An affair occured on the 2 1st Saturday
which resulted in an open armed demonstra-
tion by the Insurgent upon the volunteer
companies mustered into service under your
orders Between the hours or 2 and 3 o clock
or the day it seems that a man named Hop-
kins with an armed party acting under the
orders or the so-called Vigilance Committee
proceeded to the rooms of the Hon David S

arm him by seizing a gun which the Judge
held in his hand A scuffle ensue in which
Hopkins failing to wrest the gun from the
Judge attempted to draw a pistol from be-
hind Judge Terry then drew a knife and in
fllcted a wound with ft upon Hopkins It is
needless to say that on the statement of facts

When this occurence took place I was on
business on Montgomery street. As soon as I
was Informed or it 1 went immediately to the
room of Messrs Terry and Ashe but learned
they were in the Armory on Dupout street.
I proceeded thither but tound the doors bar-
red and the Vigilance Committee people In
possesion of the entrance and street in
front. The alarm bell of the Vigilance Com-
mittee was Immediately sounded and all the
streets in neighborhood at once filled with the
military of toe Committee armed with mas-
ketsand a multitude of citizensallrnshiDg to-
gether in wild confusion and many of them
clamonng for the death of Judge Terry
About this time Dr Ashe opened one of the

that on the part of Judge Terry himself and
others they left the whole aBafr to an ar-
rangement between myself and the Vigilance

iested and tried by the Vigilance Committee
without danger of an immediate collision of
arms which would inrolve the peace or the
whole State the consequences or which no

eration and denarted with his associates to
confer as they said with other members of

said they believed they understood and wish-
ed 1 would communicate with them in writing
I immediately addressed a letter to Mr. Cole-
man and the other members of the Committee
demanding that Judge Terry should be left in
the bands of the civil authorities or if In the
power of the Committee should be restored to
them To this communication there was a
verbal answer that there was no reply
In the meantime the military of the Com-
mittee had surrounded the house in which
Judge Terry was situated planted cannon in
front of It and snecceeded in arresting the
JndC and Dr. Ashe ; but under what pledg

night all communication with Judge Terry or
Dr Ashe had been refused to their fnends
There were stationed at the different armo-
ries at this time only a small guard over the
arms. In a few of them portions of the com-
panies collected as fast as possible ; but they
were instantly surrounded by the military of
the Committee in large force and compelled
to surrender Resistance would have been
madness in the face of such an overwhelming
force Their arms were sel2cd and taken to
the rooms of the Committee and many of the
men arrested and marched as prisoners to the
fort or the insurgents
I have also to report that the arms (IIS
stand) delivered on your resqulsitlon to the
State by Gen. Wool while in the custody of
two officers of the State in a small Tessel on
their way to San Francisco were seized by an
armed party of the Vigilance Committee who
had been sent from the city for that purpose
in a Tessel armed with cannon and muskets
That when one of their officers demanded their
authority they produced the well known seal
and authority of the Committee and read it
commanding the seizure I also learn that
the arms shipped from Sacramento were sub-
sequently seized In the same way Thus has
this lawless band of men added piracy to their
other crimes and enormities
Seeing that there was no hope of effecting
anything In the city for the defence and pro
tectlon of those arrested I have esteemed it
my duty to report all the circumstances to
your Excellency that you may take such ac-
tion as your judgment may suggest.
The circumstances connected with this
movement are such as to leave no doubt on
my mind that the Insurgents aim at nothing
less than an entire overthow or the State
government and secession from the Federal
Union. If It bad been their purpose to dis-
band in a short period they would not hare
committed piracy by robbing a vessel or a
small quantity of arms upon the Bay
They would not subsequently have levied
actual war upon the State by surround-
ing the armories by a large military force
and seizing the State arms and making
prisoners of the men guarding them especi-
ally when they knew that your orders were
that I should act on the defensive and that
I had no power or means to pursue any other
line of conduct. It must be obvious to all
men of ordinary discernment that this law-
less association has proceeded from one crime
and outrage to another until they have ar-
rived at the conclusion that then is no safety
for their leaders but In revolution and a separ-
ate government on the Pacific They have
committed Treason Murder Piracy and the
felony or Kidnapping They have violently
and with force of arms trodden down the
authority of the Executive and the Judiciary.
They have at the point of the bayonet re-
sisted the execution of the writ of kaUas
rj.w for ages Justly considered the bul-
wark of personal liberty. They have assem-
bled around the jail of the county of San
Francisco large numbers of armed men and
planted a cannon against the front and thus
compelled the surrender of two persons there-
in detained In the custody of the law whom
they have since put to death without legal
trial or the forms of judicial proceedings
Thev have without a warrant or "any other

