Cagle testimony continues

death on Oct 10, Cagle had
repeatedly slapped the baby, had
doubled up his fist and punched
her in the stomach, and that he
had dunked her head up and
down in the bathtub.
During cross-examination by
McClure on Thursday, Cagle
stated that on Oct. 10, he had
slapped the baby on the face
twice and on her stomach once,
both times with his open left
hand, not with a fist.
Cagle claimed that while he
was tiying to give Rebecca some
Tylenol, she kept spitting it out
and trying to bat it away. He said
he attempted to slap Rebecca’s
hand, but missed and ended up
hitting the baby’s stomach.
Responding to cross-examination
by Boulware, Cagle said he
thought that the baby’s death was
caused by a fall against the cof-
fee table in his living room.
Boulware asked Cagle whether
he had tried to mislead law en-
forcement officials by inten-
tionally ommitting certain inform
mation about the prior slaps and
mistreatment of the child on one
of his voluntary statements.
CAGLE REPLIED that he was
not trying to mislead anyone. He
further stated that although the
handwriting on the statements
was his, that the words were not.
Hagle claimed that Texas Ranger
George Turner told him what to
write on the statements.
Boulware responded, 'Tester-
day (Wednesday) didn’t you say
that what you wrote (on the
Highway Patrol investigates
rural traffic accidents
The Texas Highway Patrol in-
vestigated 59 rural traffic ac-
cidents in Johnson County
during December, 1986 accord-
ing to Sgt. Wynne, supervisor for
this Highway Patrol Sergeant
Area. These accidents resulted in
4 deaths and 34 injuries.
The total rural traffic accidents
for Johnson County for this year
is 669, which resulted in 18
deaths and 461 injuries.
The 22 counties which com-
prise Highway Patrol District 6A
have had a total of 6,774 rural
traffic accidents this year, which
have resulted in 206 deaths and
4,500 injuries. This compares to
6800 accidents; 224 deaths; and
4308 injuries reported during
this same period last year.

Boulware then asked 'Tester-
day (Wednesday) in response to
the question from your attorney
‘Did Ranger Timer tell you what
to say?’ you said ‘No sir.” Cagle
replied that he had said "No.”
However, Cagle then stated,
"Every word on there, he
(Ranger Timer) told me how
to write.”
In response to additional ques-
tioning from Boulware, Cagle
agreed that when Rebecca came
to his home on Oct. 1, 1986, she
had no known injury and that
every injury that happened to the
baby took place in his home.
However, Cagle said he was
not positive that no one other
than himself and Ann had had
access to the baby. In response
to further questioning bv Mahanav.
Cagle said that a dozen to 15
people including medical and
law enforcement personnel had
access to the baby on the night of
Oct. 10.
ON THURSDAY morning,'
Mahanay presented four letters
to the court as evidence. The let-
ters were written from Hagle to
Cagle since the two have been
incarcerated.
Hagle’s attorney, McClure, ob-
jected to the evidence. The objec-
tion was overruled with one
exception (a small portion of one
letter was deleted). The letters
were entered as defendant's ex-
hibits I, II, III, and IV.
Mahanay told the court that
his purpose in submitting the let-
ters as evidence is to show that it
is “contrary to the nature of a
mother to write a letter of this
kind to someone who had
harmed or killed her child.”
The letters contained several
expressions of Hagle’s love for
Cagle and willingness to marry
him.
The trial continued at 9 a m on
Friday and is expected to extend
through Monday.
