TRIAL
CONTINUED FROM 1
scene to look like a home
invasion.
Randall Philen was
convicted of his brother’s
murder and sentenced to
life in prison, and was freed
after police said there was
new evidence that Rocha,
Alex Gil, Efrain Castillo III
and Matthew Navarro went
to the Philen brother’s home
to rob Ronald Philen of
marijuana. Philen was shot
five times.
Gil and Castillo gave state-
ments implicating them-
selves as well as Rocha and
Navarro, and testified last
week that the four had gone
to the Philen brothers’ home
to commit the robbery. The
two pleaded guilty ear-
lier this year to murder, in
exchange for 40-year prison
terms. Navarro has a Jan. 27
trial date.
Through the questioning
of now-retired Brownwood
police detective Robert
Mullins, Steele focused on
details of the crime scene
that quickly led to the devel-
opment of Randall Philen as

a suspect.
Steele questioned Mullins
extensively about a panel
that was kicked out of the
locked door that led to Ron-
ald Philen’s bedroom. Police
entered the home to find
the panel leaning on a wall
near the bedroom. Paint and
wood chips were on top of
blood stains on the panel
rather than being soaked in
blood, and police believed
that was an indication the
panel had been kicked after
Ronald Philen was shot.
Steele focused on other
crime scene evidence that
indicated — as police and
prosecutors initially be-
lieved — that Randall Philen
had given inconsistent
statements to investigators,
including a small table in
Ronald Philen’s bedroom
that contained his collec-
tion of arrowheads. The
table and arrowheads were
undisturbed despite, as
Randall Philen had asserted,
a struggle that occurred be-
tween Ronald Philen and the
assailants on an unstable,
rickety floor.
Steele asked Mullins if
people sometimes falsely
confess to crimes, and Mul-
lins said that has happened.

Attorney Sam Moss indi-
cated through his cross-
examination of defense
witnesses including Mullins
that the prosecution does
not believe Randall Philen
had anything to do with this
brother’s murder.
Testimony in Moss’s
cross-examination indicated
that police initially found
unidentified fingerprints
on the door panel. After
Randall Philen’s trial, police
learned the names of Rocha,
Gil, Castillo and Navarro,
and learned that the finger-
prints on the door belonged
to Rocha and Gil, according
to testimony.
The identities of the
fingerprints and the confes-
sions of Gil and Castillo
were new evidence that
caused investigators and
prosecutors to look at
crime scene evidence in a
new way, Moss indicated
through is cross-examina-
tion.
“You weren’t alone in
this,” Moss told Mullins.
“Back then we went with
circumstantial evidence. All
of us looking at it, it was
circumstantial evidence.
The new, direct evidence ‘is
much more powerful than
circumstantial evidence.’”