ing defenceless females. For nearly six weeks
they nave trampled down by an armed mili-

stitutional right secured to the citizens by

by the labors and sufferings of the sages and
Ktriott of 1776 They have erected In the
art of the commercial metropolis a fortifi-
cation tiled with armed men to orer-awe the
crUsests and the civil authorities. By dsy
and night they paraded In the streets large
bodies of armed men and San Froncisco pre-
sents continually the appearance of a city In

lanre Committee have armed aud hired a large
body of foreign mercenaries to shoot down
the Beers and dtfsens of the State In dis-
charge of the duties cast upon them by the
laws and their oaths of office

Men who have committed such crimes as
these against the Bute are naturally hurried
by fear and desperation. Before them Is the
abyss or revolution and secession; behind the
halter Thev dare not return under a ronr-
ment of honest judges with a prospect of

oot the commission of perjury. It Is a fact
worthr or notice that?
during this whole ex-
citement licentious as the press is the Dis-
trict Judges in San Francisco the highest
judicial officers in the city both as to civil
and criminal jurisdiction hare not even been
assailed. Their purity Is not questioned To
escape from the consequences of trial before
these officers members of the Vigilance Com-
mittee through their mouth pieces the press
have constantly clamored for their resigna-
tion They have demanded also the resigna-
tion of the Mayor the Sheriff; and all other
city and county officers on the avowed ground
that the Vigilance Committee could not die

ed with creatures of their own. Failing In
this object they see no safety but In revolu-
tion Knowing that the Executive dispatch-
ed by the last steamer a requisition on the
President of the United States for the neces
sary means to nut down this insurrection and
perfectly aware that the President under the

discretion but Is bound to furnish not only
arms but to employ all the land and naval
forces of the United States for that purpose
they perceive that their punishment is Inevi-
table that It i a mere Question of time.

for murder ; that so long as California is in

their fellow citizens after them Into anarchy
and disunion They seek to pnll all down to
the common Infamy of crime
It is doubtless true that up to the time of
the refusal of General Wool to grant arms to
the btate had he complied with the requisi
tion they would hare disbanded within four

ledge that the btate was comparatively desti

high handed measures outrages and crimes
They use their momentary power to gloat

It is difficult to understand what adeauate
motives there can be alleged for all this vio-
lence commot'on and crime The two most
prominent reasons given by the Vigilance
Committee arc tho uncertainty of the punish-
ment of crime bv the judicial tribunals and
the perpetration of election frauds by the of-
ficers of elections
If enmc is not punished in San Francisco
it is not for the want or able and upright
Judges It is owing to the corruption of the
juries. It will be admitted that the jury sys-
tem In San Francisco has not always been re-
nurkaMe for pnritr Bat whoe fault is this
That of the very merchants and hopkccr
who now mainly constitute the Vigilance
Committee They decline or skirk the duty
or serving on juries on any frivolous pretext
It is well known that a distinguished Judge
In that city not long since adjourned his
Court f-r the day alleging that he was
sickened with hearing business men commit
perjury in swearing to excuses to evade serv-
ing on juries This is an evil which the
members of the Vigilance Committee might
easily have corrected by the simple discharge
of their duty as citizens and the reform
would have produced a pure and efficient ad-
ministration of justice The evil Is not
likely to be made less by superseding as
Judges such men as Judges Norton Hager
and bhattuck by the creatures of the Vigt-
lance Committee If business men would dis-
charge their legal obligations as good citi-
zens there could be no necessity for Lynch
law and revolution But the greatest mon
trosity or all is that some of the very men
who as jurors refused to concur in a verdict
for the conviction of Charles Cora subse-
quently as members of the Vigilance Com
mittee voted to nang mm
As to election fraudsbribery and ballot-box
stuffinc there is no doubt that It has been a
notorious evil in San Francisco These crimes
have been resorted to to a inghtful extent
by all political parties but the punishment
has fallen exclusively upon the offenders In
one Some of the most notorious tternetrators
of election frauds are prominent members of
and symp&iuisers wun me igtiance uommii-
tee They are honored and protected mem-
bers of that treasonable association. Since
they have created anew punishmentunknown
to the law mat of banishment why do they
not mete equal justice to the offenders of all
parties? Again the Legislature at Its late
session had passed an effective remedy as to
San Francisco by naming several gentlemen
or character se'ected from all parties to ap-

the ballot-box a sufficient motive for all this
rebellion and civil commotion I The crimes
which the Vigilance Committee have commit-
ted against the laws and society are of a
much blacker die and more injurious to so-

of those men whom thev have sent into exile.
To make the remedy complete and purify soci-
ety they should follow the men they have

