Klondike News

John celebrated his 75th
birthday this week. I saw a
T-shirt that said “Growing
older is mandatory -growing
up is optional.” Anyone who
knows John knows how true
this is for him. He practices
being child-like and has it
almost perfected now!
Mikka (Johnson) Day and
daughter Maddison were
visiting family in Klondike
this weekend. Maddison is
growing so quickly that she
changes each time we see
her.
Besides the regular visitors
to the Stone home this
week, they also had a visit
from great-granddaughter
Brooklyn Jordan. The Stones
also took advantage of the
great weather to take a ride
on a couple of days.
Patricia Blundell heard from
all her children this week.
Billy Martin joined her
at church on Sunday. He
enjoyed both the services and
the pot luck lunch afterward.
Patricia returned home to find
an unwelcome, uninvited
“guest” in her bathroom — a
snake. She stunned it with
a dustpan and tried to pick it
up with a cloth over its head
but it was not quite “out”. It
wrapped its tail around her
wrist and she couldn’t get it
off. The snake tried to strike
her and she dropped. She
covered it with the cloth and
stepped on it and held it with
her foot but the tail was still
wiggling. She managed to get
the phone and call for help.
Billy Martin came, killed
the snake and got rid of it.
Only then did he tell her that
the snake was a copperhead!
Patricia sends this warning
to all — be careful! It could
happen in your bathroom.
Patricia was leaving for a few
days vacation when we spoke.
Hope she has a great time.
Wanda Helms and her
family had a birthday lunch
for Kendra and Houston on
Sunday. Joining the family
were Martha Clark, Lisa and
girls. In an effort to slow
down children’s growth, the
numbers in Kendra’s and
Houston’s ages were added
together. So 13 became
1+3=4 and 16 became 1+6
= 7. This plan was quickly
rejected by the teenagers
involved!

Mable Wheat had son Hershal
visiting again. He was
again helping Jerrell with
moving. On Saturday night,
he accompanied Mable to a
fish dinner at the church. On
Sunday Mable said she cooked
“real food” and Hershal said
she cooked too much. But
Mable said she would have
something besides sandwiches
this week!
Tina Rainey said school is
going well this year. Some of
her little ones are still excited
about the new school year and
can’t seem to stop talking yet.
Before school started Tina,
two sisters and a friend took
a cruise to Mexico. It was the
first time for each of them and
they had a good time. The

Landowners could get a payment from,
and have legal rights in, a $1,365,523.90
Settlement for a Rail-Trail Class Action
A settlement has been reached in a class action
about whether the United States has taken an
easement for trail use and possible future rail use
over certain class members’ lands. Those lands
are in Collin, Hunt, Fannin, Delta, or Lamar
Counties, Texas, next to or over which a railroad
company had a right of way between Farmersville,
Texas, and Paris, Texas. A $1,365,523.90
settlement fund will pay landowners’ claims.
The United States District Court for the Eastern
District of Texas will have a hearing on December
2,2009, to consider whether to give final approval
to the settlement so that payments can be made.
Those included in the class action, together called
a “Class,” may object to the settlement and ask to
speak at the hearing. If you did not recently receive
a detailed notice in the mail, one is available by
calling toll free or going to the website (both listed
below).
Who’s Included?
The detailed notice explains who is affected.
Generally, if on June 20, 1995, you owned
property in Collin, Hunt, Fannin, Delta, or Lamar
Counties, Texas, next to or over which a railroad
company had a right of way between Farmersville,
Texas, and Paris, Texas, which has been
dedicated to trail use, then you may be entitled to
money for settlement damages.
What Does The Settlement Provide?
A full copy of the Stipulation and Settlement
Agreement (“the Agreement”) is available at the
website or a toll free number below. In short, a
$1,365,523.90 settlement fund will be established
to pay Class members. The United States has
stipulated to the liability in this case.
How Much Could You Get?
Payments will be based on the appraised value
of the taking plus interest, as follows: The
appraised value is based on the impact that the
rail-trail easement had on your property as of June
20, 1995, up to a limit of $10,000 per claim.
Payment will also include compound interest
calculated from June 20,1995, to approximately
the day that the United States deposits the money
into the settlement fund.
How Do You Ask For Payment?
You must submit a claim form to establish
entitlement to payment. A detailed notice and
claim form package contains everything you need.
Just call or visit the website below to get one. The
claim form must be faxed or postmarked no
later than October 10,2009.
What Are Your Other Options?
If you don’t want a payment and you don’t want
to be legally bound by the settlement, you must
exclude yourself by October 10, 2009. If you
exclude yourself, you can’t get a payment from
this settlement. If you stay in the Class, you may
object to the settlement by October 10,2009. The
detailed notice describes how to exclude yourself
or object. The Court will hold a hearing in this
case on December 2,2009, to consider whether
to approve the settlement and attorneys’ fees and
expenses. You may appear at the hearing but you
don’t have to.

of Tax Revenue
Increase
The CITY OF COOPER conducted public hearings on September 3, 2009
and September 8, 2009 on a proposal to increase the total tax revenues of
the CITY OF COOPER from properties on the tax roll in the preceding year
by 6.920110 percent.
The total tax revenue raised last year at last year's tax rate of 0.988130 for
each $100 of taxable value was $486,289.80.
The total tax revenue proposed to be raised this year at the proposed tax
rate of 0.988130 for each $100 of taxable value, excluding tax revenue to be
raised from new property added to the tax roll this year, is $519,940.35.
The total tax revenue proposed to be raised this year at the proposed tax
rate of 0.988130 for each $100 of taxable value, including tax revenue to be
raised from new property added to the tax roll this year, is $522,818.77.
The CITY COUNCIL is scheduled to vote on the tax rate that will result in
that tax increase at a public meeting to be held on September 14, 2009 at
CITY COUNCIL CHAMBER, 91 NORTH SIDE SQUARE, COOPER, TX 75432 at
6:00 PM
