USD files tax suits
LIVINGSTON * The first of what
attorneys promise will be several
hundred delinquent tax lawsuits
were filed In district court Wednes-
day on behalf of die Livingston In-
dependent School District.
Other delinquent taxpayers were
mailed demand letters.
David Randell of the law firm of
Randell and Reeves, hired by the
school district to collect some
MM,000 in back taxes owed the
LISD, said Wednesday a crackdown
on delinquent tax collections has
definitely begun.
Lawsuits against five delinquent
taxpayers were filed last week and
Randell said he plans to file an
average of 80-60 cases each month.
“We’re going to go after the
habitual delinquent taxpayers in-
itially," he said. A delinquent tax
lawsuit forecloses the lien on proper-
ty and the property can be sold at
auction to collect the money owed,
although a taxpayer can pay the
back taxes before the property is ac-
tually sold.
The law firm will work with pro-
perty owners who simply do not
have the money to pay school taxes
by arranging a payout schedule,
although penalty and interest still
accrue. Randell said his firm also
collects deliquent taxes for the New
Caney ISD and was able to collect
$15,000 in partial payments in a one-
month period for that district.

quent for a long period of time or
owe large sums of money may not be
handled through the delinquent tax

lawsuit process but may instead be
subject to "summary seizure,” ac-
cording to the attorney.
“With summary seizure we go to
the judge for a tax warrant,”
Randell said. "The warrant
demands the sheriff or constable to
seize as much personal property as
necessary to pay the taxes. It’s an
ex-parte remedy. They don’t get
served i^ith due process. They don’t
know it’s coming until they see the
sheriff.”
Summary seizure, he said, will on-
ly be used in “hard core” cases.
Most of those who received de-
mand letters from the district could
have saved money had they mailed
their taxes in time to be postmarked
by Nov. 30. Others have been given
until Dec. 10 before additional
penalties will be added.
Widening
slated for
S. Houston
LIVINGSTON -' Some long-
awaited improvements to South
Houston Street in Livingston will be
getting under way soon.
At its November meeting, the
State Highway and Public Transpor-
tation Commission awarded a
$3,077,603.05 contract to the low bid-
ders, F.R. Lewis Construction Co.,
Inc. and 4-J Construction Co., Inc. of
Nacogdoches, to add two lanes to the
existing two lanes of South Houston
(Texas 146) from US 190
southeastward to FM Road 1988, a
distance of approximately 4.4 miles.
John D. Galloway of Livingston is
the department engineer In charge
of supervising the work, which will
require about a year-and-a-half to
complete.
The present two lanes are not ade-
quate to handle the growing volumes
of traffic which use the roadway, ac-
cording to Galloway.
The Livingston project, like many
other improvements to the highway
network in Texas, has been speeded
up by additional money made
available to the highway program
by the Legislature in a special ses-
sion in the summer of 1984.
After several years of inadequate
financing, the highway system fell
behind the traditional high stan-
dards of safety and convenience, he