The doctrine they proclaim can never be
productive of anything but disorder and anar-
chy The Incuiate openly that a maiorltv
of the citizens of any single city may over-
throw the government of that locality and
supercede Its officers although that govern

a constitution established bv the neonle of
California They assume to enact a new crim-
inal code and appoint new Judges under
which and by whom the citizens of any coun-
ty in the State accused of crime In San Fran-
cisco may be arrested and sent to excution

California andin effect declare that the mer-
chants and shop keepers of San Francisco are
not only the State but the only people in It
who have any of the rights of the governing
class They insult all other portions of the
State and treat the people of the other coun-
ties as their vassals
Neither can these men escape scrutiny into
their motives. Thev are not nnrelv those of
the public good There are In the Vigilance
Committee some merchants of wealth and
business integrity There are a host of
others on the verge of bankruptcy. There
arc men unable to make remittances before
this commotion began and who are now urg-
ing its prolongation because it affords thema
piaustDje excuse lor not sending per mau
funds which they are unable to remit. No
one wishes to take out an attachment or fore.

the Courts are practically closed. Capital is
timid and shrinks from Insurrection civil
commotion and the conflict of arms but a
man who trades on borrowed capital and in
an untried hour is little more affected by the
losses of bis creditors and landlord than the

tate the city. An ocean of flame burns noth-
ing that he can call his own. What right
hive such men to kidnap one of the Jndgea or
the Supreme Court a gentleman who & the
soul of honor and truth? How dare these
traitors thrust Dr. Ashe into their dungeon
erected at the expense of their creditors a
gentleman who has committed no offence and
upon whose Integrity the mildew of calumny
has never for a moment rested. r
Are the people of California descendants of
men who can guard liberty with their sword
or some bastard race reduced to slavery on
the shore of the Pacific by shopkeepers and
merchants? When shall we ell be sold In
market to pay their debts In New York and
Boston?
No one who has closely observed the pro-
ceedings of the Vigilance Committee for the
last few days can doubt that it baa rank into
a mere political machine Even if the asso-
ciation should not have the nerve to proceed
with the revolution and overthrow of the
Government It is manifest that for the last
three weeks it has been a mere party enxins-
The leading spirits ontaMa and i bsioncu a
certain political combination art well kaewn
and marked for their former political associa-
tions and affinities. They cannot dtanlse
their selfish and unholy asabWon. Their pur-
pose is various: some wish for a separation
from the Union others to ossrtiane the asso-
ciation until after the November election for
mere party purposes. They think they see in
it a potent lever for controlling the i eUotloas
in laiuornia.

Nothing can with safety be received as evi-
dence of an intention to disband this danger-
ous organization but the delivery of their
arms and a submission on the part of the
twenty-nine arrests and trial by the civil
authorities. It Is well known that not long
since a large quantity of George Law mus-
kets ww skipped to San Francisco on sneculs-
tion to aba of the members of the Committee
These muskets were purchased or seized by
the insurrectionists together with all others
In the market on sale They also seized the
only two pieces of ordinance belonging to the
State and have taken or purchased all others
In the market. These men should not be per-
mitted to disband nominally and yet retain

the public peace and security.

will rally to the support of the constitution
and the laws To thtnk otherwise would be to
retard them as slaves tn feelinir. as well as
vassals in fact It Is not In the nature or
things that Americans will supinely witness
their government overthrown their Isws and
liberties subverted without striking a Mow
to prevent it They will not e the lives of
some or meir most vaiuea citizens ssenncea
to the vengsneeof traitors without attempt-
lar to rescue them They will not see the
dungeons or the Vigilance Committee filled
with unoffending men without striking a blow
to deliver them. They will not see one or the
highest judicial officers In the State a man of
honor or sterling integrity of unstained rep-
utation seized condemned and ordered to ex-
ecution without a trial when he has commit-
ted no offence for which any jnry in Christen-
dom would condemn him The honest vcomsn-
ry and miners In the country have hearts and
the sentiments and the souls of honest and
free men Call them to the rescue with their
rifles and such arms as they pomcw they will
respond to the call and redeem the country
from this deep disgrace which is a stain upon
every citizen however iambic. The sober
people have right hearts and stout arms They
have made the country what ft is in peace and
war and will never fail to redeem It in the
hour or danger and public calamity Let them
deal with the traitors
