The Litter Letter
By Harold L. Carr
Rains County Environmental Enforcement
Officer and On-Site Sewage Systems Inspector
In spite of the recent rain we
were blessed with, there is still
great danger from fire. Tall
dried-out vegetation is plentiful
throughout the county. A stiff
wind can carry a fire through this
vegetation at a rate that defies
imagination. The generous accu-
mulation of leaves on the ground
is also a danger, perhaps not as
volatile as the standing vegeta-
tion, but a danger nevertheless.
TEN-ACRE EXEMPTION!! 1
wish to address this often-misun-
derstood and misquoted rule.
The “ten-acre exemption” re-
garding septic systems exempts
the individual from the require-
ment to purchase a permit only.
The installed system must meet
all state of Texas requirements as
set forth in Health and Safety
Code 366 as well as Texas
Administrative Code 285. This
includes soil requirements,
design requirements, installation
requirements and operational
requirements. If at this point you
are thinking “huh,” I will elabo-
rate.
The property must meet these
qualifiers: One system for a sin-
gle residence on a single tract of
land 10 acres or greater. If an
acre or so is replatted for mort-
gage purposes (home site), the
property does not qualify. If the
property is being offered for sale
or lease, it does not qualify. No
part of the system may lay closer
than 100 feet to the property line.
The system must not affect any
surface or subsurface waters. The
system must not affect neighbor-
ing properties.
If you have any doubts or
questions contact the county des-
ignated representative (me), for
further information or clarifica-
tion. I can be reached at 903-
473-5000 ext. 201, e-mailed at
rains.co.litter@verizon.net, or
seen in the office at 201 Doris
Briggs Pkwy.
