AMENDED PUBLIC NOTICE
On March 6. 1998. United Telephone Company of Texas. Inc. dha Sprint
(Sprint) filed a Petition with the Public Utility Commission of Texas
(PUC) to charge an additional $3.19 per month per customer line to
recover costs for providing Expanded Local Calling service (ELC)
to certain Texas customers. This fee was to be paid only by those
customers who were not paying the monthly $3.50 residential fee or the
$7.00 business fee. In May 1998, the PUC determined a fee could be
applied to all customers in the slate, including those residential
customers who currently pay the $3.50 per month and business
customers who currently pay the $7.00 per month ELC fee. Because of
this ruling, Sprint re-evaluated and determined that all of its customers
needed to receive notice of this request to increase the monthly amount
to be surcharged and that the amount requested in the earlier notice is no
longer accurate. ^
The amount of the increase in the surcharge could be as tygh as $2.22
per month for residential customers and as high as $4.45 per month for
business customers. ^
The request for an increase in the monthly surcharge was filed pursuant
to PUC Substantive Rule 23.49 (c)( 12), which implements Senate Bill
632 passed during the 73rd Legislature. Sprint has requested that an
increase in the monthly surcharge be implemented on an interim basis
subject to being refunded if the Commission decides that either no
increase is appropriate or that a smaller increase should be levied. The
State Office of Administrative Hearings in Austin has scheduled a
hearing on the merits on Sprint’s request for an increase of the surcharge.
The hearing is currently scheduled for October 27, 1998, but could be
changed for good cause.
ELC was created in 1993 by Texas legislation requiring telephone
companies to provide toll-free calling between small towns that share a
community of interest such as a school or a hospital district. The
legislation also allowed telephone companies to recover costs of providing
ELC service by collecting a surcharge from all customers in the state.
Sprint estimates the additional monthly per line surcharge will recover
the $2, i 91,354.44 in lost revenues and reimburse the company for the
increased cost of providing ELC services between March 6, 1996, and
December 9, 1997.
