” and “Summertime.”
Smallwood described
the set as “a lot of Glenn
Miller-type stuff.”
Fitting, since Miller was
the best selling recording
artist in the U.S., between
1939 and 1943, prior to
the disappearance of his
flight over the English
Channel during WWII,
while serving in the Army
Air Corps.
Smallwood leads several
bands, having previously
toured around the coun-
try. He now limits his
appearances within Texas
and all of the band’s
players are from the hill
country. Along with his
wife Sandie on piano, they
began touring in 1968.
Another 1940s gen-
eration attraction has
also been added to the
evening’s entertainment.
In 1940, roller derby drew
millions of spectators
their events and guests
of the Ark event will see
a demonstration by the
Cowboy Capital Roller-
girls.
There will be a prize for
the best 1940s costume
and live and silent auc-
tions throughout the
evening. Of course, the
traditional theatrical mys-
tery remains the highlight
of the event.
“Larry Mathis has done
an excellent job writing a
script for the theme,” said
Mary Silver, program and
volunteer coordinator for
the Ark.
Tickets and sponsor-
ships are still available,
although the event is
attracting guests from all
over central Texas.

Bien trial enters
third day

Testimony contin-
ued Thursday in 35 th
District Court in the at-
tempted capital murder
trial of Michael Bien,
who is accused of trying
to hire a hit man to kill
his ex-brother-in-law.
Jurors heard testimony
from Texas Ranger Dan-
ny Briley and recordings
of phone conversations
between Bien and Bien’s
longtime friend Mickey
Westerman. The pros-
ecution alleges that Bien
sought out Westerman
to put him in touch with
a hit man to kill his ex-
wife’s parents and later
her brother. Westerman
ended up working with
the Rangers as a confi-
dential informant.
District Attorney Mi-
chael Murray told jurors
in his opening argument
that Bien had wanted to
cause his ex-wife to suf-
fer after their marriage
ended.
Defense attorney Jason
Johnson told jurors that
Bien has fallen prey to
entrapment. Johnson
sought to establish
through his cross-ex-
amination of Briley that
the recordings of phone
conversations showed
that Westerman had
goaded Bien down a path
of pursuing a murder for
hire scheme.
