notated Revised Civil Statutes of the

COMMITTEE; MODIFYING THE
COMMITTEES FUNCTIONS; PRO-
VIDING FOR A SEVERABILITY
CLAUSE; A REPEALER CLAUSE; A
PENALTY CLAUSE AND AN EFFEC-
TIVE DATE CLAUSE.
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF BURLE-
SON, TEXAS:
SECTION I.
The Code of Ordinances, Appendix
B (Ordinance B-464, Subdivision
Regulations), is hereby amended, as
follows:
"SECTION 4. Definitions.
!0. Development Assistance Com-
mittee. A committee of key staff mem-
bers to provide a centralized, techni-
cal review of development plans.
SECTION 5. Development Assis-
tance Committee.
A development assistance commit-
tee is hereby established to be com-
posed of the city planner, city engi-
neer, city secretary, public marshal
and other department directors as
required. The city planner shall chair
the Development Assistance Commit-
tee and be responsible for coordinat-
ing and establishing committee proce-
dures. The committee's general pur-
pose is to assist developers and appli-
cants through the development pro-
cess in the most efficient manner pos-
sible. The committee's more specific
purposes are to: (1) provide technical
review, (2) ensure compliance with
development codes and ordinances.
The committee's review comments will
be consolidated by the city planner
who will forward the comments in
writing to the applicants. The city plan-
ner will then report to the Planning and
Zoning Commission and City Council
of the status of the application or case
at the time of the commission meetings
or council sessions."
SECTION IV
Any person, firm, association of per-
sons, company, corporation, or theft
agents, servants, or employees violat-
ing orfailing to comply with any of the
provisions of this ordinance shall be
fined, upon conviction, not less than
one dollar ($ 1.00) nor more than two
thousand dollars ($2,000.00), and
each day any violation or non-compli-
ance continues shall constitute a sepa-
rate and distinct offense. The penalty
provided herein shall be cumulative of
other remedies provided by state law,
and the power of injunction as pro-
vided in V.T.C.A. Local Government
Code 54.012 and as may be
amended, may be exercised in enforc-
ing this ordinance whether or not there
has been a complaint filed.

CLAUSE; AND AN EFFECTIVE DATE
CLAUSE.
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF BURLE-
SON, TEXAS:
SECTION I
The code of ordinances is hereby
amended in Chapter 1 1, Article 1,
Section 11-1 to provide new provi-
sions and change existing provisions
as follows:
"Sec. 1 1-1. Garage sales.
(a) Definition: The term "garage sale"
shall be defined as one or t&o (2)
sales of tangible personal property at
retail not exceeding three (3) con-
secutive day* in length for each sale
during a twelve (12) month period,
from January first through December
thirty-first, carried on at a home or
residence by a person who does not
hold such person's self out as engag-
ing in or who does not habitually
engage in the business of selling such
tangible personal property at retail
and who does not carry on such sale
in such a manner as to create a
disturbance or become a nuisance to
the neighborhood, and only so long
as such person is selling only personal
property that belongs to such person
personally and has not been pur-
chased for purpose of resale.
(b) Signs: Not more than two (2)
signs shall be posted on any residen-
tial property advertising such sales,
and no such sign shall exceed a size
of two hundred eighty-eight (288)
square inches. No signs shall be posted
at any point other t)jan on said resi-
dential property except as noted by
the following: Two off premise direc-
tional signs may be posted if permis-
sion for the locotion of said signs has
been obtained from the property own-
ers where signs are to be located.
(c) Permit: Each individual desiring
to hold or have a garage sale shall
apply for and receive a permit from
the city; the fee paid therefor shall be
the fee as approved by the cit£ dbun-

(d) Yard signs as defined in this
article shall be removed by the owner
of such sign no later than sevenly-lwo
(72) hours following the completion
ol the event or activity advertised by

83).
SECTION IV.

able, there shall always be one more
master electrician than journeyman
electrician on the electrical board; or
(2) One (1) building contractor may
be appointed in place of one licensed
electrician.
The building official or his designee
shall act as secretary of the board, but
shall not have voting privileges.
(b) Plumbing board: The plumbing
board shall consist or five (5) mem-
bers meeting the following qualifica-
tions:
(1) Two (2) or three (3) master
plumbers when available;
(2) One (1) or two (2) journeyman
plumbers when available; or
(3) One (1) building contractor may
be appointed in place of one (1)
licensed plumber.
The building official or his designee
shall act as secretary of the board, but
