COLLEGE STATEION - With the end of sum-
mer, many Texans turn their thoughts to the upcom-
ing deer hunting season. A successful hunt, however,
begins with a well written lease!
Hunting leases may last an entire season or for a
few weeks or days. They may be oral, but this option
is not recommended, says Judon Fambrough, an at-
torney and senior lecturer with the Real Estate Center
at Texas A&M University.
"A hunting lease not only grants the hunter permis-
sion to enter a landowner’s property, it sets the terms
and conditions of entry and use," he says. "Thus, the
lease agreement should be written, read and signed
by all parties to avoid potential disputes.”
While induvidual lease terms may vary, key issues
should be addressed in all leases. Important provi-
sions include types of weapons allowed, access to the
land and lease price.
"Because landowner liability in Texas depends on
the amount charged for entry, landowners may want
to use a signed waiver fromthe hunter releasing the
landowner from liability," says Fambrough. "Hunters
must realize, however, what rights are being given up
and must grant the waiver willingly and intentional-
ly."
